Writ of Union and Amity

Preamble:

We humble delegates, representatives of the Grand Nations of Oured, Zastava, Mylos, and all states included within, pledging our mutual honor, combining our swords, shields, and pens, and desiring to march together towards a future of cooperation, do thus establish this Writ of Union and Amity between the States for the purpose of establishing the Grand Republic of Columbia, on this day, the twenty seventh of October, 1789.

Article 1: The Legislative Branch

1.1:

All powers of legislation not delegated to the individual governments of the States shall reside within the Dual Assemblies Combined, which shall consist of the Assembly of Consuls and the Assembly of the Lords.

1.2:

The First Assembly shall be the Assembly of Consuls. The members of this Assembly, hereafter referred to as “Consuls,” shall be chosen by all eligible persons of their State to serve for a period of two-and-a-half years, and shall be of both good honor and a sound mind, and be at least twenty one years of age, along with any other qualifications that the State may require.

This Assembly shall consist of a total of ninety Consuls which shall be distributed thusly; the Three Major States of Oured, Zastava, and Mylos, shall each be granted twenty Consuls, and the Three Minor States of Formosa, Vostok, and Nyasha, shall each be granted ten Consuls.

Consuls shall be elected by a popular vote of all citizens who have completed no less than five consecutive years in a State or National Army or equivalent service, within their district, the borders of which shall be decided by their respective State.

Should a new state be admitted into the Union of Columbia, then they shall immediately be granted ten Consuls to represent them in the Assembly, and shall be designated as a Minor State. Should a Minor State grow in prestige and population such that it may no longer be considered Minor, it may be upgraded to the status of a Major State, and its number of Consuls shall be increased to suit their new status.

Should a Consul pass on to join with the Spirits, prove themselves of poor honor, or otherwise be shown to be incapable of representing their State, a replacement shall be appointed by said State’s legislature to serve in their stead for no longer than the term that the Consul was elected for.

The leaders of this most august Assembly shall hereafter be known as the “Grand Consuls.” There shall be no less than two Grand Consuls, and they shall be elected from amongst the Consuls of the two groups most numerous within the Assembly. With agreement amongst themselves and the approval of no less than two thirds of their Assembly, these Grand Consuls shall be granted the power to begin the proceedings of impeachment on Lords, Tribunes, and their fellow Consuls.

1.3:

The Second Assembly shall be the Assembly of Lords. The members of this Assembly, hereafter referred to as “Lords,” shall not be elected, but shall rather be appointed from amongst the Notables of Columbia. Any noble of good honor and a sound mind who holds a title greater than or equal to the position of Duke shall be entitled to a seat on the Assembly, as shall the High Priests of each state. In addition, the Assembly may from time to time deign to raise a clan of good standing to the status of Lord, following which the clan may elect a single representative to represent them within the Assembly of Lords each year.

The number of Lords may vary, but there shall not be less than thirty lords at any given time. Should the number of Lords fall below thirty, the Assembly of Consuls may compel the Lords to replenish their ranks. If, after one year, the Lords have failed to do so, the Assembly of Consuls shall begin discussions regarding the continued usefulness of the Second Assembly.

The leaders of this Assembly shall be the Grand Princes of Oured, Zastava, and Mylos. They shall be granted the ability to organize religious and secular festivals, confer titles of nobility, establish and maintain Orders of Knighthood, and with the approval of no less than two thirds of their assembly, to call a Quorum of the Faith, establish or alter a national emblem or symbol, and call for a reform of the language.

1.4:

The First Assembly shall be responsible for enacting legislation on a national scale, collecting taxes for the purposes of national services and providing for the army, and for approving international treaties and alliances.

The Second Assembly shall be responsible for maintaining Columbian culture and heritage, ensuring the continuation of the Tritheist faith, and all other faiths that reside within the borders of Columbia, and maintaining relations with the various monarchs of Valsora.

