Constitution of Cyland

Preamble:

In order to preserve the stability, security, and peace of the region, the rights of its residents, and the community they create, this Constitution hereby establishes the government of Cyland.

Article 1: Citizenship

Section 1: Citizens shall be nations that have been in the region for 24 hours, have a place on the map, and are the primary nations of the account holder. Only one nation per person may be considered a citizen.

Section 2: Only citizens may participate in regional cannon, hold office, or vote on any poll regarding regional government.

Section 3: The account "Founder of Cyland" may not be considered a citizen, may not vote, and may not hold office. The holder of this account must execute the duties of the Founder.

Section 4: The Rights of the Citizens shall include:

    1. Right to free speech within the confines of Site Rules and Regional Law
    2. The Right to Vote.
    3. The Right to express their views in the senate.
    4. The Right to express dissent from the government in a manner that follows the Site Rules and Regional Law.
    5. The Right to due process for appealing of bans or ejections by the regional officers.

Article 2: The Senate

Section 1: The Senate will consist of five nations who are popularly elected for 3 month terms. Existing Senators may be challenged to an election by any Citizen who does not already hold office.

Section 2: The senate shall have the power to legislate laws presented to them by any citizen of the region, introduce and pass amendments to the constitution, impeach the president, confirm appointments by the President, and to ratify Treaties or Alliances negotiated by the Executive Branch.

Section 3: Laws should undergo the following process:

    1. A citizen introduces a bill to the senate;
    2. The senate debates the merit of the bill and discusses how it will help or hurt the region;
    3. The senate will then vote on the bill, which will require 3/5 senators to vote for the bill to pass.

Alliances should also undergo this process.

Section 4: Confirmation of appointments should undergo this process:

    1. The President presents the appointments to the Senate;
    2. The Senate discusses the merit of the individual appointees in relation to the position they are appointed to;
    3. The senate will then vote on the appointee, which will require 3/5 senators to vote for the appointee to be confirmed.

Section 5: Amendments to the Constitution will undergo the following process:

    1. A citizen introduces the Amendment to the Senate;
    2. The senate will debate the amendment in relation to the Current Constitution, what problems it may solve, what rights it may award or take away, and if it is properly written;
    3. The Senate will vote on the amendment (which the President may not veto) and it will pass if 4/5 senators agree on the amendment, but preferably with a unanimous vote;
    4. The amendment will be presented to the citizens in the form of a poll which will last for three days;
    5. If the Amendment passes the poll with more than 60 percent of the region's Citizens voting in the affirmative, the Amendment will be added to the constitution;

Section 6: Impeachment shall undergo the same process as an amendment.

Section 7: The Senate shall determine the rules of its proceedings, but must allow citizen nations that are not part of the Senate to participate in the discussion or introduction of the bill, amendment, or alliance.

Section 8: The Vice President shall enforce the rules of the senate and act as Speaker.

Article 3: The Executive Branch

Section 1: The Executive branch shall enforce the laws of region and run the regions day to day operations.

Section 2: The power of the Executive shall be placed in the President, who will be elected every 6 months. The president will have the following powers:

    1. The President, as leader of the Executive Branch, shall appoint all other executive officers in the region with confirmation from the Senate and may dismiss these officers at any time.
    2. The President, as leader of the Executive Branch, shall execute the power of border control in accordance to the laws of the land.
    3. The President, as leader of the Executive Branch, shall ensure that all executive officers are performing their duties as expected by the President and the Senate
    4. The President, as leader of the Executive Branch, shall act as commander in chief of the R/D Army in conjunction with the Secretary of Defense.
    5. The President, as leader of the Executive Branch, Must Approve or disaprove of all executive orders written by officers during the president's term.
    6. The President, as leader of the Executive Branch, shall have the power to veto any bills or alliances passed by the senate. This veto may be overridden with a popular vote by a poll which will last 3 days.
    7. The President, as leader of the Executive Branch, shall be required to write an Executive Order defining the region's Foreign Policy within one week of taking office. This Executive Order should repeal the previous Foreign Policy as well.

Section 3: The President must appoint citizen nations to these positions and present these appointees to the senate for confirmation:

    The Vice President:
    1. The Vice President will act as the leader of the senate and as an adviser to the president and as chief justice . The VP will also assume the temporary role of any officer that is absent or has left the office empty.
    2. The Vice President will also be first in line if the President Resigns or is otherwise absent.

