The Domestic Air Accident Compensation Act

ESTABLISHING that WA legislation lacked on fair and stable compensation for aeronautical accidents,

UNDERSTANDING that our nation lacked any compensation at all for those accidents,

I, Emperor Conall Solis, officially enact THE DOMESTIC AIR ACCIDENT COMPENSATION ACT and enforce it immediately with the following provisions.

SECTION I - EFFECTIVE AGENCIES MANDATED TO COMPLY

ARTICLE I - Any airline that was founded in, has their main headquarters in or only services flights from the Empire shall be held to comply with this legislation.

ARTICLE II - An airline of an international nature that has operations in the Empire shall be held to comply with this legislation.

ARTICLE III - All private airlines and air services that shall fly citizens within the Empire shall be held to comply with this legislation.

ARTICLE IV - All airplane manufacturers within the Empire shall be held to comply with this legislation. Any airplane manufacturer used by domestic airliners may be mandated to comply with this legislation.

SECTION II - DEATH COMPENSATION OF CIVILLANS

ARTICLE V - Shall a civilian die of a crash on an airline, that civilian's significant other if they have one, or that civilian's immediate family shall receive Apologetic Death Compensation. If the fault was proven to be of the airline or of the manufacturer, then an additional Airline/Manufacturer Fault Compensation shall be issued.

ARTICLE VI - Shall a civilian die of a crash on any other type of flight, that civilian's significant other if they have one, or that civilian's immediate family shall receive Manufacturer Fault Compensation should the manufacturer of the vehicle be found at fault. Apologetic Death Compensation shall not be issued in this case.

SECTION III - NATIONAL AERONAUTICAL SAFETY BOARD

ARTICLE VII - This legislation shall establish the National Aeronautical Safety Board under the Ministry Of Energy, Infrastructure & Environment with the sole power to investigate air safety incidents and rule on compensation as outlined under this act.

ARTICLE VIII - The NASB may not regulate airlines or aeronautic manufacturers directly, however, the NASB may enact safety policies that can be enforced upon those two categories of effective agencies.

ARTICLE IX - The NASB may assist in any international investigation as such requested and granted.

ARTICLE X - The NASB shall investigate all air safety incidents within the effective agencies regardless of jurisdiction.

SECTION IV - INVESTIGATION & LIABILITY OF EFFECTIVE AGENCIES

ARTICLE XI - No effective agency shall be held liable to foreign laws or punishment for crimes under this act, and shall hereby be mainly investigated by the NASB.

ARTICLE XII - The NASB Chairperson and Minister Of Diplomatic Affairs may jointly waive Article XI for an incident as seen fit.

ARTICLE XIII - Only the NASB shall investigate any incident, unless so requested by the NASB Chairperson.

ARTICLE XIV - Effective agencies shall hereby be required under this article to produce any and all requested evidence pertinent to an NASB investigation without a warrant or authorization of the courts.

ARTICLE XV - All effective agencies shall assist and cooperate in all NASB investigations as requested.

SECTION V - INJURY COMPENSATION OF CIVILANS

ARTICLE XVI - Shall a civilian become injured on an airline due to a fault of the airline or of the manufacturer, then Airline/Manufacturer Fault Compensation shall be issued.

ARTICLE XVII - Shall a civilian become injured on any other type of flight due to a fault of the manufacturer, then Manufacturer Fault Compensation shall be issued.

SECTION VI - APOLOGETIC DEATH COMPENSATION

ARTICLE XVIII - ADC shall be compensation issued automatically upon the confirmation of a crash by the NASB or the airline affected. No repayment shall be required shall the fault not be of the airline or the manufacturer.

ARTICLE XIX - ADC shall be a value up to 100% of the original purchase cost of the airplane crashed in question, including seats and upgrades.

ARTICLE XX - Any receiver of an ADC may dispute the awarded compensation with the NASB who may overturn and order a higher or lower value.

SECTION VII - FAULT COMPENSATION

ARTICLE XXI - Fault compensation shall be issued upon a ruling by the NASB of faults being found in a crash by the airline or manufacturer.

ARTICLE XXII - An airline may choose to issue fault compensation early, and may order repayment shall the NASB rule no-fault. Manufacturers may not issue it early.

ARTICLE XXIII - Fault compensation for deaths shall be 6% of an airline or manufacturer's income from the previous year.

ARTICLE XXIV - Fault compensation for injuries shall be SLO$430,000 for serious or life-threatening injuries, SLO$215,000 for severe injuries, SLO$107,000 for minor and other injuries and SLO$3,000 for no injuries at all.

ARTICLE XXV - Any civilian may petition the NASB to overview fault compensation and potentially increase or decrease it. Increases over the statutory amount may only be authorized by the Minister Of Energy, Infrastructure & Environment.

SECTION VIII - GOVERNMENT REIMBURSEMENT PROGRAM

ARTICLE XXVI - Shall an airline or manufacturer be found to be at fault in the death of any state official, they shall pay triple the original amount of fault compensation to their significant other or immediate family and double the amount of ADC and pay that directly to the state.

ARTICLE XXVII - The GRP shall not apply to foreign government officials and diplomats (excluding ours).

SECTION IX - BAGGAGE REIMBURSEMENT

ARTICLE XXVIII - Shall any baggage go missing due to the fault of the airline or manufacturer, baggage reimbursement shall be issued.

ARTICLE XXIX - Baggage reimbursement shall be the total cost of all lost items' value plus 5%.

ARTICLE XXX - Baggage claims and investigations shall only be conducted by the airline or manufacturer. One may appeal a decision of reimbursement to the NASB.
