The Constitution

Preamble


We, the Nations of Atlanticana, seek to establish a welcoming abode for those who practice fairness and tolerance to others, and erect it as a rampart against bigotry, extremism, fascism, shaming, and all other forces that promote the subduing of individuals for who they are. We aspire to found and protect a community valuing mutual respect, equity, fairness, and solidarity. We are determined to provide to individuals of all walks of life a warm and welcoming haven where their identity will be respected and cherished.

Convinced that Atlanticana may only be a home to its members by empowering them to shape its future, we do hereby ordain and establish for the Region the following Constitution as its supreme legislative source and a guiding force in the progression of this community.

Article I

The Constitution and the Skylands


Establishment of the Cosmic Dreamscape

§01. The Region of Atlanticana and all of its platforms and extensions shall be consolidated in a sovereign republic known as the Cosmic Dreamscape of Atlanticana.

§02. Atlanticanan Institutions shall not provide for the irreversible surrender of regalian powers to foreign entities or the merger of Atlanticana to a foreign region.

Constitutional Supremacy

§03. The present Constitution shall rest on the top of the Atlanticanan normative hierarchy as the supreme law of the Region.

§04. Laws and other normative acts in contradiction with the provisions of this present Constitution shall, to the extent of their incompatibility, be considered null and void.

§05. Notwithstanding the above, no part of this Constitution shall be construed as:

  1. Mandating the deployment of powers not mechanically available or the accomplishment of legally, physically, or mechanically impossible acts.

  2. An impediment for the Delegate and other Out of Character authorities and moderation to protect the Atlanticanan community, deal with threats to the Region or its members, fulfill out-of-character legal obligations, or otherwise effectively discharge the responsibilities expected of an internet moderation body.

These exemptions suffer from no exceptions and shall supersede any other interpretation of this Constitution or the acts authorized by it.

Constitutional Amendments

§06. The contents of the present Constitution may only be amended by the Tidal Chamber with the support of a two-thirds (2/3rds) super-majority of its voting members and executive assent of the Archonate.

§07. The Tidal Chamber may not repeal the integrality of the present Constitution without including a suitable replacement text in the same legislative instrument, or otherwise deprive the Cosmic Dreamscape of a Constitution.

Article II

Fundamental Freedoms


Freedom of Expression

§08. Every person shall be vested with the right to hold and profess their opinions, adhere or refuse to adhere to ideas, currents, philosophies, or religions, and freely disseminate and receive them.

  1. This section shall not be construed as protecting expression that is disorderly or excessively burdensome to the everyday life and practice of Atlanticanans.

  2. This section shall not be construed as protecting expression that advocates for the demeaning, humiliation, obliteration, or other harm against human beings for their age, gender, sex, ethnicity, nationality, personal origins, religion, or any other factor shaping their identity lying beyond their control.

  3. This section shall not be construed as protecting expression that causes intense harm or distress to members of Atlanticana.

Freedom of Assembly

§09. Every citizen shall be guaranteed the right to assemble and form law-abiding private associations and groups.

Freedom of Press

§10. Every citizen shall be guaranteed the right to seek and publish information through media insofar as it respects the truth and the privacy of individuals, and does not otherwise break Atlanticanan Laws or other rules and regulations.

Freedom of Movement

§11. Every person shall be guaranteed the right to exit Atlanticana without prejudice. Individuals shall be granted the right to enter and reside in the Cosmic Dreamscape insofar as their presence is not otherwise forbidden or prejudicial to the Region.

Right to Vote

§12. Every citizen shall be guaranteed the right to run and vote in scheduled elections and remain free from repercussions, retaliation, or obstruction due to their running or voting preferences.

Right to Parliamentary Participation

§13. Every citizen shall be guaranteed the right to participate and vote in the operations of the Tidal Chamber.

Withdrawal of Rights

§14. The Solar Chamber shall not provide for the withdrawal of the above freedoms, except as the result of a fair process determined by law, or to protect the sovereignty or spirit of Atlanticana.

Protection from Unjust Acts

§15. The Solar Chamber shall not pass bills of attainder or other acts declaring the guilt of specifically named individuals.

§16. Laws shall apply prospectively, and no citizen shall be placed under jeopardy for acts that were legal at the time of commission. Notwithstanding, mitigating provisions of new legislative acts shall apply retroactively.

§17. No citizen may be placed under jeopardy twice for the same act.

Article III

The Executive


Executive Authority

§18. Executive power shall be vested in two Archons, who shall lead efforts to represent the region and promote its interests abroad, and to oversee regional governance, culture and identity. The two Archons shall be the Heads of State and Government of Atlanticana.

