Second Constitution of Rageria

CONSTITUTION II

ARTICLE I - THE EMPEROR

(1) His Imperial Majesty, the Emperor of the Ragerian Imperium, henceforth referred to as the Emperor, and taking the place of the Imperial Crown, shall serve as the Head of State for the Ragerian Imperium, henceforth referred to as the Imperium.
(2) The Emperor may remove any individual from any Office of the Imperium, political or otherwise, at any time or for any reason.
(3) The Emperor shall serve as Commander-in-Chief of all military and intelligence forces of the Ragerian Imperium, and no law may supersede this right. The Emperor may establish, modify, and remove, as well as govern, any military and intelligence forces as he sees fit.
(4) The Emperor may issue Imperial Edicts, henceforth referred to as Edicts to govern the region from the Throne.
(5) The Emperor may repeal or modify the Imperial Edicts defined in (4), at his leisure.
(6) The Emperor shall be responsible for defining requirements for Citizenship that extend beyond those established by law.
(7) The Emperor shall be responsible for overseeing the processing of Citizenship applications, with the Grand Councillor responsible for the processing thereof.
(8) All legislation from any legislature that may be established within the Imperium must be given Imperial Assent, henceforth referred to as Assent, by the Emperor before becoming Imperial Law, except for in extenuating circumstances defined in Article V.
(9) The Emperor may impose Imperial Banishment on any member of the Imperium.
(10) The Emperor may issue an Imperial Pardon on any member of the Imperium convicted of a crime by the Imperial Court.
(11) The Emperor may revoke the Citizenship of any member of the Citizenry via a notice of Imperial Revocation.
(12) The Emperor shall be responsible for appointing the Grand Councillor of the Ragerian Imperium.
(13) The Emperor shall be responsible for appointing the Chief Justiciar of the Ragerian Imperium.
(14) The Emperor’s Citizenship is guaranteed, and may not be removed by any law or procedure.
(15) All decisions of the Imperial Crown are exempt from any judicial review.
(16) The Emperor may establish and govern colonies of the Ragerian Imperium as he sees fit.
(17) The Emperor may grant titles and styles of Nobility to members of the Ragerian Imperium as he sees fit, and may revoke these titles at any time.

ARTICLE II - THE LORD PROTECTOR

(18) His Imperial Lordship, the Lord Protector of the Ragerian Imperium, henceforth referred to as the Lord Protector, shall serve as the chief transitional authority of the Imperium.
(19) At the time of the passage of this Constitution, the Lord Protector shall be Naj.
(20) In the event of the abdication of the Emperor, the Lord Protector shall be responsible for (a) naming the Prince of the First Rank the Emperor in the event that the Emperor has named a successor, or (b) naming a responsible Citizen the Emperor in the event that the Emperor has not named a successor.
(21) The Lord Protector’s Citizenship is guaranteed, and may not be removed by any law or procedure.
(22) The Lord Protector shall name a successor upon resignation, who will immediately assume the Lord Protector’s position upon that resignation. Shall a successor not have been named, the Emperor shall be responsible for naming a new Lord Protector.
(23) The Lord Protector may be granted powers afforded to the Imperial Crown under Article I and elsewhere in this document, provided that the Emperor has listed which powers the Prince of the First Rank may and may not exercise in the Imperial Palace of the forums. If no such listing of powers is posted, it is assumed that the Lord Protector may exercise no powers other than those defined by law.

ARTICLE III - THE PRINCE OF THE FIRST RANK

(24) The Emperor may name a successor to the Imperial Crown. This successor shall be titled and styled His Imperial Highness, the Prince of the First Rank of the Ragerian Imperium.
(25) The Prince of the First Rank may be granted powers afforded to the Imperial Crown under Article I and elsewhere in this document, provided that the Emperor has listed which powers the Prince of the First Rank may and may not exercise in the Imperial Palace of the forums. If no such listing of powers is posted, it is assumed that the Prince of the First Rank may exercise no powers other than those defined by law.

ARTICLE IV - THE IMPERIAL COUNCIL

(26) The Grand Councillor of the Ragerian Imperium, henceforth referred to as the Grand Councillor, shall serve as the Head of Government for the Imperium.
(27) The Grand Councillor shall be responsible for the day-to-day business of management of the Imperium, other than specific responsibilities granted to officials by law.
(28) The extent to which the Grand Councillor’s governing authority extends is at the discretion of the Imperial Crown.
(29) The Grand Councillor shall, at the leisure of the Emperor, direct the executive policy of the Imperium.
(30) The Grand Councillor may create, destroy, and modify Executive Departments at their discretion.
(31) The Grand Councillor is responsible for determining the composition, including appointment and removal of members, of the Imperial Council and the titles of members on that Council.
(32) The Grand Councillor is responsible for determining the duties of members of the Imperial Council.
(33) The Grand Councillor may propose Treaties to the Senate.
(34) The Grand Councillor may Declarations of War to the Senate.
(35) The Grand Councillor serves as the Chief Member of the Imperial Council, responsible for providing its collective opinion to the Imperial Crown.

