A lady catches her fiance in a steamy exchange of text messages and sexy pictures with someone that is not her. This discovery puts her in a towering rage. (Go figure...) She collects these images and texts into a four page letter and sends them to members of both families along with words to the effect of "oh by the way, the wedding is off."
Low and behold, the State of Illinois charges her under their revenge porn statute. Not to be undone, she and her lawyers are making a federal case out of it. A First Amendment case to be exact. This one is on the way to the US Supreme Court with her arguing the Illinois law violates her right to free speech.[1]

its not really free speech when you take images and texts not meant for you and release w/o consent of one or more of the people involved such has the ex-fiancé and the women he cheated with they did not give her permission plus he could turn around and say "well she violated my privacy by going into my phone and viewing private exchanges and photographs without my permission" plus she really didn't "catch" him cheating she was actively looking for any info and did not just come across it by accident.
There is an excellent chance the courts may not agree with your assessment of the situation. I'm not really sure, but I have some guesses as to how this is going to go.
The first problem is it is really easy to inadvertently break the "reasonable expectation of privacy" doctrine, especially in the digital world. Over the last decade or so lower appellate courts consistently ruled that leaving your computer, tablet, phone, etc, laying around unlocked pretty much voids any privacy claim one might make. These decisions came down primarily from cases trying to void warrants obtained with probable cause garnered from spouses, significant others, coworkers, etc, that found something bad on someone else's device and turned that information over to police.
In every case the lower courts upheld the warrants, clearly stating that akin to leaving your diary open on the kitchen table, no law was broken. The Supremes refused to hear any of these cases allowing the lower court rulings to stand as the law of the land. A civil case came up some time ago where a reporter was able to look over some lower level executive's shoulder and get some juicy tidbit about General Electric which made ink in The New York Times. The court ruled the executive should not have been reading sensitive documents in a Starbucks and dismissed the case.
It should also be pointed out that if this were a divorce proceeding, all of those images and messages would be admissible. Once part of the case, they would become public record available to anyone that cared to wander down to the courthouse for a look.
The First Amendment restrains government from preventing anyone from saying just about anything they want to. There are exceptions to this. One may not yell fire in a theater, make threats, incite to riot, etc. There are also restrictions on obscenity. (Which is a very wide gray area because as yet no one has drawn a consistent legal line on what is obscene.) There have been Free Speech vs. privacy cases, most of which ruled for free speech. Think primarily paparazzi and tabloids here.
In this case we have a lady that somehow stumbled across texts and images between her fiance and someone else. She broke off the engagement and canceled the wedding. When pressed for details, she explained he was unfaithful. According to court transcripts, upon hearing about her response the fiance told anyone that would listen she was delusional using the words, "she's crazy" and "she's out of her mind." Her response was to compose a four page letter, including the texts and images, and mail copies to everyone on the invitation list.
While I have no idea which way this is going to go, it is a sure bet her counsel is going to go before the Nine Scorpions and vigorously argue several points. — These images and texts were not publicly distributed. She didn't post them on the internet, take out a full page ad in the local paper, or post flyers on every fence and phone pole in the county. The letters were mailed only to those acquainted with one or the other. Therefore the state law is misapplied in this case. — The fiance opened the door to her response by impugning her character and mental status with words to the effect of "bitch be crazy" to her family and friends. Her letters are a more than reasonable response to the fiance's slander of her character and designed to set the record straight in a manner that removed all doubt from the conversation. — The state law she is charged under unfairly and unconstitutionally infringed on her absolute right to defend her reputation and standing in the community through free speech. — The state law is an unconstitutional prior restraint on free speech in general.
Whatever the Supremes decide, this is going to be a great deal of fun to watch. I would love to be in the gallery for the arguments.

Last Saturday...
Me and my brothers and our Dad were taking down and putting away the Christmas tree and other Christmas decorations and putting up some Happy New Year decorations in the morning. Mom didn't help us cause she was in the kitchen baking cookies and experimenting with new recipes for our upcoming Annual New Year Family Gathering. During the afternoon me and my brothers and Mom tried to teach Dad to swim after we helped him to finally overcome his fear of drowning. An hour after dinner we played basketball with Dad cause Dad said he wanted to play basketball.
So it wasn't just too much post-Christmas. My Dad overexerted himself physically. :(
