It is the opinion of the court that the most recent national election in Forbitten, although highly contentious and extremely close, was conducted lawfully and in accordance with the Constitution of the Federation. The rights of voters were upheld, and the slim parliamentary majority of the Forbitten National Party is upheld until the next scheduled election.

It is the opinion of the dissent that given the structural advantage of the long-time incumbent Forbitten National Party, the significant amount of electoral irregularities, including but not limited to voter suppression, polling station locations, counting errors & misplaced ballots - is enough to deny the fairness of the electoral process in this case.

It is the unanimous opinion of the court - that is, both majority and dissent - that additional laws concerning the regulation of elections are needed to clear ambiguities and to ensure a fair, democratic election process in all districts of the federation.

We propose the following amendment be added to the constitution:

X. Elections in the Federation

We affirm the following:

1) This document guarantees the uncompromisable right to vote in free and fair elections at all levels of government.
2) It is the responsibility of each of the nations of the federation to ensure free and fair elections in their jurisdiction.
3) A Federative Elections Council comprised of independently-appointed judges will be tasked with ensuring the fairness of all elections in the Federation. The council will be comprised of no less that 2 representatives from each nation - for a total of 14 representatives.

With this affirmed, elections will only be considered free and fair if they meet the following criteria:

1) Authority of the government can only derive from the will of the people as expressed in genuine, free and fair elections held at regular intervals on the basis of universal, equal and secret suffrage.
2) Every adult citizen has the right to access to an effective, impartial and non-discriminatory procedure for the registration of voters
3) No eligible citizen shall be denied the right to vote or disqualified from registration as a voter, otherwise than in accordance with objectively verifiable criteria prescribed by law, and provided that such measures are consistent with the State's obligations under international law.
4) Every individual who is denied the right to vote or to be registered as a voter shall be entitled to appeal to a jurisdiction competent to review such decisions and to correct errors promptly and effectively.
5) Every voter has the right to equal and effective access to a polling station in order to exercise their right to vote.
6) Every voter is entitled to exercise his or her right equally with others and to have his or her vote accorded equivalent weight to that of others.
7) The right to vote in secret is absolute and shall not be restricted in any manner whatsoever.
8) Everyone has the right to join, or together with others to establish, a political party or organization for the purpose of competing in an election.
9) Every candidate for election and every political party shall have an equal opportunity of access to the media, particularly the mass communications media, in order to put forward their political views.
10) Every individual and every political party has the right to the protection of the law and to a remedy for violation of political and electoral rights.
11) Every candidate and political party competing in an election shall accept the outcome of a free and fair election.
12) Candidature, party and campaign rights carry responsibilities to the community. In particular, no candidate or political party shall engage in violence.
13) States should take the necessary legislative steps and other measures, in accordance with their constitutional processes, to guarantee the rights and institutional framework for periodic and genuine, free and fair elections, in accordance with their obligations under international law.

Given that following these laws is incompatible with authoritarianism, the NationStates classification system provides a scientific frame-work for determining the legitimacy of an election. Elections shall be declared undemocratic in nations classified as the following: Psychotic Dictatorship, Anarchy, Benevolent Dictatorship, Corrupt Dictatorship, Authoritarian Democracy.

Electoral laws throughout the Federation which are not compatible with this amendment are hereby struck down.

Co-ordinated investigations of police forces through Tornky & Klozhet have been able to confirm the following:

- On Tornky Day in the year A-H-17 at the intersections of Hut & Flaude approximately 4300 were gathered in protest against the Sultan of Tornky
- At around 2 in the afternoon, the Armed Forces of the Sultanate of Tornkey were dispatched to displace the protesters
- A confrontation ensued, and the AFST opened fire, killing 49 people and wounding 924 others

Whereas Tornky is a District in the United Socialist States of the Klozhet which is a member of the Federated States of Toylin, citizens are entitled to rights guaranteed in the Constitution of the USSK and the Treaty & Constitution for the Establishment of the Federated States of Toylin,

Whereas these rights include - in accordance with both documents - the right to free protest,

Whereas any laws passed locally within the Sultanate of Tornky barring free protest would therefore be unconstitutional,

The Supreme Council of the USSK has unanimously voted in favour of prosecution of the Sultanate of Tornky on 49 counts of murder and 924 counts of battery.

Whereas the position of "Sultan" is not recognized in laws in the Federation or Klozhet as holding any democratic, legal legitimacy,

The Supreme Council of the USSK has unanimously voted in favour of the forced resignation of the Sultan and his Executives, followed by the election of a new government in Tornky.

Whereas the Sultan is protected by the AFST and has refused to surrender to police

The United Socialist States of the Klozhet requests the Federation's assistance in military action in Tornky to liberate prisoners of the Sultan's regime.

The stability of Tornky, being necessary to the security and protection of democracy within the Federation, must be upheld.
