Election Process Act

THE LEFTIST ASSEMBLY

Description


The Election Process Act seeks to clarify the process by which free and democratic elections take place in The Leftist Assembly. This Act hereby makes all relevant changes to the Constitution and Code of Laws to group all existing election law into one Constitution Article, while also adding new provisions for the processes of candidate exclusion and election moderators.

Existing Law


Section II, Article II of the Constitution

The Secretary of the Assembly serves as the head of The Leftist Assembly for matters of diplomacy and military action. The Secretary may call for action against another region, declare a state of emergency and appoint heads of ministries that serve under them. The Secretary is elected by popular vote by the population of the region. They will serve a 3-month term. Elections will begin at the end of the months March, June, September and December.

Section III, Article II of the Constitution

The ministries shall be considered a core component of The Leftist Assembly government. Their heads shall be elected in a process mirroring that of the Secretary of the Assembly, unless the ministry serves directly under the Secretary in which case they are appointed. The head of ministries will serve a 3-month term and be elected at the same time as the Secretary. The head of each ministry will be referred to as the “Minister of” and their respective ministry. Section IV, Article II of the Constitution

Should proper elections be unable to take place by the end of the Secretary's term for any reason, then the current Secretary will form an Emergency Government Committee. This committee consists of the Secretary and six other regional members of their choosing, and replaces the General Assembly for the duration of the next three-month term, or until elections are next called. As such, each member of the committee is able to submit legislation, amendments, or a request to repeal legislation. A proposal requires a simple majority vote to be passed.

If the committee is formed as a result of insufficient participation in elections, it is tasked with the principal goal of increasing regional activity. The minimum parameters for accomplishing this goal is that four of the elected positions have at least two candidates running. Any further goals will be decided upon and implemented by the committee itself.

Article III of the Code of Laws

1. In circumstances where only one candidate is running for an elected office, that candidate will be faced with a confidence vote. The voters will be given the option of 'yes' or 'no'. To be elected, a candidate will need to gain a simple majority 'yes' vote. This helps to prevent officials from gaining power without public scrutiny or support due to lack of political activity.

2. In circumstances where this candidate does not receive a simple majority 'yes' vote, the office will once again be declared open and a run-off election will be held.

Alternative Law


Section I, Article V of the Constitution

Elections shall take place in the latter half of every Month of March, June, September, and December. Ministers therefore upon election serve a term of three months.

To begin the elections the Secretary must issue a regional poll whereby region members can nominate themselves for the elected governmental positions. This poll lasts 3 days. Each candidate is then automatically entitled to run unless all three Ministers of Law submit a ruling of exclusion from the election, citing a lawful reason why the candidate is ineligible to run. If the candidate in question is themselves a current Minister of Law the Prime Minister serves as the final minister in their place.

Section II, Article V of the Constitution

The election moderators of which there will be three will oversee that the election process is done according to democratic practices. The first moderator will be chosen by the Secretary; they must be someone who has access to the founder account. The second and third moderator will be nominated by the via self-nomination. In this process, members may nominate themselves as moderators if they fulfil the criteria that they are WA members and are not candidates for election, the General Assembly then votes on who should become a moderator. The members who have the most and the second most votes become moderators, in the event of a tie the Secretary casts the deciding vote.

The elections will be held in secrecy using an online ballot, where all eligible candidates are listed against other candidates running for their respective positions. Voters submit their ballot and then confirm their ballot with The Leftist Assembly Founder.
