The Region That Has No Big Banks

We the nations of TRTHNBB, in Order to create a more socialist Union, establish Democracy, insure domestic Welfare, provide for the common Citizen, promote the democratic socialist Ideology, and secure the Rights of Liberty to our nation’s and our Region, do ordain and establish the Constitution for The Region That Has No Big Banks.

Article I – General Provisions
  1. The Region That Has No Big Banks, shall be called TRTHNBB or it’s full name

  2. TRTHNBB shall promote the agenda and ideology of Bernie Sanders, and shall consist of any nation who shares a support for Sanders or an absence of large banks

  3. All records and written documentation of events within this region will be available publically either on the Discord, on The Social Reformer, or on the region’s Official Page in NationStates.

  4. The Region That Has No Big Banks does not discriminate on the basis of political ideology, religion, national heritage, or economic status in any of its policies, procedures, or practices.

  5. Citizens is any resident with both a NationStates account and Discord account, citizens may run for any office and partake in the Jury and Senate

  6. Residents is anyone with just a NationStates account, residents may not run for office, however they may vote

Article II – Purpose

  1. To establish a Regional Government to propose regional laws, represent the nations of the region, and enforce enacted laws.

  2. To promote the ideology of Bernie Sanders and create a region of like-minded nations.

  3. To bring together Bernie Sanders supporters throughout NationStates and establish a government with ideas and policies inspired by his message.

Article III – Organization

  1. The Regional Government

    1. The regional government shall consist of the following offices in order of succession.

      1. Prime Minister

      2. Deputy Minister

      3. Minister of Foreign Affairs

      4. Minister of Domestic Affairs

      5. Minister of Homeland Security

      6. Presiding Juror

      7. Founder

    2. The regional government shall consist of three separate branches, each tasked with different functions.

      1. The Executive Branch- Consists of the Council of Ministers, and the Founder. The Executive branch shall enforce the laws and manage the region.

      2. The Legislative Branch- Consists of the Senate, the Senate will contain every legal citizen who wishes to be in Senate the Senate shall be headed by the Deputy Minister

      3. The Judicial Branch- Consists of the Jury, the Jury will interpret if laws made by the other branches are fair. Alongside this the Jury will be incharge of determining innocence or guilt in legal cases. The Jury shall be headed by the Presiding Juror.

    3. The three branches of government together shall contain an internal set of checks and balances to ensure one never is more powerful than the others.

      1. The Executive Branch- The Prime Minister may veto legislation from Senate, nominate the Presiding Juror, and utilize Executive Orders or Ministerial Orders to fill in policy gaps in Regional Legislation, so long as they receive a ⅔ approval by Senate afterwards.

      2. The Legislative Branch - The Senate must approve all of the nominations by the Prime Minister, while also being able to outvote the Prime Minister’s veto with a ⅔ majority vote in favor.

      3. The Judicial Branch- The Grand Juror may deem legislation or Ministerial/Executive Orders as unlawful. The Grand Juror may make revisions and present it back to the Senate. The Jury may determine the actions or policies of regional officials as unconstitutional, leading to the suspension from their position, permanent impeachment, or in extreme cases ejection from both Discord and the region.

Article IV – Offices

  1. Prime Minister- Head of Government of TRTHNBB

    1. Powers

      1. Nominates nations to be in the Council of Ministers

      2. Calls special meetings with the Council of Ministers and/or Senate

      3. Veto legislation that goes through Senate

      4. Utilize Executive Orders in order to fill in policy gaps in regional legislation, cover all things in the purview of the functioning of the Executive Branch

    2. Duties

      1. Preside over all meetings of the Council of Ministers.

      2. Create new positions in the Council of Ministers as they are needed.

      3. Act as the official representative for the region in cases where the Minister of Foreign Affairs is either unavailable or does not have the power to do what is required of the situation.

      4. Approve/Sign off on all legislation, any amendments to the Constitution, and all major decisions that affect the region or Regional Government.

      5. Take over any duties of positions that have yet to be filled or have been vacated until they can be re-elected once again.

