Thought you all might want to hear this funny story from this week:

For the past few days there has been a chicken stuck in my backyard. We're in a typical looking subdivision so this seems weird until you realize the property behind us is a farm. Anyway... today after dinner I drove up to that farm to let them know since I wasn't sure if they realized the chicken was over here. I couldn't figure out how to get up to the door since the yard was fenced in and they have no trespassing signs everywhere (people sometimes use there driveway to get into my subdivision, evidently) but I was out there long enough for the farmer's wife to see my car because they have a really narrow driveway and I had to spend like 2 minutes pulling into it.

After explaining that no, I was not trying to use there driveway as a shortcut, I explained that one of there chickens was on the other side of the wire fence in my backyard. Evidently they had already sent their son to catch it before to no avail. My neighbors also tried catching the chicken with no success either. And the farmer's wife didn't want to injure her ankle again. But we agreed to meet at the fence separating our two properties and try to catch it.

...You'd never guess what that started. Next thing you know, there's six of us trying to catch this chicken because my nextdoor neighbors had been trying to catch it for fun for the past few days and figured now was a good time for another attempt. Despite there being 6 of us, though, this chicken was a rascal- really fast, and would run away every time you got close. It took close to half an hour, but we managed to corner the chicken which forced it to climb up a tree, at which point one of us was able to catch it by the leg.

To say it was difficult to catch this chicken was an understatement. Safe to say I will never be a farmer!

In what will be an interesting case for the US Supreme Court, a Texas state trooper sued the state of Texas for what he felt was discrimination related to his accommodation request related to injuries suffered from a deployment with the Army Reserve. Texas and several other states are claiming Sovereign Immunity; you can't sue a government that doesn't consent to it. There is concern that a vote in favor of the states could seriously jeopardize the protections under the Uniformed Services Employment and Reemployment Rights Act (USERRA).

State's sovereign immunity protections only go as far as state law. That immunity vanishes when the case in is Federal Court. So the question is whether or not the original suit was brought in state court. There is a chance that is the only venue open to this kind of suit, in which case the trooper is going to loose. Sovereign immunity has already been tested and upheld many times over the decades, and I'm sure many more tests are in store for the future.

Now that said, a state patrolman has to be able to perform certain functions. I'm all about reasonable accommodations for the disabled, especially those disabled while in the service. However, there is and must be a a clear and reasonable definition of the word "reasonable." Someone unable to run cannot be a street cop. Just like someone unable to lift over 25 pounds should not be crew on an ambulance or fire truck.

I've been in a position where I had an employment attorney telling me I had to make reasonable accommodations for a driver with a debilitating disease and had to let him drive. A driver who shouldn't have been driving anything, let alone 30-50 thousand pound trucks. At the same time I had our company attorney and Federal Motor Carrier Safety Administration consultant telling me if I let him drive and he gets in a wreck, I too will be on the hook.

As for the court case, I'd have to look at the history of the original suit to see where it was first brought up. Even if the complaint wasn't valid, the idea that state employees are somehow not protected is a bit troubling.

Sovereign Immunity is troubling on many levels. However, the state is a big target with deep pockets filled with taxpayer money. The government is also a huge magnet for crazy people armed with frivolous lawsuits. Lots of people do not respond well to others exercising sometimes arbitrary control over their property and their lives.

It is sometimes a good thing and sometimes a bad thing.

Happy César Chávez Day Texas! For those who may be unaware, César Chávez is a U.S. federal commemorative holiday, proclaimed by President Barack Obama in 2014.
