Only if all nations involved opt-out. You attack a nation who has opted in or a nation who has not voted TOPHAT will be involved. This is because by opting-in a nation essentially asks TOPHAT to protect them until they choose to opt-out and until a nation opts-out they are guaranteed protection by TOPHAT.