  2. Deputy Minister

    1. Powers

      1. Take up the office of Prime Minister if vacated, until a replacement is found

      2. Can act as temporary minister in ministries without an official Minister

      3. Placed as the head of Senate, breaks ties, and calls votes

      4. Moderates and oversees the Senate

    2. Duties

      1. Act as the authority figure in chaotic or unlawful situations which the Prime Minister is not there to observe and act on.

      2. Serve as the defendant and representative for the Council in all Judicial cases against the Administration.

      3. Lead discussion and make sure progress is made in sessions of the Senate.

      4. Call sessions of Senate and schedule future sessions

      5. Work directly with the Ministers of Domestic and Foreign Affairs in order to develop and bring forth legislation relating to both parties.

      6. All further duties can vary based on what is necessary

  3. Minister of Foreign Affairs

    1. Powers

      1. Establish embassies with other regions, disestablishing embassies requires consultation with other Ministers or approval of the Senate

      2. Calls special meetings with the Council of Ministers and/or Senate on foreign diplomacy matters

      3. Broker truce, armistice, and peace, and be present in peace treaties and WA hearings.

      4. Implementation of regional polls.

      5. Involve TRTHNBB in inter-regional cooperation pacts

    2. Duties

      1. Communicate major foreign events to the Prime Minister and Ministers

      2. Act as the official representative of the region in all diplomatic matters.

      3. Actively further connections with neighboring regions through embassies and/or diplomacy

      4. Create and maintain interregional military and economic alliances

  4. Minister of Domestic Affairs

    1. Powers

      1. Ability to edit the main page of the region, and of affiliated forums

      2. Calls special meetings with the Council of Ministers and/or Senate concerning domestic matters

      3. Ability to poll the populace in order to make better legislation

      4. Access to changing the recruitment telegram if seen fit

    2. Duties

      1. In charge of all aesthetic parts of the region’s pages.

      2. In charge of updating new information in the region’s pages that the Prime Minister is unable to attend to or forgets to change.

      3. Report on Internal Developments in the region to the Council.

      4. Develop strategies to get new nations more involved in the region.

      5. Work with the Council of Ministers to create a more welcoming atmosphere for new arrivals to the region.

  5. Minister of Homeland Security

    1. Powers

      1. Banish and/or punish nations that have broken laws within the region.

      2. Create and enforce immigration protocol

      3. Prevent, mitigate, and prepare for a potential raid

    2. Duties

      1. Ban nations that come to TRTHNBB with the intent of raiding

      2. Ban nations that have conspired to raid TRTHNBB

  6. Presiding Juror

    1. Powers

      1. Preside over the Jury

      2. Call Ministers under scrutiny to a trial

      3. Placed as head of the Jury, breaks ties, and calls trials

    2. Duties

      1. Interpret the laws of TRTHNBB.

      2. Assess evidence in court cases.

      3. Serve as an impartial decision-maker in the pursuit of justice when the jury is inconclusive or tied.

  7. Founder - Head of State

    1. Powers

      1. Appoint a Prime Minister if the office is vacated

      2. Override all government officers in the case of emergency

    2. Duties

      1. Maintain order and unity during chaos

      2. Serve as an advisor to all members of the government

Article V – Elections

  1. Voting

    1. All residents within the region have the right to vote in all regional elections

  2. Election Process

    1. The methodology in which elections are run and voted on is subject to change as it will evolve over time to become more convenient and efficient.

    2. All elections will be held with an open ballot in order to guarantee fairness

    3. The candidate that has received the most votes will win the elections

    4. When appointing Ministers, the Senate will vote, in favor of or against, the nomination of the potential Minister in question

    5. All elections will be reviewed and confirmed to be accurate and fair by the Founder before any nation is elected to office.

    6. Elections will take place every four months on a day that works best for all the candidates to get their information released to the public in sufficient time.