Each Assembly must convene in full no less than twice per year, once as the year begins and once when it ends, save for during an election year, when it must meet immediately before and after the election in addition to the previously mentioned sessions. In addition, no less than one half of the Assembly of Consuls and one fourth of the Assembly of Lords must be in attendance for any given session to commence.

1.5:

Each Assembly shall be responsible for judging their own elections, ensuring the honorable conduct of its members, determining the rules of their conduct, and refining the qualifications of their posts. Should one Assembly believe that something is amiss with the actions of the other, an official complaint may be lodged with the Assembly of Justicars, and the action shall be reviews.

1.6:

Each Assembly must publish a transcript of their proceedings in full every other month, and these transcripts must be provided in the most convenient manner possible for the general population to view. Should a matter require secrecy, the Dual Assemblies must inform the Assembly of Justicars no less than two weeks prior to the publishing of the transcripts.

1.7:

Members of the Assembly of Consuls are to receive a compensation for their services, determined by the Assembly of Tribunes, and paid out of the National Treasury of Columbia. In times of war, Consuls shall be immune to all laws save for those of treason, felony, and breach of the peace.

Members of the Assembly of Lords are to be paid no compensation, save for in specific circumstances where it is justified. They are to receive no immunities save for those traditionally granted to the nobles of the land, except in times of war, when they shall receive the same immunities as Consuls.

1.8:

Two separate military bodies shall be established to provide for the protection of the Assembly of the Consuls, and the Assembly of the Lords. The body responsible for providing protection to the Assembly of Consuls shall be titled the “Consular Guard,” and the body responsible for providing protection to the Assembly of Lords shall be titled the “Lord’s Men.” These units shall be answerable only to their respective Assembly, and the Assembly of Justicars. Recruits for these units shall be pulled from the most honorable members of the Legion, to serve in the unit for so long as they see fit.

Article 2: The Executive Branch

2.1:

All executive powers shall be vested in the Primarch and his Council, consisting of the Diarch and the Assembly of Tribunes.

2.2:

The Primarch shall hold office office with his Diarch for a term of five years, and shall be elected in the following manner:

Not sooner than one year, and not later than four months prior to the election, any person of good honor and a sound mind who has served no less than five consecutive years in a State or National Army, may present themselves to the Assembly of Lords as a candidate for Primarch, and select one person to serve as their Diarch. Should the Assembly of Lords find the candidate to be eligible to hold the office, they may begin to campaign. Should the Assembly of Lords find the candidates ineligible, the prospective candidates may appeal to the Assembly of Consuls, and failing that, the Assembly of Justicars. Should the Assembly of Justicars find the candidates maintain the decisions of the Consuls and Lords, the candidate shall be barred from running for Primarch for the given election cycle.

On the first of August, four months prior to the elections, a preliminary election will be held, wherein all persons who have served no less than five consecutive years in a State or National Army, or equivalent service may submit their vote. The ten best performing candidates of this preliminary election shall continue to the next round of voting, which shall occur on the first of October, two months prior to the final election. In this, the 5 final candidates shall be selected, and a final vote shall be held no later than the first of December. Following this, the votes shall be counted and the winner announced no later than two weeks past the last submitted vote. The new Primarch and his Diarch shall assume their office on the first of January of the new year.

Should the Primarch be removed from office, whether it be due through death or dishonor, his position shall be assumed by his Diarch, who shall serve for such a duration as the Primarch was elected for. Should both the Primarch and the Diarch be incapable of serving their duty, the responsibility shall fall upon the Assembly of Tribunes to raise one of amongst themselves to the position of Primarch. Should this fail, the responsibility passes to the Assembly of Consuls to elect one amongst themselves to the position.

Before entering the office of Primarch, the Primarch-Elect shall take the following Oath of Service: “As Primarch, first among equals and greatest of Tribunes, I do hereby pledge my sacred honor to complete the task which I have been chosen for. In times of war I shall live by the saber. In times of peace I shall live by the pen. I shall strive to uphold and greaten the honor and glory of Columbia and her gods, and to safeguard the Writ from those who would seek to undermine it. This, I do swear.”

