KEN DOLL VS. THE COMMONWEALTH OF Hull-wai

In the case of Ken Doll vs The Commonwealth of Hull-wai, the Supreme Court of the Federation ruled 5-2 in favour of Mr. Doll -

Majority: Dolliwud, Gotemme, Klozhet, Batrumme, Forbitten

Dissent: Hull-wai, Adultii

Opinion of the Court:

It is the opinion of the court that the Hull-wai Act 329-f4 which bans same-sex marriage in Hull-wai violates the constitutional rights guarenteed to Mr. Doll by the cConstitution of the Federation as a citizen of the Federation. The law is hereby struck-down.

THE MOST SERENCE REPUBLIC OF Chreschtduerf VS. THE CONFEDERACY OF Forbitten

In the case of THE MOST SERENCE REPUBLIC OF Chreschtduerf VS. THE CONFEDERACY OF Forbitten, the Supreme Court of the Federation ruled 6-1 in favour of Forbitten

Majority: Dolliwud, Gotemme, Klozhet, Batrumme, Forbitten, Hull-wai, Adultii

Dissent: Forbitten

It is the opinion of the court that existing laws within the MOST SERENCE REPUBLIC OF Chreschtduerf that legalize and regulate consensual cannibalism conflict with laws in the CONFEDERACY OF Forbitten which forbid such acts.

Whereas - it is the opinion of the court - that any laws within the Federation legalizing cannibalism would violate constitutional rights guaranteed to citizens of the Federation, all laws and any new laws concerning legal cannibalism are hereby struck-down.

X. Political representation in the Federation

Whereas the Federation is a collection of sovereign nations with party-systems in place prior to the creation of the Federation - the following laws ensure separation of National and Federational party associations:

1. The Federation may make no law abridging a Nation's right to form political parties.
2. The Federation may make no law that over-turns the Nations right to govern political parties.
3. Federational parties may have affiliates within nations - but affiliates must participate in the electoral procedure as dictated by the nation.
4. Elections are conducted and managed at the Federal Level.

THE FORBITTEN NATIONAL PARTY et all, VS. THE SOCIALIST PARTY OF FORBITTEN et all.

The Supreme Court of the Federation rules 4-3 in favour of THE FORBITTEN NATIONAL PARTY.

Majority: Dolliwud, Forbitten, Hull-wai, Adultii

Dissent:Gotemme, Klozhet, Batrumme

It is the opinion of the court that the most recent national election in Forbitten, although highly contentious and extremely close, was conducted lawfully and in accordance with the Constitution of the Federation. The rights of voters were upheld, and the slim parliamentary majority of the Forbitten National Party is upheld until the next scheduled election.

It is the opinion of the dissent that given the structural advantage of the long-time incumbent Forbitten National Party, the significant amount of electoral irregularities, including but not limited to voter suppression, polling station locations, counting errors & misplaced ballots - is enough to deny the fairness of the electoral process in this case.

It is the unanimous opinion of the court - that is, both majority and dissent - that additional laws concerning the regulation of elections are needed to clear ambiguities and to ensure a fair, democratic election process in all districts of the federation.

Gotemme City wrote:A Proposal for an Amendment to the Treaty & Constitution for the Establishment of the Federated States of Toylin [failed]

Whereas it is established constitutionally that the Federation is - and shall always be - a federation of democratic republics,
Whereas ensuring the integrity of democratic elections in all republics of the Federation is tantamount to being able to guarantee this establishment,
Recognizing rulings by the Supreme Court indicating more laws are needed regarding the construction of elections.

We propose the following amendment be added to the constitution:

X. Elections in the Federation

We affirm the following:

1) This document guarantees the uncompromisable right to vote in free and fair elections at all levels of government.
2) It is the responsibility of each of the nations of the federation to ensure free and fair elections in their jurisdiction.
3) A Federative Elections Council comprised of independently-appointed judges will be tasked with ensuring the fairness of all elections in the Federation. The council will be comprised of no less that 2 representatives from each nation - for a total of 14 representatives.

With this affirmed, elections will only be considered free and fair if they meet the following criteria:

1) Authority of the government can only derive from the will of the people as expressed in genuine, free and fair elections held at regular intervals on the basis of universal, equal and secret suffrage.
2) Every adult citizen has the right to access to an effective, impartial and non-discriminatory procedure for the registration of voters
3) No eligible citizen shall be denied the right to vote or disqualified from registration as a voter, otherwise than in accordance with objectively verifiable criteria prescribed by law, and provided that such measures are consistent with the State's obligations under international law.
4) Every individual who is denied the right to vote or to be registered as a voter shall be entitled to appeal to a jurisdiction competent to review such decisions and to correct errors promptly and effectively.
5) Every voter has the right to equal and effective access to a polling station in order to exercise their right to vote.
6) Every voter is entitled to exercise his or her right equally with others and to have his or her vote accorded equivalent weight to that of others.
7) The right to vote in secret is absolute and shall not be restricted in any manner whatsoever.
8) Everyone has the right to join, or together with others to establish, a political party or organization for the purpose of competing in an election.
9) Every candidate for election and every political party shall have an equal opportunity of access to the media, particularly the mass communications media, in order to put forward their political views.
10) Every individual and every political party has the right to the protection of the law and to a remedy for violation of political and electoral rights.
11) Every candidate and political party competing in an election shall accept the outcome of a free and fair election.
12) Candidature, party and campaign rights carry responsibilities to the community. In particular, no candidate or political party shall engage in violence.
13) States should take the necessary legislative steps and other measures, in accordance with their constitutional processes, to guarantee the rights and institutional framework for periodic and genuine, free and fair elections, in accordance with their obligations under international law.

