Thanks it's been a while. Been busy with school. What's been new in the region?

Here are the basic points I'm considering for the draft of the constitution that I will try my best to present by Wednesday night or earlier (this is not the draft itself; that will be properly formatted):

The first article affirms that the democratic will of the natives of WZAF is the source of all legitimate authority in the region. The region asserts the right to grant, withhold, or revoke the status of native, based upon a process described in a legislative act. All active denizens of WZAF, who are ultimately loyal to WZAF, at the time of ratification are automatically granted the status of native.

The second article describes our membership in the Warzone Federation. We entrust the Federation with our foreign relations and our defense from invasions and coups. As such, we cede authority over such matters to the Federal government, while reserving our authority over other matters. Although distinct, Federal citizens are not mutually exclusive from WZAF natives (I imagine an overlap of or near 100%). We reserve the right to organize a regional militia which, though ultimately loyal to the Federation, will be comanded by regional officials unless the appropriate Federal official(s) take direct command. We also promise to extradite wanted WZAF natives (who have been charged with treason, corruption, or other serious crimes that threaten the Federation) to Federal authorities, so they may stand trial for their alleged crimes.

The third article describes a legislature, tentatively called the Council. The Council has the power to pass and repeal acts, to elect the Premier, and to establish its own procedures. Because of our small size, the Council will not be elected per se (though this my be amended as we grow). Rather any native may volunteer to serve on the Council with the expectation that they be adequately involved in the happenings of the Council. Council sessions must be reasonablly accessible to all Councillors and a quorum of more than one-half of all Councillors is required for a vote to be legitimate. The voting process lasts at least one day.

The fourth article describes the government. The head of government (tentatively called the Premier) is elected, and may be replaced, by the Council at the Council's will. The Premier holds all regional controls and should probably be the Delegate. The Premier is charged with carrying out the acts of the Council. The government also has ministries. These ministries are established and described by act of the Council. The ministers are appointed by the Premier and hold whichever regional controls granted to them by the act that created their ministry.

The fifth article describes the head of state, called the Native Cheif. The Native Cheif is elected by popular vote of all natives for a fixed term (say three months) As head of state, the Native Cheif is (officially, but with limited actual power) the overall leader of WZAF. Although their actual power is limited (with authority to govern entrusted to the Premier), the Native Cheif is not merely a figurehead. They have access to all regional controls and, if neither the Premier or the appropriate ministers are able to immediately respond to an emergency situation (an invasion or coup), the Native Cheif is charged with maintaining order in the region. They also serve as a kind of non-binding arbitrator (their opinion is respected by not necessarily followed) in intra-regional disputes.

The sixth article describes the ratification of the constitution and the process of constitutional amendments, with the approval of two-thirds of all voting natives after public referendum, lasting three days (or until two-thirds of all natives signal their approval).

I figure the current natives are Pharoahs Haven, Lunar City, Malagasy Kingdom, Hong Kaong, and myself. Am I missing anyone?

By the way, in my draft, the Native Cheif, Premier, and any ministers can (and probably will) be Councillors.

Also, there doesn't need to be any ministries. They'll be created by the Council only if the Premier needs assistance in a particular area of government.

There might also be a provision for the impeachment and removal of the Native Chief.

Constitution of the Democratic People's Republic of Warzone Africa

Article I: The Natives

Section 1: The source of all legitimate authority in Warzone Africa is the democratic will of the natives.

All natives have the right to participate in the fundamental political processes of the region, be that participation in support of the government, in loyal opposition to the government, or in a neutral or inquisitive capacity.

To this end, it is the responsibility of the regional leadership to widely announce all elections, referenda, and other important information relating to regional affairs, other than that which is classified.

Section 2: The regional leadership has the power to grant, withhold, and revoke the status of native based on a process established by legislative act.

Section 3: During the process of ratifying this Constitution, all active denizens of Warzone Africa, whose loyalty lies ultimately with Warzone Africa, are recognized as natives and will continue to be recognized as such, following the ratification of this Constitution.

Article II: The Federation

Section 1: Warzone Africa is a state of the Warzone Federation, a democratic union of equal and sovereign warzone regions.

Section 2: The Federation is entrusted with promoting the interests of its states in the realm of foreign affairs, and with defending its states against invasions and coups.

To this end, Warzone Africa cedes its authority over foreign affairs and defense to the Federal government, while retaining full authority over all other matters.

Section 3: Warzone Africa reserves the right to raise, by legislative act, a regional defense militia.

Such a regional defense militia, though ultimately loyal to the Federation, would be under the command of the leadership of Warzone Africa, unless ordered otherwise by the appropriate Federal authority.