  3. Elected Positions:

    1. Prime Minister: Several candidates run and the victor is the Prime Minister

    2. Ministers: Nominated by the Founder and Prime Minister, then approved

    3. Presiding Juror: Nominated by the Prime Minister, then approved

  4. Qualifications:

    1. Prime Minister: Any citizen with no history in raiding

    2. Ministers: Any resident deemed experienced by the Senate

    3. Presiding Juror: Any citizen with no history in raiding and deemed experienced by the Senate

  5. Term Lengths and Limits of Office

    1. Every elected and appointed office is up for re-election/re-appointment at the end of four months (excluding High Judges which hold power for one year) all citizens and residents have no restrictions on term limits for any of the offices.

Article VI – Impeachment

  1. In order for a nation in office to be impeached, there must be a vote of at least ⅔ of the Senate and a justification for the impeachment presented to the Jury in order to have it confirmed.

  2. The nation in question will have the opportunity to defend themselves in a public hearing made accessible to all residents of the region.

  3. Once the impeachment process has concluded, there will be an immediate re-election/appointment with the impeached nation barred from running for office for one election cycle and potentially ejected for a short period of time.

  4. In the event of a worst-case scenario (regional crisis, psychotic dictatorship, war), the Founder will temporarily take over control of the region if absolutely necessary.

  5. Another method of impeaching a Council Member is to prove they have committed an unconstitutional action while in office and get a confirming verdict from the Jury. Another appointment will be voted on as soon as is convenient for the Senate to convene.

Article VII – Senate

  1. The Senate shall consist of:

    1. An open, unicameral institution, which consists of every region citizen

    2. Any citizen who wishes to be in the Senate may be allowed to do so

    3. The Deputy Minister, which has the role of leading discussions and presenting legislation to the body as a whole

  2. The Senate is responsible for the creation, passage, and repeal of any and all legislation for the region.

  3. The Senate may determine its own bylaws to govern its functioning, so long as they are not in violation of the Constitution.

  4. All appointments made by the Prime Minister must first be confirmed by the Senate in order to take effect.

  5. Legislation passed through the Senate can be vetoed by the Prime Minister, however, the veto can be overturned with a ⅔ vote majority in Senate.

  6. Any resident may propose legislation for the Senate to vote on and enact.

Article VIII – Interpretation of the Constitution and Legislation

  1. All claims and concerns of unconstitutional actions taken by the government and unconstitutional legislation passed by Senate may be brought to the Jury to determine constitutionality. If such unconstitutional claims prove true, the Founder shall take swift action to remedy the situation.

  2. Residents may file complaints and lawsuits against the Regional Government if they believe that the current regional law was broken and/or if they believe they were the victims of unlawful actions perpetrated by the Regional Government. All complaints and lawsuits must be filed and reported to the Presiding Juror in order for the Jury to take the case(s).

Article IX – Fundamental Rights

  1. Freedom of Religion - Each Resident of TRTHNBB has the right to worship any religion they please, whether it involves making it their national religion and/or preaching of it on the RMB.

  2. Freedom of the Press - Each Resident of TRTHNBB has the right to create, write for, and promote any news publication, whether it is one founded in the region or outside of it.

  3. Freedom of Assembly - Each Resident of TRTHNBB has the right to assemble in protest(s), political parties, activist group(s), and any other form of assembly that does not promote hate or violence.

  4. Freedom of Speech - Each Resident of TRTHNBB has the right to any speech, so long as they do not commit any acts of libel, slander or direct threats of violence.

  5. National Sovereignty - Each Resident of TRTHNBB has the guaranteed protection from the Regional Government that they will not have their national sovereignty threatened or taken away for any reason, under any circumstances. If the Regional Government fails to meet this protection and infringes on a Resident's sovereignty, the Resident can bring their case to the Supreme Court and have their sovereignty reinstated.

Article X – Amendments

  1. Amendments to the Constitution may be proposed by any resident in the region. Residents should send proposals to Senate.

  2. Approved amendments to the Constitution will be put up to vote by Senate. If there is a majority vote of 51% in favor of the amendment then it will be ratified and added on to the Constitution and will be immediately enforced.