Given that following these laws is incompatible with authoritarianism, the NationStates classification system provides a scientific frame-work for determining the legitimacy of an election. Elections shall be declared undemocratic in nations classified as the following: Psychotic Dictatorship, Anarchy, Benevolent Dictatorship, Corrupt Dictatorship, Authoritarian Democracy.

Electoral laws throughout the Federation which are not compatible with this amendment are hereby struck down.

Klozhet wrote:A Request for Military Action in Tornky [failed]

Concerning the events of Late Winter in the year A-H-17, commonly referred to as the Tornky Day Massacre:

MEMO from the Committee on General Relations of Tornky

Co-ordinated investigations of police forces through Tornky & Klozhet have been able to confirm the following:

- On Tornky Day in the year A-H-17 at the intersections of Hut & Flaude approximately 4300 were gathered in protest against the Sultan of Tornky
- At around 2 in the afternoon, the Armed Forces of the Sultanate of Tornkey were dispatched to displace the protesters
- A confrontation ensued, and the AFST opened fire, killing 49 people and wounding 924 others

Whereas Tornky is a District in the United Socialist States of the Klozhet which is a member of the Federated States of Toylin, citizens are entitled to rights guaranteed in the Constitution of the USSK and the Treaty & Constitution for the Establishment of the Federated States of Toylin,

Whereas these rights include - in accordance with both documents - the right to free protest,

Whereas any laws passed locally within the Sultanate of Tornky barring free protest would therefore be unconstitutional,

The Supreme Council of the USSK has unanimously voted in favour of prosecution of the Sultanate of Tornky on 49 counts of murder and 924 counts of battery.

Whereas the position of "Sultan" is not recognized in laws in the Federation or Klozhet as holding any democratic, legal legitimacy,

The Supreme Council of the USSK has unanimously voted in favour of the forced resignation of the Sultan and his Executives, followed by the election of a new government in Tornky.

Whereas the Sultan is protected by the AFST and has refused to surrender to police

The United Socialist States of the Klozhet requests the Federation's assistance in military action in Tornky to liberate prisoners of the Sultan's regime.

The stability of Tornky, being necessary to the security and protection of democracy within the Federation, must be upheld.

Whereas the Federation has been at peace for more than two decades -

The Assembly of the Federation as of Mandate V of the Federation of Toylin agree that it must adopt a permanent settlement

To be the Capital City and for that city to be legal operated as its own District, under Federal jurisdiction, separate from any Nations of the Federation.

It is with this decree that the Assembly approves the beginning of construction of the District of the Federation

To be located at the tripoint of Nations of Adultii, Hull-wai, and Dolliwud

And the Districts of Dolphin City, Lesliiville, and Tijuana-Chihuahua

And be roughly 500 square miles in area,

With easy access to water, harbours and other places of trade.

The District shall be under the jurisdiction of the Executive Branch of the Federation.

Signed,

Theodore Edward Bear, Montanareal
President of the Federation

Rust Eiten Hammer, Urine-Ural
Vice-President of the Federation

Kimiko-Peenk Dranger, Kapital City
Chair of the People's Assembly of the Federation

Declaration of a Federational Currency

Whereas it is the ultimate goal of the Federation to have the Nations of the Planet of Toylin unified.

Whereas business-owners and worker councils have each expressed a need for financial continuity and economic standardization throughout the Federation

The People's Assembly of the Federation hereby establishes the following:

1) The monetary unit of the Federation is the Pomodoro.
2) The denominations of money in the currency of the Federation are pomodoros and cents, the cent being one-hundredth of a pomodoro.
3) All public accounts established or maintained in the Federation shall be in the currency of the Federation, and any reference to money or monetary value in any indictment or other legal proceedings shall be stated in the currency of the Federation.
4) Nations have sovereignty over their own currency and may continue to use and maintain their currency.
5) For legal and financial purposes, money transferred to and from the Federation will be issued with the current pomodoro value taken into account.

This legislation was passed by an act of the People's Assembly by a vote of 80 - 27 and by an act of the Senate by a vote of 8 - 6.

Supreme Court Decision in Case #3918445 (Year: A-H-24):

Councilmember Jason Reh-Dranger, Klozhet vs
Secretary-General Kuai Liang Subziro, Klozhet

In the case of Councilmember Jason Reh-Dranger, Klozhet vs Secretary-General Kuai Liang Subziro, Klozhet, the Supreme Court rules 4-3 in favour of Mr. Reh-Drager.

Majority: Batrumme, Forbitten, Gotemme, Hull-wai

Dissent: Dolliwud, Adultii, Klozhet

Whereas the constitutional framework is unclear regarding the election of the Secretary-General in Klozhet,

And whereas the Act in which the framework is outlined has been deemed unconstitutional by the standards of the Treaty & Constitution for the Establishment of the Federated States of Toylin,

It is the opinion of the Supreme Court of the Federation that the election results constitute an unlawful, undemocratic action and are therefore illegitimate.

The court orders the following:

1) Kuai Liang Subziro is to be removed from the office of Secretary-General and pending trial, may no longer serve in government.
2) Councilmember Jason Reh-Dranger will be re-instituted as Secretary-General.
3) A new election will be held, the terms of which must be approved by a majority vote of the People's Assembly of the Federation.
4) Following a new election, it is recommended that the Supreme Council of Klozhet re-establish a constitutional electoral standard through legislation.

Opinion of the Dissent

Whereas the rules for the election were agreed upon and passed by the Supreme Council of Klozhet prior to the election, flaws in that process are moot. It is, therefore, the opinion of the dissent that Kuai Liang Subziro's election as Secretary-General is lawful and democratic.

The dissent agrees with the Majority in recommending the Supreme Council of Klozhet re-establish a constitutional electoral standard through legislation.
