  • Noting with regret the prolonged argument recently on the RMB with regards to a regional member’s real-life situation.

  • Also noting that the argument was continued despite that regional member stating multiple times that they no longer wished for anybody to discuss that real-life situation.

  • Believing that real-life situations are inherently more important than issues or debates on NationStates.

  • Supporting the right to privacy of all individuals.

      1. Any nation has the right to stop the rest of the region from talking about a real-life situation in that nation’s life.
        a) this does not apply to wider political occurrences or issues, only to personal situations

      2. If a nation wishes to trigger Article 1, they merely have to state in the RMB that they wish for all other nations to stop discussing their situation.
      3. When this has been done, no regional member may discuss that real-life situation.

        a) if they continue to do so, these messages will be suppressed.

      4. Article 3a may be applied retrospectively.

  • Hereby passes the Protection of Real-Life Interests Act

In a bid to solve this legal debate and put an end to the arguments, whilst setting an important precedent, I have drafted some legislation.

    good thinking :)

Would go against the constitution, but ig that doesn't matter

The Glorious State of Corbyn wrote:Would go against the constitution, but ig that doesn't matter

Not really? The Constitution doesn't protect your rights in the RMB, it protects your rights for the founder not to abuse his power and to respect the rule of law. The law that Belac is proposing has a retrospective clause in it, so would allow the suppression of those posts, in line with the Constitution.

Furthermore, as stated in the Constitution (I should know i wrote the damn thing):
    Article 4: "Citizens' Inalienable Rights"
    (1) The right of Expression, notwithstanding the provisions of pre-existing laws that limit the extent of this right, shall not be infringed, except by Constitutional Amendment. This right extends to opinions, whether they be contrary to that of the ruling party or not; insults that do not exceed the levels of correctness outlined in pre-existing legislation; religion and religious obligation; and other significant areas of contention. To better allow for flexibility over this controversial issue, the Slide Court shall interpret this Right, and the pre-existing legislation, to the best of their abilities.

The Constitution clearly states that laws with regards to RMB use are primary - if the will of the people suggests further restrictions on what people can say in the RMB there is precedent in the document itself to allow limitations on Freedom of Speech.

In fact, it even directly states "the Slide Court shall interpret this Right [...] to the best of their abilities". If you take it up with the Slide Court, I would find it rather likely that discussing personal info when asked to stop would be something that the court would object to.

    have to agree

The Glorious State of Corbyn wrote:Although the Clarification of the position of great leader act states that the founder may "B. Break, make or repeal laws at any time for the good of the region", the constitution states that the founder must "c. Agree to respect the rule of law and the decisions of the democratic bodies of the region", and this is clearly against RMB laws. It cannot be suggested that the clarification act has more power, as the constitution states "c. In any way overrule or repeal the provisions of this document.".

If the above isn't good enough, I am happy to "submit an appeal to any officer for voting in the region. if a majority is achieved against the action
then repealed laws will be placed into law once more, new laws will be stuck out and any law breakages will be treated as they would any other regional member.", in this case that officer being myself. This action would also be enforceable wherein the constitution states that the founder must not "e. Seek to directly interfere with the democratic process in the region.", which going against that decision would definitely be.

Equally, the posts can be unsupressed and the issue will be quickly resolved.

Article 3a states the founder must not “Infringe upon the rights and liberties outlined in this document without genuine necessity”

Legally this is somewhat open to interpretation and i would argue there is ‘genuine necessity’ in this case.

Therefore I disagree that “ The constitution is very clear on the issue”, as you have said.

Necessity in the constitution would insinuate something has implications for the whole region.

Anyway, I won't argue the point, but I think it's pretty outrageous for someone to say something like that, and when others say it's a bad idea (having been asked their thoughts) they are dumped on.

The Glorious State of Corbyn wrote:Necessity in the constitution would insinuate something has implications for the whole region…

I disagree. ‘Necessity’ only insinuates that the situation is one in which the Founder feels they must intervene. Doesn’t have to apply to the whole region.

You were free to say it was a bad idea, until he made it clear he wanted everyone to stop talking about it. At that point, leave him alone.