ARTICLE V - THE IMPERIAL SENATE

(36) The Imperial Senate (The Senate) shall serve as the principle legislative body of the Imperium. Unless otherwise specified, actions taken by the Senate shall require a simple majority of Senators voting to take.
(37) The Senate shall be comprised of three Noble members of the region, appointed by the Emperor.
(38) The Prince of the First Rank shall be the President of the Senate and shall be responsible for the management and upkeep, as well as opening and closing votes on the Senate floor.
(39) Only Senators and those invited to speak by Senators shall be permitted to speak on the Senate floor.
(40) Proposals by Senators on the Senate floor must be on the floor for forty-eight hours before they can be motioned to vote, although this period can be waived by unanimous consent of the Senate.
(41) The President of the Senate shall bring items to vote at their discretion or at the motion and second of other Senators, pursuant to (40).
(42) Votes in the Senate shall last for twenty-four hours or until all Senators have voted.
(43) Pursuant to Article III, sections (33) and (34), the Senate may approve requests for Treaties and Declarations of War from the Grand Councillor.
(44) The Senate may remove the Grand Councillor from office by unanimous vote.
(45) The Senate may remove the Chief Justiciar from office by unanimous vote.
(46) The Senate may remove an Associate Justiciar from office by unanimous vote.
(47) The Senate may remove a member of the Imperial Council from office by a ⅔ majority vote.
(48) All actions of the Senate do not require the consent of the Citizens’ Assembly, while the inverse is not true.
(49) All actions of the Senate requiring consent of the Imperial Crown or Imperial Assent will be delivered by the President of the Senate to the Visitors’ Hall of the Imperial Palace for receiving such consent or Imperial Assent from the Imperial Crown. If the item brought to the Visitors' Hall does not receive assent in five days, the Senate may motion and vote to pass the item anyways, with a 2/3 super-majority.
(50) The President of the Senate may appoint a Deputy President to fulfill the duties of the Office of the President should the President be unable to fulfill its duties. Should the President of the Senate and the Deputy President, if there is one, be absent for more than three days, the Imperial Crown shall become responsible for the procedural duties of the President of the Senate, although the Imperial Crown will not have a vote.
(51) Further procedures for the Senate may be defined by law.

ARTICLE VI - THE CITIZENS’ ASSEMBLY

(52) The Citizens’ Assembly of the Ragerian Imperium, henceforth referred to as the Citizens’ Assembly or the Assembly, shall be the secondary legislative body for the Ragerian Imperium.
(53) The Citizens’ Assembly shall elect a Speaker to preside over the Assembly once every two months.
(54) The Speaker of the Citizens’ Assembly shall be responsible for the upkeep, maintenance, and opening and closing of votes for the Citizens’ Assembly.
(55) The Citizens’ Assembly shall be able to pass bills regarding its own governance without the consent of the Imperial Senate. Other bills passed by the Citizens’ Assembly shall require the consent of the Senate.
(56) Shall a bill passed by the Citizens’ Assembly require consent of the Imperial Senate, as determined by (55), the Speaker of the Citizens’ Assembly shall be responsible for posting the passed bill on the Senate floor. For the purposes of privilege to speak, it is assumed that the Speaker of the Citizens’ Assembly is always invited to speak on the floor of the Imperial Senate for the express purpose of posting bills passed by the Citizens’ Assembly.
(57) Bills proposed on the floor of the Citizens’ Assembly must remain so for forty-eight hours before they can be motioned to vote.
(58) A bill must receive a motion and a second to be brought to vote.
(59) The Speaker will be responsible for bringing the bill to vote upon the occurrence of a motion and a second.
(60) For the purposes of the Citizens’ Assembly, all Citizens will be able to participate in proceedings, however, Senators will not be able to vote if consent of the Senate, as established by (60) is required. If consent is not required, however, Senators will be eligible to vote. The Emperor will not be eligible to vote in the Citizens' Assembly.
(61) Votes in the Citizens’ Assembly will last forty-eight hours or until all eligible voters, as established by (60) have voted.
(62) The Citizens’ Assembly may impeach a Senator with a ¾ majority.
(63) The Citizens’ Assembly may impeach their Speaker with a ¾ majority.
(64) The Speaker of the Citizens’ Assembly may appoint a Deputy Speaker to assist with the duties of the Speaker’s Office and to exercise the duties of the Speaker’s Office at the leisure of the Speaker or in the absence of the Speaker.
(65) Should the Speaker of the Citizens’ Assembly and the Deputy Speaker, if there is one, be absent for more than three days, the Imperial Crown shall become responsible for the procedural duties of the Speaker of the Citizens’ Assembly on an interim basis.
(66) Unless otherwise specified, actions taken by the Citizens’ Assembly shall require a simple majority of Citizens voting to take.
(67) Procedures for the Citizens’ Assembly may be further defined by additional law.

