RELATIONS WITH ENKON DELTA AND UNIVERSE

ENKON DELTA
Athretvari is a sovereign nationstate and an original founding member of the New Coalition of Nations, and maintains direct interactions with the nationstates therein via plenipotentiary envoys, embassies, and local representatives. The Government of Athretvari is committed to fostering and developing positive and constructive relations and mutually beneficial interactions with the foreign nationstates of the New Coalition of Nations and beyond to better provide for its economic prosperity and insure its national security, peace, prosperity and domestic tranquility.

NS WORLD ASSEMBLY
Athretvari is an observer-state to the WA, holding an indirect vote therein through Wicko. As such it does not automatically or officially adopt any WA resolutions passed. However, the Government of Athretvari does reserve the right to adopt sans avantages ni responsabilités, and with or without necessary revisions and amendments, those resolutions with which it agrees and are not offensive to Athretvari's national sovereignty, defense, security, peace or prosperity.

WA RESOLUTIONS ADOPTED BY ATHRETVARI
The following WA General Assembly resolutions are adopted by the Government of Athretvari without the benefits or responsibilities associated therewith. The Government of Athretvari adopts these resolutions as national law while reserving the right to revise and amend as necessary. The repeal by the WA of a resolution adopted by Athretvari has no effect in Athretvari unless the Government of Athretvari agrees and also repeals its adoption of the resolution. Athretvari also reserves the right to adopt with or without revision or amendment those resolutions already repealed.
  • GAR#3 The Right To A Fair Trial
    Adopted with amendments on AthDia 2618.

    Amendment 1: All persons charged with a criminal offense shall be provided an available expert legal advocate and available paralegal assistant from the realm of legal advocates and counselors of their choosing and their own expense, or should such advocate and/or paralegal be unavailable, one or both selected and being of the defendent’s approval, from and by the realm of legal advocates and counselors at the expense of the state. The same shall apply to proceedings of appeal.



    Amendment 2: Juries in high criminal proceedings, being those possibly resulting in sentences of imprisonment of 5 years or greater, or forfeiture of wealth in excess of 1 million AthCoins shall consist of 13 citizen-residents selected by lottery and be presided over by 3 expert judges selected by lottery from the realm of justices. All other criminal proceedings shall be decided by juries of 7 citizen-residents selected by lottery and be presided over by an expert judge selected by lottery from the realm of justices. Juries in administrative proceedings, being those possibly resulting in fines of specific quantities or rates for violation(s) of administrative laws, shall consist of 9 citizen-experts selected by lottery from the relevant realm, and presided over by 1 expert administrative judge selected from the realm of justices.



    Amendment 3: The right to remain silent shall not include the right to refuse cooperation in a criminal or administrative proceeding or the refusal to provide physical or electronic documents, data or records declared as admissible as evidence in a criminal or administrative proceeding by the presiding judge(s). Such refusals may be punished with imprisonment no greater than 1 year and a forfeiture of wealth of no greater than 250,000 AthCoins, per offense as agreed by the proceeding’s presiding judge(s) and sitting jury.



    Amendment 4: Confinement or forfeiture of wealth in accordance with existing Athretvari Laws shall not be considered as applying “duress” or any form of “physical or psychological torture”.



    Amendment 5: A guilty verdict in all instances shall be defined as unanimity of the jury excepting perhaps one, and the agreement of the presiding judge or a majority of them if they be more than one. In all instances when there be disagreement among any of the jury or judges, they shall openly declare the reasoning therefor before the presiding judge(s), jury, and public spectators of the proceeding. The same shall be preserved in the record of the proceeding.

    Amendment 6: The right to question witnesses may be exercised by the presiding judge(s), a defendant’s or prosecuting legal advocate or paralegal assistant, or the jury.



    Amendment 7: No sentence of imprisonment, forfeiture of wealth, or administrative fine shall be imposed that is not specified by existing Athretvari Laws for the defined offenses of which a defendant shall be found guilty.



    Amendment 8: There shall be limited time afforded the state to prosecute any criminal or administrative offense that does not involve the physical harm, injury, or death to a person or animal worthy of high regard. Thusly, there shall be no time limit restricting the state from prosecuting any criminal or administrative offense when the offense(s) do involve harm, injury, or death to a person or animal worthy of high regard.

    Amendment 9: This adoption and these amendments are considered part of Athretvari Laws and subject to the legal scrutiny of Athretvari’s courts, and the legislative scrutiny of the Government of Athretvari. This adoption or any part of it may be amended or repealed at the will of the Government of Athretvari via acts of legislation and rules of regulation.

  • GAR#6 Humanitarian Transport
    Adopted with amendments on AthDia 2618.

