That section of the RMB Act has to be backed up with a valid justification. And the status of citizenship does not affect the application of the Charter of Rights and Responsibilities or the RMB Act.

Look, I recognize I am an unpopular player and I have many regrets regarding the past, but I also have only ever been a civil participant here on the Regional Message Board.

It’s been five years since my initial forum ban in TRR, and instead of the ban being relaxed, it’s now being expanded. So why is it being expanded now? Are there any new accusations? In fact, has anyone who I’ve spoken with in the past five years felt I’ve made them feel unsafe? I don’t pretend to be perfect, but I also don’t see how my posts here could be defined as creating an unsafe environment.

The precedent being set here could significantly weaken the rights and freedoms of rejects — especially if (1) citizenship is held to impact the interpretation of rights (2) claims of safety aren’t rationally related to the ban, and (3) the censorship of players is delegated to unelected surrogates who suppress players freely.

Discord channels are not subject to the same legal standards because they are private entities. The RMB is a public sphere. The law of the land has long recognized that the free use of the Regional Message Board is an extension of the Rejected Realms’ democratic society and its liberal constitution.

This was my home region for years, long before any Discord ban. I’ve been writing about the Rejected Realms’ constitutional law for a decade, and I have always advocated for a policy of free expression here and abroad — this is not inconsistent coming from me.

The law doesn’t provide for some “blacklist” system where you pick and choose the “bad” people and suppress them arbitrarily. The law provides for suppression only to maintain a safe and open environment — an example (and the intent of the law’s author) would be suppressing Nazi content. A suppression has to be rationally connected to keeping an environment safe and open.

Have I posted something here that would make someone feel unsafe or discriminated against? No.

Have I even made anyone feel unsafe on any platform (including Discord) in five years since my initial forum ban?

Does the delegate have any reasonable grounds to think I’m going to start posting something discriminative or harassing or abusive or anti-semitic or homophobic or inappropriate?

Within the next year, I’ll have been blacklisted from TRR for longer than I was a Gameplayer. People like Tim continue to assert that the bans against me should not only continue but be intensified, without any new reason to think I will act inappropriately in spite of me continuing to chat with many NSers and maintaining friendships where I can over the past five years.
