Constitution of the Republic

Constitution of the Republic of the United Confederacy of Texas

Preamble:

We the people of the Republic, in respect of the United States of America, in order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common Defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the Republic.

Article I.

Section I: Legislature:

A bicameral legislature shall be established to create federal law. This legislature, known as Congress, shall consist of the Senate and House of Representatives. The Senate will be represented by eight Senators from the states of the Republic, nine from each of the Federal Districts, and seven from the Autonomous Republics. The Senators shall be elected every six years, with no fixed term limits, and elections are to be held every two years to fill any vacant seats in the Senate. To qualify as a Senator, one must be at least twenty-five years old, have been living in their district of representation at the time of election, and have been living in the Republic for five years, regardless of citizenship.

As for the House of Representatives, the amount of Representatives are in proportion to the population, but there must be at least one Representative in each district of the Republic. Representatives shall be elected to two year terms, also with no fixed term limits, and elections shall be held every two years for new positions in the House of Representatives. To qualify as a Representative, one must be at least twenty-three years old, have been living in their district of representation, and have been living in the Republic for at least five years, regardless of citizenship.

In the case of a vacant seat before the elections, Congress shall authorize an election to temporarily occupy the seat until the next election date. The powers and duties of the Legislature include signing authorized laws and control of debate.

Section II: Executive:

The executive branch shall be under a cabinet headed by the President. The President shall be both the head of state and the head of government of the Republic, as well as the Commander-in-chief of the Republican Armed Forces. The President shall cover a variety of duties, such as approving or vetoing proposed laws from Congress, command the military, and select cabinet officials. The President shall be elected via popular vote every four years, with no fixed term limits. To run for office, one must be at least twenty-one years old, unless recommended by Congress to at least seventeen years, and shall been a citizen for seven years, regardless of citizenship.

If a President is to be found to be in violation of the Constitution or federal law, they can be impeached after a verdict from the Supreme Court and a two-thirds vote from Congress. If a President has been impeached, deceased, or unable to perform his or her duties, then the Vice President shall be first to replace the President. The Vice President shall also serve as President of the Senate and shall execute powers to help in certain laws proposed by the Senate. Requirements for the office of Vice President shall be the same as the requirements for the Presidency.

If the Vice President is unable to perform the duties of the President, the next in line of succession shall be the Speaker of the House, followed by the President pro tempore of the Senate, and the Secretary of State. If any of the offices above are able to fulfill the role of the President, a temporary election shall be held in a joint session of Congress to elect an acting President until the next election.

Section III: Judicial:

The judicial branch shall consist of the Supreme Court, headed by nine judges. These judges shall be elected every ten years by the citizens of the Republic via popular vote. The duties of this court are to determine the constitutionality of federal and local laws, to interpret the constitution as it applies to cases related to the constitution, and to preside over impeachment trials. A judge may be impeached if it is determined that he or she has committed any unlawful activity or violated constitutional law. The impeachment trial will be conducted by Congress, and shall be presided by the President of the Senate (Vice President).

Article II.

Section I: Organization of Administrative Districts:

The Republic shall be divided into four administrative districts: States, Federal Districts, Autonomous Republics, and Autonomous Confederations, which will hold administrative power within their respective borders. These districts are sovereign entities within the Republic and while subject to federal law, are free to establish their own local governments, while code of law are determined by the Federal Government. For a state to become an Autonomous Republic, a two-thirds majority referendum must be confirmed by the state's executive branch, the state's population, and Congress, excluding state Senators and Representatives. The request will then be approved by the President, with the state now granted greater autonomy at the cost of government representation. An Autonomous Republic may also pursue for classification as an Autonomous Confederation, or union with other Autonomous Republics. To become an Autonomous Confederation, two or more Autonomous Republics sharing the same borders shall be confirmed by the signatories, then follow the same steps as reclassification. A state may also secede by performing the same steps for reclassification, but with a year of forming a provisional government until legally declared an independent nation.