Before entering the office of Diarch, the Diarch-Elect shall take the following Oath of Service: “As Diarch, second arbiter of Columbia’s will, I do hereby pledge my sacred honor to complete the task which I have been chosen for. In times of war I shall live by the saber. In times of peace I shall live by the pen. I shall strive to uphold and greaten the honor and glory of Columbia and her gods, and to safeguard the Writ from those who would seek to undermine it. This, I do swear.”

2.3:

The Assembly of Tribunes shall consist of five representatives, hereafter referred to as “Tribunes.” Of these Tribunes, three shall be styled as the “Military Tribunes,” and two shall be styled as the “Civil Tribunes.”

The three Military Tribunes shall be known as the Tribunes of the Legion, Air Corps, and Navy. These Tribunes must have served no less than five years in their respective branches, be of good honor and a sound mind, and have announced their candidacy at least four months prior to the elections, which shall be held concurrently with that of the Primarch. They shall be elected by popular vote amongst all persons who have served no less than five years in their State or National Army, or equivalent service.

The two Civil Tribunes shall be known as the Tribunes of the Consuls and the People.

The Tribune of the People must of of good honor and a sound mind, have announced their candidacy at least four months prior to election, and be no less than twenty five years of age. He shall be elected by popular vote amongst all persons over the age of eighteen, regardless of their history of service.

The Tribune of the Consuls shall be elected from amongst the Consuls to serve as their representative in the Assembly of Tribunes. He shall no specific requirements save for those imposed upon the Assembly of Consuls as a whole.

Before entering the office of Tribune, the Tribune-Elect shall take the following Oath of Service: “As a Tribune, guardian of Columbia’s holy honor and organizer of her armies, I do hereby pledge my sacred honor to serve my Primarch, my People, and their Writ. To this end, I pledge my blade and pen till I be released from service. Whilst I serve, Columbia shall stand. This, I do swear.”

2.4:

The Primarch shall be the Commander in Chief of the Legions Combined and Admiral of the Navy. With the approval of two thirds of the Assembly of Consuls presiding, or the consent unanimous of the Assembly of Tribunes, he shall be granted the authority to appoint ambassadors, ministers, and to form a cabinet. He may receive ambassadors, and submit treaties before the Assembly of Consuls. The Primarch is granted a single unconditional veto per year, following which he is granted unlimited vetoes which may be reversed by a simple majority in the Assembly of the Consuls. Should a Tribune prove themselves dishonorable, the Primarch may bring their findings before the Grand Consuls with the intent of impeachment.

The Diarch shall act as an extension of the Primarch’s will, and is granted the same authority as the Primarch save in cases where the two would conflict.

Should the Primarch or Diarch be found guilty of treason, bribery, or any other such unforgivable offenses, he shall be immediately removed from office and the case shall be tried once more in the interest of fairness. Should he be found guilty once more, he shall be summarily executed and his names struck from the registry of Primarchs.

2.5:

The Assembly of Tribunes shall be the highest officers of the army save for the Primarch, and shall be responsible for the organization, deployment, and management of all Columbia’s armies. Without approval they may appoint officers, grant titles, call forth the militia to deploy as they see fit, and preside over courts of military law. In times of conflict, Tribunes outside of Oured shall be considered to be On Campaign, and shall wield absolute authority over all citizens of Columbia. Should the Primarch prove themselves to lack honor, Tribunes shall be privileged to bring their case before the Grand Consuls with the intent of impeachment.

Should a Tribune be found guilty of treason, bribery, or any other such unforgivable offenses, he shall be immediately removed from office and the case shall be tried once more in the interest of fairness. Should he be found guilty once more, he shall be summarily executed and his name struck from the registry of Tribunes.