    Amendment 1: Defensive or security personnel, vessels, guard-drones or other such assets and the carrying of their respective necessary weapons and suppies, when they are engaged in the escort of humanitarian vessels for their protection shall not be construed as materials directly supporting combat operations, but instead as part of the defense and security of the humanitarian vessels. Said defense and security personnel, vessels, and other assets shall conduct themselves in manners consistent with being part of humanitarian missions, however they may not be, and are authorized to resist being, searched or seized, except by an agent or agents explicitly authorized by the Government of Athretvari to perform such action(s). The hulls of all such vessels shall clearly exhibit the official markings and insignia of Athretvari and the Commontongue phrase “Humanitarian Security of Athretvari” in such manner as can be easily observed and read from at least 0.5 kilometer distance by other vessels within the same sphere-of-operation, be it air, sea, space, or other such “sphere”.

    Amendment 2: The hulls of all humanitarian transport vessels registered with Athretvari, and thusly, operating under Athretvari Laws, shall be colored completely white excepting a large solid red cross within a solid red crescent and the Commontongue phrase “Humanitarian Transport of Athretvari” in bold red letters and in such manner as can be easily observed and read from at least 1.5 kilometers distance by other vessels within the same sphere-of-operation, be it air, sea, space, or other such “sphere”.

    Amendment 3: This adoption and these amendments are considered part of Athretvari Laws and subject to the legal scrutiny of Athretvari’s courts, and the legislative scrutiny of the Government of Athretvari. This adoption or any part of it may be amended or repealed at the will of the Government of Athretvari via acts of legislation and rules of regulation.

  • GAR#7 Workplace Safety Standards Act
    Adopted with amendments on AthDia 2619.

    Amendment 1: For all workplaces there shall be assigned a Workplace Safety Standards Compliance Officer by the Ministry of Health & Safety who shall insure the compliance of this adoption and its amendments in their respectively assigned workplaces.

    Amendment 2: For all workplaces where employees must handle chemicals to perform their work there shall be assigned a Chemical Safety Officer by the Ministry of Health & Safety who shall insure the compliance of this adoption and its amendments in their respectively assigned workplaces, and assist the Workplace Safety Standards Compliance Officer with respect to issues concerning chemical safety.

    Amendment 3: For all workplaces where employees must operate tools, machines, or motorized vehicles to perform their work there shall be assigned a Machines Safety Officer by the Ministry of Health & Safety who shall insure the compliance of this adoption and its amendments in their respectively assigned workplaces, and assist the Workplace Safety Standards Compliance Officer with respect to issues concerning tool, machine, and motorized vehicle safety.

    Amendment 4: For all workplaces with 50 or greater employees there shall be assigned, for every 50 employees, a Compliance Inspection Officer by the Ministry of Health & Safety who shall insure the compliance of this adoption and its amendments in their respectively assigned workplaces, and assist the Workplace Safety Standards Compliance Officer with respect to issues concerning workplace safety.

    Amendment 5: The Ministry of Health & Safety and the Ministry of Industries & Services shall coordinate and provide joint rules and regulations regarding workplace safety and emergency response procedures, personnel, equipment, facilities and emergency exits. For all workplaces, the Workplace Safety Standards Compliance Officer shall insure compliance with those rules and regulations.

    Amendment 6: The Ministry of Health & Safety shall perform regular and frequent inspections of workplaces to insure compliance with this adoption and its amendments.

    Amendement 7: This adoption and these amendments are considered part of Athretvari Laws and subject to the legal scrutiny of Athretvari’s courts, and the legislative scrutiny of the Government of Athretvari. This adoption or any part of it may be amended or repealed at the will of the Government of Athretvari via acts of legislation and rules of regulation.

  • GAR#9 Prevention Of Torture
    Adopted with amendments on AthDia 2619.

    Amendment 1: Wherein the adopted resolution it does says “member nation” or “member nations” it shall be understood to include Athretvari and its realms and other constituent parts unless otherwise excepted by Athretvari Laws.

    Amendment 2: Torture, as defined in the adopted resolution, is a heinous high crime in Athretvari and all its constituent parts, and punishable by upto 20 years imprisonment and forfeiture of upto 25 million AthCoins, per offense.

    Amendment 3 : Investigations into accusations of torture, or when probable cause exists to believe that an act of torture has been committed, are authorized and shall be conducted by the Civil & Human Rights Division of the Crimes Investigation Agency of the Department of Justice within the Ministry of Law & Order.

    Amendment 4: This adoption and these amendments are considered part of Athretvari Laws and subject to the legal scrutiny of Athretvari’s courts, and the legislative scrutiny of the Government of Athretvari. This adoption or any part of it may be amended or repealed at the will of the Government of Athretvari via acts of legislation and rules of regulation.