Article III.

Guaranteed Rights of the Citizens of the Republic:

The following Rights shall be guaranteed to any and all Citizens of the Republic, and are Unalienable, to the extent of which includes the times of Peace and War, so as to retain a Democratic society whatever the costs may be, and Maintain the Sense of Order necessary to keep the Republic a Strong, Sovereign, and United Nation to Protect the Citizens from Anarchy and Destruction.

I. By the Virtue of Liberty, Congress cannot impede on the Rights of the Citizens via establishment of any and all religions, as well as enforcing the stance for the Citizens to not adhere to religion, and to add to the freedoms of speech, press, the right of the people to peacefully assemble in protest, and to petition the Government of the Republic in addressing grievances against the Citizens.
II. As a Response to the Plights of the Citizens, in order for the Republic to maintain Security, and to keep the People well-armed against Anarchy and Violence, allow for the Citizens to actively pursue and partake in Purchasing, Operating, and Wielding Arms, but the Government shall enact Laws to maintain Order, and prevent Intolerable Actions from occurring.
III. In Respect to the Sovereign Rights of Man, no Soldier shall, in Times of Peace, be quartered in any House without the Consent of the Owner, nor War, unless as Proscribed by Law.
IV. As a Response to the Plights of the Citizens, the Rights of the Citizens to be Secure in their Persons, Houses, and Documents, against unreasonable Searches and Seizures shall not be violated, and no Warrants shall issue, but upon favorable outcomes, supported by Oath and Affirmation, and in particular the location of which Searches are to be held, as well as the Citizens and Possessions to be Seized.
V. In Respect to the Sovereign Rights of Man and of the Virtue of Liberty, no Citizens shall be held to answer to a Capital Punishment unless in the Presence or Indictment of a Grand Jury, except in cases arising in the Armed Forces, when in actual service of War or of Danger to the Public; nor shall any Citizen be subject to the same Offence to be twice put to Jeopardy of Life or Limb; nor shall any Citizen be Compelled to bear Witness against Oneself, nor be Deprived of Life, Liberty, or Property, without Due Process of Law; nor shall Private Property be Revoked for Public Use without just Compensation.
VI. In Respect to the Sovereign Rights of Man and of the Virtue of Liberty, Citizens shall enjoy the Right to a Speedy and Public trial, by a Jury of the District and County wherein the crime shall have been committed, which County shall have been previously Ascertained by Law, and to be Aware of the Nature and Cause of the Accusation; as well as to Confront the Witnesses against the Accused Citizen, the Right to compulsory process to Obtain a Witness in Favor of the Accused, and to enjoy an Assistance of Counsel in Defence.
VII. In Respect to the Sovereign Rights of Man and of the Virtue of Liberty, in Cases at Common Law, in which the Controversy exceeds twenty Credits, the Right to a Trial by Jury shall be Preserved, and no fact Tried by a Jury, shall be otherwise examined in any Court of the Republic
VIII. In Respect to the Sovereign Rights of Man and of the Virtue of Liberty, no Citizen shall be Subjected to neither Excessive Bail, nor Excessive Fines or be subjected to Cruel and Unusual Punishments.
IX. In Respect to the Sovereign Rights of Man, the Enumeration of certain Rights in this Constitution shall not be construed to deny or disparage other Rights retained by the Citizens.
X. In Respect to the Sovereign Rights of Man, any Powers not delegated to the Republic by this Constitution, nor Prohibited to it by the Districts, are reserved to the Districts, or to the Citizens.
XI. In Respect to the Sovereign Rights of Man and of the Virtue of Liberty, the Judicial Powers of the Republic shall not be construed to extend to any Case in Law or Equity by Citizens of another District or by Citizens of any Foreign Nation.