ARTICLE VII - THE IMPERIAL COURT

(68) The Imperial Court of the Ragerian Imperium, henceforth referred to as the Imperial Court or the Court, shall be comprised of one Chief Justiciar and a number of Associate Justiciars.
(69) The Imperial Court possess the sole judicial authority in the Ragerian Imperium.
(70) The Court shall preside over all trials in the Imperium, criminal and civil.
(71) The number of Associate Justiciars on the Court shall be determined by further acts of law, but must not exceed nine, be less than three, or be an even number.
(72) Associate Justiciars of the Court shall be appointed by the Chief Justiciar on the Senate floor. Such nominations require a ⅔ majority of the Senate to consent to.
(73) For the purposes of privilege of speaking on the Senate floor, consistent with this law and the provisions of (76) specifically, it is assumed that for the express purpose of appointment of Associate Justiciars, that the Chief Justiciar always have invitation to speak on the Senate floor.
(74) No Justiciar can also serve as the Emperor, Grand Councillor, Speaker of the Citizens’ Assembly, President of the Senate, or Lord Protector concurrently.
(75) Further procedures for the operation of the Imperial Court may be defined by acts of law.

ARTICLE VIII - ELECTORAL PROCESS

(76) The Imperial Crown shall be responsible for the holding and counting of elections in the Ragerian Imperium.
(77) All Citizens are entitled to vote and run in every election, unless their Citizenship application has been accepted in the last week, from the date that standing opens.
(78) General elections for the Office of Speaker of the Citizens’ Assembly shall occur in February, April, June, August, October, and December.
(79) Standing for a general election shall open on the first day of the month specified, in a post made by the Imperial Crown, and shall remain so for forty-eight hours. Candidates may post their campaigns in the authorized section of the forums during this time.
(80) Additionally, on the post opening standing, the Imperial Crown must provide a list of all Citizens who meet the requirements for eligibility to run, as determined by this law and other additional acts of law. If a Citizen isn’t on this list, they may not stand in the election.
(81) Following the standing period, campaigning shall remain active for an additional forty-eight hours.
(82) Following the conclusion of the campaigning period (although candidates may continue to campaign during this period), voting will open. This will remain so for forty-eight hours.
(83) If, for any reason, due to loss of Citizenship, resignation, or impeachment, the Office of Speaker of the Citizens’ Assembly becomes vacant, the Imperial Crown will endeavor to open standing for a by-election as soon as is reasonably feasible. By-elections will follow the same procedure established by the preceding sections of this article.

ARTICLE IX - GENERAL RESPONSIBILITIES

(84) The Imperial Crown and the Grand Councillor shall be jointly responsible for maintaining a list of all Citizens, including their forum account and Citizenship nation, which shall be publicly viewable to all members of the Ragerian Imperium.
(85) All losses of Citizenship due to provisions established by law must be posted publicly by the Grand Councillor and Imperial Crown, jointly.
(86) All Offices and positions defined in this piece of law are considered to be automatically vacated in the event that the official in question loses Citizenship, due to provisions established by law.
(87) A prospective citizen of The Ragerian Imperium must have a declared nation in the region of the Ragerian Imperium or one of its colonies to receive Citizenship.

ARTICLE X - BILL OF RIGHTS

(88) Every Citizen shall have the right to freedom of speech, so long as it does not actively and intentionally provoke or offend others, threaten their rights or damage the security of the Ragerian Imperium.
(89) Every citizen is entitled to equal and fair protection under the law.
(90) Every citizen is entitled to a free and fair trial by the Justiciars.
(91) Every citizen put on trial is to be treated as innocent until proven guilty.
(92) Any person may apply for citizenship, and be approved or denied by the Imperial Crown or Grand Councillor.

ARTICLE XI - ENACTMENT

(93) Constitution of the Ragerian Imperium is repealed in its entirety.
(94) Constitutional Amendment #1 is repealed in its entirety.
(95) The Assembly Procedures Bill is repealed in its entirety.
(96) The Civil Service and Employment Act is repealed in its entirety.
(97) The Judicial Definitions and Regulations Act is repealed in its entirety.
(98) The Repealment Act is repealed in its entirety.
(99) All prior Imperial Edicts are repealed in their entirety.
(100) At the time of passage of this document, Vulturret (Vultus Rex I) shall be Emperor and Samsonyte (Samsonyte I) shall be the Prince of the First Rank.

ARTICLE XII - MODE OF AMENDMENT

(101) All amendments to this document initiated in the Citizens' Assembly require a 3/4 majority of the Citizens' Assembly to pass.
(102) All amendments to this document in the Senate require a 2/3 majority of the Senate to pass.
(103) All amendments to this document require the Assent of the Imperial Crown.

APPENDIX

(104) For the purposes of this document, “the Ragerian Imperium” is defined as the on-site NationStates region, as determined by the Imperial Crown, the off-site forums, as determined by the Imperial Crown, and the Discord server, as determined by the Imperial Crown.