2.6:

Once per year, the Primarch shall speak on the State of the Union before the Assembly of Consuls, in the interest of suggesting actions or informing of a crisis. In times of crisis, he may call forth any of the Assemblies in full to debate matters of great importance.

2.7:

The Primarch and Tribunes are to receive just compensation, of an amount determined prior to each election by the Assembly of Consuls. This amount may not be altered until the next election.

2.8

In times of great need, should the Primarch, Diarch, and Assembly of Tribunes, hereafter referred to as the “Septarchy,” express unanimous consent, they may bring forth a case to the Assembly of Justicars in order to establish the Septarchy. Should the Justicars approve of the action, the powers traditionally granted to the Assemblies of Consuls and Lords shall instead be transferred to the Septarchy for the duration of no more than a single year, or until the crisis is averted. If at any time the Assembly of Justicars should have reasonable cause to believe that the office is being abused, they may strike down the Septarchy without delay, and the members shall be put on trial.

Should the Septarchy accomplish its task and avert the crisis, the Assembly of Justicars shall be compelled to review the actions of the Septarchs to ensure that they were honorable and necessary. Should they find evidence to the contrary, the Septarchs shall be punished to the fullest possible extent.

2.9:

An independent unit shall be established to provide for the protection of the Tribunes and the Primarch. This unit shall be titled the Honor Guard, and shall be answerable only the Tribunes and the Primarch. Recruits for these units shall be pulled from the most honorable members of the Consular Guard and the Lord’s Men, to serve in the unit for so long as they see fit.

Article 3: The Judicial Branch

3.1:

The judicial power of Columbia shall be bestowed upon the Assembly of Justicars, and in so many inferior courts as the Justicars may deem necessary.

3.2:

There shall be a total of thirty Justicars at any time, which shall be divided into three separate divisions. One of these divisions shall be titled the Consular Justicars, and shall be appointed by the Assembly of Consuls. One shall be titled the Lord’s Justicars, and shall be appointed by the Assembly of Lords. The last shall be titled the Tribunal Justicars, and shall be appointed by the Assembly of Tribunes. For so long as they maintain their honor, these Justicars may continue to serve.

When one Justicar passes on to join with the Spirits, their respective Assembly Leaders shall put forth six recommendations to take their place. In the case of the Lords and the Consuls, where multiple Assembly Leaders exist, these recommendations shall be split equally among them. These recommendations shall be voted on, and the candidate with the fewest votes shall be eliminated. This process will continue until there remains only one candidate, who shall join the Assembly of Justicars. Should two-thirds of the Assembly find none of the recommendations acceptable, and thus abstain from voting, the Assembly Leader shall be compelled to select six new candidates, and the voting will begin again. This process may be repeated until a suitable candidate is found.

3.3:

At least one Justicar shall preside over any case involving any member of the National Government, except in cases of impeachment, where the Grand Consuls shall preside over the entirety of the Assembly of Justicars.

3.4:

Should a Justicar be found to be of poor honor, then a fellow Justicar, or a member of the Assembly the accused belongs to, may call for their expulsion. If the accuser is a Justicar, a vote shall be held amongst their fellows and may be passed with a two thirds majority. If the accuser is from a the Assembly the Justicar belongs to, a vote shall be held amongst that assembly and may be passed with a two thirds majority.

3.5:

The Assembly of Justicars shall be responsible for upholding the Writ of Union and Amity, and ensuring that legislation passed does not infringe on that which is established here. In addition, should an amendment to the Writ be proposed, the Justicars may pass it via a five sixths majority.

3.6:

Each Division of the Justicars shall be lead by their Respective Grand Justicar, who shall be the longest serving among them. Namely, these shall be the Grand Justicar of Consuls, Grand Justicar of Lords, and Grand Justicar of Tribunes. These Grand Justicars shall be granted no special privileges save for the prestige of the position, and whatever tasks their respective Division may request of them.