Elections

§19. Each Archon shall be separately elected via universal suffrage by the citizens of Atlanticana in an Archonal election, for a term of one-hundred and twenty (120) days.

§20. Archonal elections shall be administered by the Delegate (or any person they nominate in their stead), but the administrator must not themselves stand for election.

Succession

§21. Should the position of Archon become vacant for any reason other than the end of their term, a special election shall be held to fill in the seat.

Executive Powers

§22. Archons may issue decrees relevant to the scope of their missions, whose provisions shall have force of law insofar as they do not contradict constitutional or statute law. Such decrees may be repealed by a simple majority vote of the Solar Chamber.

§23. Notwithstanding the above, the Aeon may take any In Character action necessary to protect Atlanticana and its community.

The Executive Council

§24. The Executibe Council shall discuss and take collective high-level decisions for the benefit of Atlanticana. It shall be comprised of:

  1. The Archons,

  2. a Foreign Minister, who shall be nominated by the Archonate to lead the Ministry of Foreign Affairs,

  3. a Culture Minister, who shall be nominated by the Archonate to lead the Ministry of Culture,

  4. a Media Minister, who shall be nominated by the Archonate to lead the Ministry of Media, and

  5. a Domestic Minister, who shall be nominated by the Archonate to lead the Ministry of Domestic Affairs.

§25. No person may serve as a Minister except a citizen who is nominated by the Archonate and then confirmed by the Tidal Chamber. Ministers shall serve for a term of sixty (60) days.

§26. A Minister may appoint and dismiss any number of deputies and assistants to administer a fraction of their duties.

§27. Where a Ministerial post is vacant, the Archons shall discharge their duties until a Minister is confirmed.


Article IV

The Assembly


Establishment

§28. Legislative power shall be vested in a bicameral legislative.

§29. The legislative shall be composed of the Lunar Chamber and the Solar Chamber.

§30. The Solar Chamber may determine its internal procedures by statute insofar as they do not conflict with the present Constitution.

The Lunar Chamber

§31. The Lunar Chamber shall be composed of five legislators.

§32. The Legislators shall be elected through universal suffrage for a term lasting sixty (60) days.

§33. In the case of a vacancy within the Lunar Chamber, members of the Executive Branch shall fill in the empty seats.

§34. The Lunar Chamber shall be vested with the power to discuss, design, draft, pass, and maintain laws for the benefit of the Cosmic Dreamscape.

§35. The Lunar Chamber shall retain the exclusive authority to amend laws of the Cosmic Dreamscape, including this present Constitution.

§36. Legislation passed in the Lunar Chamber shall be sent to the Solar Chamber for approval and the Archonate for executive assent before becoming law.

§37. The Lunar Chamber shall retain the exclusive authority to ratify Treaties and declare War and Peace.

The Solar Chamber

§38. The Solar Chamber shall be composed of every citizen of the region.

§39. The Solar Chamber may oversee the actions of the executive and, to that effect, summon members of the Executive for interrogation. The Tidal Chamber may impeach members of the Executive, Skyward Tribunal, the Lunar Chamber or its Speaker with a two third (2/3rds) majority.

§40. The Solar Chamber may petition the executive to use its powers or refrain from using its powers in a certain way. Such petitions shall be non-binding.

Article V

The Tribunal


Establishment

§41. Judicial Power shall be vested in a Tribunal of Atlanticana.

§42. The Tribunal of Atlanticana shall be composed of Arbiters.

Composition

§43. In times it judges fit, the Archons may nominate any citizen who has shown interest, expertise, or potential in the crafting or study of Atlanticanan Law to the office of Arbiter. Such nomination shall be effective after a Tidal Chamber confirmation by simple majority.

§44. There shall be no fixed cap to the number of Arbiters.

§45. An Arbiter shall serve for life, and their term may only be concluded for at least one of the following:

  1. At their request, upon the tendering of their resignation to the Archonate.

  2. Upon loss of Atlanticanan Citizenship

  3. Following the success of an impeachment proceeding requiring the assent of two thirds (2/3rds) of the Tidal Chamber's voting members.

Powers of the Tribunal

§46. The Arbiter shall be empowered to determine and appropriately remedy alleged breaches to Atlanticanan Law.

§47. The Tribunal may review the legality or constitutionality of bills passed by the Lunar Chamber or other acts from Atlanticanan Institutions, and invalidate any act found to be unconstitutional or unlawful to the extent of the conflict.

§48. Where the laws of Atlanticana are unclear or liable to multiple interpretations, the Tribunal may resolve unclarities and designate a correct interpretation of the Law.

§49. The Tribunal may codify its own internal procedures, which shall rank above decrees but beneath statute law and the present Constitution.