    The Secretary of Roleplay:
    1. The Secretary of Roleplay will Enforce the standards of roleplay as decided by regional law, will help new nations build their nations up based on Factbooks, and advise them on how to best justify their desired nation.
    2. The Secretary of Roleplay will regulate roleplay through Executive Orders.
    3. The Secretary of Roleplay will also have control of the map and who goes on it.
    4. The Secretary of Roleplay will be second in line if the President Resigns or is otherwise absent.

    The Secretary of State:
    1. The Secretary of State will act as the Regions delegate to all other regions, will decide on Alliances and embassies in accordance to Regional law, and be responsible for the heading of Recruitment programs for the region.
    2. The Secretary of State shall be allowed to write Executive Orders regarding the function of their office.
    3. The Secretary of State will be third in line if the President resigns or is otherwise absent.

    The Secretary of Defense:
    1. The Secretary of Defense shall be the commander of the R/D army. This officer will decide how to organize the R/D army, what ranks it might have, how big it will need to be, and how it will operate.
    2. The Secretary of Defense shall be allowed to issue "Orders of the Day", which will dictate troop movements or orders.
    3. The Secretary of Defense may not engage the R/D Army without permission from the President.
    4. The Secretary of Defense may write Executive Orders within the scope of the office.
    5. The Secretary of Defense will be fourth in line if the President Resigns or is otherwise absent.

Section 4: Executive Orders are orders written by officers to regulate or clarify official positions on issues within the scope of their office. Executive orders will be treated as regional law and all orders must be approved by the President. If the region finds an Executive Order distasteful, or there is a large amount of resistance from the region against the Executive Order, then a regional Poll will be started by the President to decide on if it should be repealed, amended, or remain the same.

Article 4: The Judicial Process
The Judiciary of Cyland shall be a permanent branch of the government of Cyland, concerned with the apportionment of appropriate punishments for violations of regional law and this Constitution.

Section 1: The Judiciary of Cyland shall be represented in public affairs and, if applicable, Senate hearings, by an Attorney General of Cyland, to be selected by the President if they so desire when elected and then approved by a majority vote from the Senate. Should an Attorney General be indisposed by manners other than appointment by the President and Senate, the office shall be held until another appointment can be made by the Vice President.

Section 2: The Attorney General shall have the authority to arrest any citizen of Cyland under reasonable suspicion of a violation of regional law or this Constitution, and if they so choose, represent the Region of Cyland against the accused in the Regional Court.

    Section 2.1: Arrest shall be defined as removing the citizen's voting rights until such time as the trial can be completed. If the citizen is an officer or senator, the citizen will be temporarily removed from office until such time as a trial may be completed.

Section 3: The Regional Court shall be an informal institution, created whenever there is a need for it to judge a case brought forward by the Attorney General. The Regional Court shall consist of three judges, who shall be selected at random from the body of regional citizens. Should the Attorney General choose not to represent the Region of Cyland in any particular case, a fourth citizen shall be randomly selected to do so.

Section 4: The Regional Court will operate under the circumstances of the principle "innocent until proven guilty." The representative of the Region of Cyland, or the prosecutor, has the burden of proof to prove the accused violated regional law or this Constitution. After hearing each side of the case, from both the accused and the prosecutor, the Regional Court's three judges must come to a unanimous agreement whether or not the accused is guilty. If they cannot come to a consensus, the Court will be declared hung and the case will be judged by the Senate, of which only a majority is required to make a final ruling in any particular case.

Section 5: Under the circumstances of violations that reasonably require immediate removal from the region, such as spamming or comments that violate the Terms of Service of NationStates, the President shall be authorized to use any means necessary to remove nations committing such violations from the region. If those removed wish to return to citizenship in the region, they must appeal to a new session of the Regional Court (as specified in 4.3) where the Attorney General shall represent (or allow a random citizen to represent) the Region of Cyland and play devil's advocate against such nations.

Article 5: The Election Process

Section 1: Elections shall undergo the following process:

    1. The Founder or Delegate shall send out a regional telegram announcing the open office.
    2. Citizens shall have 24 hours from the time of the telegram to send a speech via telegram to the founder.
    3. Once the 24 hour window is closed, the Founder or Delegate will then start a regional poll regarding the election with a link to all of the candidates' speeches.
    4. The candidate with the most votes will be named the victor and take office the following day.

Section 2: The regional telegram informing Citizens of the election should be sent out 4 days before the end of the incumbent's term, the poll opened 3 days before the end of the term. If the election is the result of a challenge, the process should begin as soon as possible.

Article 6: Replacing the Constitution

Section 1: This Constitution will not be replaced without the approval of 75 percent of the Citizens who take part in the Regional poll asking the question "Should the Constitution be repealed and replaced?"