Article 4: Establishment of the Capital

4.1:

A new capital shall be established to provide a centralized location from which the government shall be conducted. This capital shall be located within the State of Oured, and shall be titled “Tiir,” the name of that ancient city which saw the Gods descend to Valsora. The initial funds for this city shall be distributed thusly; Oured shall provide three tenths of the funds, Mylos and Zastava shall each provide two tenths, and Formosa, Vostok, and Nyasha shall each provide one tenth.

The exact location, as well as the initial budget required for construction, shall be determined in the first session of the Assembly of Consuls.

4.2

Until such a time as this capital is deemed sufficient for conducting government, the government shall be run from the city of Carynth, in Mylos.

4.3

Upon the completion of Tiir, the Assembly of Consuls shall determine no less than one alternative city per state, which they deem worthy of serving as the capital of the nation should Tiir fall to invaders.

4.4

The residents of Tiir shall be counted as citizens of Oured, however Oured shall have no legal authority over them. Rather, Tiir shall be administered by the National Government directly, so as to avoid conflicts of authority.

Article 5: Fundamental Rights

5.1:

No restrictions shall be placed on the right of citizens to possess and bear weaponry, or to form militias and practice as they may. However, in times of great need or national conflict, these militias may be mobilized and placed under the command of the Assembly of the Tribunes.

5.2

No restrictions shall be placed on the formation or practice of religions within the nation, excepting in cases where the practices of a religion may be reasonably considered to impede upon the safety or rights of others within the nation.

Deeply ingrained within the culture of all states as the Trostrukai Faith is, the use of its terminology within government documentation shall not be restricted. However, it shall not be used to justify legislation of any kind, save for that which relates solely to the Faith.

5.3

No person accused of a crime shall be denied the right to a swift trial in the region in which they were apprehended, tried by an appointed federal judge, and attended by a jury consisting of eight impartial jurors, as well as a juror sympathetic to the accused and a juror sympathetic to the accuser. Should this prove impossible, the jury shall instead consist of ten impartial members.

No person accused of a crime shall have their charge obscured to him, nor shall he be denied the right to legal counsel or the ability to call forth witnesses.

Should a person be found guilty of a High Crime and sentenced to death, the method shall not be needlessly cruel to their honor or their body. Rather, the accused shall be granted the right to choose between a firing squad, hanging, or whatever other method their State may deem appropriate.

5.4

Should a person feel as though their honor has been infringed upon or called into question by another, they may freely challenge that person to a duel. However, duels must be officiated by an officer of the law so as to avoid a needless death.

5.5

All persons and their belongings shall be secured against unjustified searches and seizures, and no warrants shall be accepted except under proper justification.

5.6

Any person residing within any State of Columbia for at least three years may claim residency. A Resident of Columbia is permitted to partake in the government within their respective State, as well as the election of the Tribune of the People.

Any resident of Columbia may enroll in the service of the Nation. In most cases this shall be military service, either in their local militias, or in their State Guard or the National Legion. After ten years of consecutive service in their militia or five years in the Guard or Legion, they may claim Citizenship. Citizens are entitled to participate in all National and State politics, as well as being entitled to numerous services. Should someone prove incapable of serving in a military capacity, alternatives may be established as the Assembly of Lords may see fit.

Article 6: Amendment of the Writ

6.1:

The Assembly of Consuls, with a majority of no less than seven ninths, may propose an amendment to the Writ. The Assembly of Lords shall then determine whether or not the proposed amendment interferes with any principles established by the original document. Should they pass the proposed amendments with a two thirds majority, the amendment shall pass to the Assembly of Justicars, who shall determine whether it is necessary and proper. Should they approve it, with no less than a two thirds majority, the amendment shall be incorporated.

Article 7: Prior Relations

7.1:

All treaties, alliances, debts, and other such affairs which previously applied to any of the States shall now apply to the nation of Columbia as a whole, until such a time as the Primarch may decide to nullify them.