Section 4: Warzone Africa will extradite, to Federal jurisdiction, any native charged by the Federal government with treason, corruption, or any other serious crime that threatens the Federation, so that they may stand trial for their alleged crimes.

Article III: The Council

Section 1: The Council is the legislature of Warzone Africa with the power to pass and repeal acts, to elect the head of government, and to establish its own procedures.

Section 2: The Council is comprised of all active natives who volunteer to serve on the Council, and who can generally be trusted to be present for votes and to be adequately involved in all other affairs of the Council.

Article IV: The Premier

Section 1: The Premier is the head of government of Warzone Africa.

Section 2: The Premier is elected, and may be replaced, by the Council.

The Premier is charged with administering all acts of the Council.

Section 3: Ministries may be established by the Council to assist the Premier in particular areas of governance.

The Premier has the power to appoint ministers to lead any such ministries.

Section 4: The Premier is the legitimate Delegate of Warzone Africa, unless otherwise stated by an act of the Council.

Article V: The Native Chief

Section 1: The Native Chief is the head of state of Warzone Africa.

Section 2: The Native Chief is elected by popular vote of the natives, in an election lasting three days, for a fixed term of three months.

Section 3: The Native Chief has access to all available regional controls.

In the event of an invasion, coup, or other emergency, the Native Chief is charged with maintaining order within Warzone Africa.

Section 4: The Native Chief may be removed from office, by a majority in a referendum among the natives, for treason, corruption, or gross incompetence.

Such a referendum on removal may be called by at least two-thirds of the Council, or by any native with the support of at least two other natives, and is to last three days.

Article VI: Ratification and Amendments

Section 1: This Constitution is to be ratified by a vote of at least two-thirds in a referendum among the natives.

Such a referendum on ratification is to last no more than three days and may be concluded prior to three days, upon the approval of two-thirds of all natives.

Section 2: This Constitution may be amended by a vote of at least two-thirds in a referendum among the natives.

Such a referendum on an amendment may be called by an act of the Council, or by any native with the support of at least two other natives, and is to last three days.

I think that’s about right

Natives of Warzone Africa (Pharoahs Haven, LunarCity, Malagasy Kingdom, Hong Kaong, JonesIsland), please cast your vote in the constitutional ratification referendum, which is presented as a regional poll. This referendum will close in no more than three days from now. It may be closed early if enough votes are tallied to accurately presume the results.

Thank you for casting your vote, Malagasy Kingdom. Although LunarCity has not yet voted on the poll, they have previously stated their support for ratification on discord (the Africachat channel of the Warzone Confederation server). With at least two-thirds (specifically four-fifths of all natives, perhaps all five if Hong Kaong votes to ratify) in support, all the requirements the Constitution sets for its own ratification (Article VI, Section 1) are now satisfied.

I volunteer to serve on the Council of Warzone Africa. Proceedings of the Council will not begin until more Councillors are seated.

All natives (including the Native Cheif, Premier, and other givernment officials) are welcome, and encouraged, to volunteer to serve on the Council, as long as they can usually be present to vote and generally participate. I personally don't think it has to be that strict a requirement. I think it's fine as long as you don't frequently have long periods of inactivity without prior notice.

I can’t fully remember the process as I only read the new constitution twice 😏

If a native (who is generally active, etc.) volunteers to serve on the Council, they're on the Council. That is the only explicit Constitutional provision for membership in the Council. Specific details of the process (Is there specific place for a native to announce they volunteer for the Council? Do volunteering natives become Councillors immediately upon their announcement, or is there an "innaguaration?" etc.) can be sorted out by the Council itself, as the Constitution empowers the Council to establish it's own procedures. For now, I think an RMB announcement is enough.

I think we should hold an election for Native Cheif soon, even if only to confirm Pharoahs Haven under the new Constitution. I also have a further suggestion. If we hold an election that opens, say, October 6th (which would close October 9th), maybe the next election should occur January 1-3, even though that wouldn't quite be the three months mandated by the Constitution. Every subsequent election to that would occur every three months. I suggest this because having a three-day election open on the first (as opposed to some other day) of a month seems more "intuitive" in a way. It seems like it will be easier to keep track of as we grow. Maybe it's just me. I don't know.

This would mean the term of the first Native Cheif elected under the new Constitution (probably PH, unless they decide not to run), would be cut a bit short. There are no term limits, however, so the Native Cheif who term expired January 3rd could continue to serve indefinitely if reelected. One alternative to this could be for the upcoming election to be held November 1-3. The election after that would be held February 1-3 and so on.

Of course, another alternative could just be for us to hold our elections on whatever days of every three months that we end up holding our first election on (the 6th through the 9th for example), regardless of whether or not it's the 1st through the 3rd.
