The ASEAN Code

The ASEAN Code

TO UNITE OUR STRENGTHS AND STRENGTHEN OUR UNITY, THE ASEAN CODE IS HEREBY ESTABLISHED AS THE SUPREME LAW OF THE REGION OF ASEAN

Article 1: Preliminary Notes

1) The ASEAN Code shall be recognized as the ultimate code of laws for the region of ASEAN. All laws shall be appended and/or amended to the ASEAN Code.

2) For the duration of this document, the following acronyms and short forms shall be used to replace their verbose counterparts:
a) WAD for World Assembly Delegate
b) WFE for World Factbook Entry
c) RMB for Regional Message Board
d) CTE for Cease to Exist

3) Any administrative action, including actions related to legislation and membership requests, requiring the consent of ASEAN members shall pass through a voting session, in which “majority consent” is determined to be approval deriving from the majority of those ASEAN members participating in the voting session, not from the majority of ALL ASEAN members.

4) During each voting phase, each ASEAN member is given one vote.

5) This one vote is transferable and retractable.

Article 2: Membership

1) Any nation that has not obtained membership and is residing in ASEAN shall be considered an ASEAN observer.

2) Any nation that has obtained membership and is residing in ASEAN shall be considered a current ASEAN member.

3) In order to become an ASEAN member, the observer must pass the following requirements:
a) Not be a puppet nation of a current ASEAN member
b) Reside in ASEAN for at least one week

4) All membership benefits herein granted shall be vested in the current members of ASEAN. These membership benefits include, but are not limited to:
a) Proposing, debating, and voting on legislation
b) Voting for WAD in the WAD election
c) Being eligible for other government positions

5) Membership status shall be lost and the nation demoted to observer status as a result one or more of the following events:
a) Member unilaterally revokes membership
b) Ban and ejection from ASEAN
c) Majority vote in favor of demotion from ASEAN members
d) Non-residence in ASEAN for at least one week

Article 3: Leadership Powers

1) All leadership powers herein granted shall be vested in the executive authority of the region, which shall be comprised of the Founder and the WAD.

2) The following leadership powers require the majority consent of ASEAN members:
a) Appointing cabinet ministers
b) Proposing, constructing and withdrawing embassies
c) Editing regional tags
d) Appending to and amending the ASEAN Code

3) Other leadership powers not mentioned above but are exclusive to both the Founder and the WAD shall not require the consent of ASEAN members for execution.

Article 4: Founder

1) The nation shall be recognized as the founder of ASEAN.

2) The founder shall be delegated certain exclusive powers, which include:
a) Banning and/or ejecting the WAD, if necessary
b) Banning and/or ejecting nations deemed a threat to the region
c) Appointing moderator(s) to supervise WAD election
d) Supervising the WAD election
e) Issuing executive orders
f) All leadership powers mentioned in Article 3

3) The founder is and will always be an ASEAN member, even if it CTE.

Article 5: World Assembly Delegate Election

1) The selection of the WAD shall be determined through the electoral process.

2) The WAD election shall be held 5 days before the end of the incumbent WAD's term.

3) The WAD election shall be monitored and moderated by the Founder and/or election moderators appointed by the Founder at his discretion.

4) The WAD election shall be divided into two chronological phases: campaign and voting.

5) Nations that wish to run for WAD must:
a) Have a population of at least 500 million
b) Be a WA member
c) Be an ASEAN member
d) Declare their intention to run for WAD in RMB
e) Swear an oath in their declaration that they will not betray ASEAN
f) Include in their declaration a list of previous government positions held in other regions
g) Satisfy clauses (a) to (f) before the start of the voting phase

6) Candidates are prohibited from being election moderators for the same election they are running in.

7) ASEAN nations are permitted to nominate, campaign, and debate during the campaign phase.

8) The campaign phase shall last for 3 days.

9) Nations that wish to vote for candidates in WAD election must be an ASEAN member.

10) Nations are permitted to campaign, debate, and vote during the voting phase.

11) The voting phase shall last for 2 days.

12) Votes for a candidate that has withdrawn are declared null and void for that candidate.

13) If there is only one candidate at the end of the campaign phase, then that candidate shall automatically be deemed the WAD.

14) If there are no candidates at the end of the campaign phase, then the incumbent WAD shall retain the position for another term.

15) If the winner of the election is not the incumbent, WA endorsements shall be transferred from the incumbent to the winning candidate to allow the winner to become the new WAD.

16) If the winner does not become WAD within 7 days after the election, then the incumbent shall be required to temporarily resign from WA to allow the winner to obtain the WAD position.

Article 6: World Assembly Delegate

1) The WAD shall function as the second executive authority after the Founder.

2) The executive powers of the WAD shall be dependent on the Founder's permission for WAD administrative powers.

3) The WAD shall adhere to a term of 60 days, with no term limits.

4) The WAD shall be delegated certain exclusive executive powers, which include:
a) Voting in WA General Assembly and WA Security Council
b) Implementation of WA-related legislation
c) Banning and/or ejecting any nation deemed to be a threat to the region, except the Founder
d) All leadership powers mentioned in Article 3

Article 7: Cabinet

1) Minister positions shall be created or removed by Founder and/or WAD at their discretion.

2) Cabinet ministers shall be appointed by Founder and/or WAD with majority consent from ASEAN members.

3) Cabinet ministers are required to be ASEAN members to be eligible for appointment and must maintain membership throughout the duration of their careers to maintain their positions.

Article 8: Legislation

1) Only ASEAN members are permitted to propose bills and vote on legislation.

2) Both ASEAN members and observers are permitted to participate in legislative debate.

3) Any legislation with intention of appending/amending the ASEAN Code shall be noted accordingly.

4) The legislative process shall be divided into three chronological phases: proposal, voting, and conclusion.

5) The first phase shall be declared as the proposal phase.

6) Any ASEAN member shall be able to propose bills for consideration at any time.

7) Proposed bills shall be posted in RMB.

8) The type of legislation shall be indicated in the proposed bill.

9) The proposing nation shall be able to rescind their bill at any time.

10) The proposing nation shall be able to amend their bill prior to the voting phase for that particular bill.

11) The second phase shall be declared as the voting phase.

12) ASEAN members place votes with respect to a particular bill during the voting phase.

13) ASEAN nations are permitted to discuss the bill during the voting phase.

14) The voting phase shall commence at the end of the proposal phase.

15) The length of the voting phase shall be specified.

16) Votes shall be placed in the RMB.

17) Multiple bills can be voted on at the same time.

18) The third phase shall be declared as the conclusion phase.

19) The votes for a bill shall be counted at the end of the voting phase.

20) Results of the vote counting shall be posted in RMB.

21) A bill that has passed with the majority of votes shall officially be considered legally binding, and can be implemented.

Article 9: Endorsement Cap

1) All WA members in ASEAN, except the elected WAD, are subject to an endorsement cap if the number of endorsements for the WAD exceeds 2.

2) The endorsement cap shall be placed at 75% of WAD endorsements.

3) Any nation exceeding the endorsement cap shall be ejected from the region by either the Founder or the elected WAD at their discretion.

Article 10: Holidays

1) On 18 August 2013, in commemoration of establishing over 100 embassies with other friendly regions, 18 August shall be celebrated as ASEAN Unity Day.