XII. As a Response to the Plights of the Citizens and of the Virtue of Democracy, the Citizens shall Directly Vote on the President and Vice President, regardless of whether the Votes are on Ballot or Online, by order of Most Desired Candidate to Least Desired, with a Signature of Certification at the bottom of the Ballot, and shall be sent to the President of the Senate. After the Ballots are organized by each District and checked for Certification, the President of the Senate shall, in presence of both the Senate and the House of Representatives, open and tally the Votes by Candidate. The Presidential Candidate with the majority of Votes is declared President-elect, and if no Candidates receive the majority, then the House of Representatives shall immediately Vote, by Ballot, for President. However, the election shall be held via District representation, the Representatives each holding one Vote; a quorum for this purpose shall be the two-thirds majority of the Districts’ Representatives. In the case the House of Representatives is unable to decide before the deadline, the Vice President shall act as President, as in the case of either Death or other Constitutional Disability for the President. The Vice Presidential Candidate with the majority of Votes is declared Vice President-elect, and in the case of no Candidates receiving the majority, the Senate shall elect the Vice President, with a similar quorum of a two-thirds majority of Senators. However, if a Candidate is Constitutionally Ineligible for the Office of the Presidency, they shall not be Eligible for the Office of the Vice Presidency.
XIII. In Response to the Plights of Man, neither Slavery nor Involuntary Servitude, regardless of the Conviction ordered, shall exist in any and all Territories controlled by the Republic. Congress shall have the Power to enforce this Right via Legislation.
XIV. In Response to the Plights of Man, the Republic shall grant the Right to the Pursuit of Citizenship; a Citizen shall automatically receive Citizenship if either a Parent or Legal Guardian already hold Citizenship in the Republic, the signing of Naturalization Forms, provided either Online or by Request, or living in any Territory of the Republic for a Term of two years, with filling out of daily reports to Government Officials.
XV. In Response to the Plights of Man, the Republic shall grant all Citizens the Right to Vote, and shall not be denied or abridged by the Republic or by any District based on Race, Gender, Sexual Preference, Place of Origin, or Religion. Congress shall have the Power to enforce this Right via Legislation.
XVI. In Response to the Plights of Man, Congress shall hold the Power to Lay and Collect Income Taxes, from whatever Source derived, without apportionment from the District, nor by regarding any Censuses or Enumerations.
XVII. In Respect to the Virtue of Democracy, Citizens shall be granted the Right to Directly Elect Government Officials of all Categories by a Popular Vote, and shall Vote for Replacement Officials every two years.
XVIII. In Respect to the Sovereign Rights of Man, Citizens shall be granted the Right to the Purchase and Consumption of Substances such as Alcohol, Tobacco, and various Narcotic Drugs, excluding substances that may cause immediate damage to the Consumer. Citizens shall be able to Consume Substances at the Age of 15, but are advised that Rehabilitation may occur by Request from Legal Guardians.
XIX. As per Request by the Citizens, the Citizens are granted the Right to determine the Beginning and End Dates for the Terms of Government Officials, so long as they fall within the Term Limits.
XX. In Response to the Plights of the Citizens, the Republic shall grant the Government Officials the Rights to not be held be Term Limits, but if found Breaching this Constitution of the Rights granted, they shall be Revoked and the Officials shall be put through the Supreme Court.
XXI. As per Request by the Citizens and by the Virtue of Liberty, the Republic shall grant to the Citizens who adhere to the Federal Districts or the Autonomous Republics rather than the States, the Right to Elect Senators and Representatives to Congress. All Districts shall also hold the Right, if a majority of Citizens and two-thirds of the Legislature desire, to secede from the Republic in a well-maintained manner.
XXII. In Response to the Plights of the Citizens, the Republic shall grant Citizens the right to a Guaranteed Vote of Officials without paying a Poll Tax, and shall not be Barred from Voting for not paying the Poll Tax. Congress shall be given the Power to enforce this Right via Legislation.
XXIII. In Respect to the Virtue of Democracy, the Republic shall allow Citizens the Right to decide on the Succession of the President and Vice President in terms of both Offices being vacant, with the decisions to either Re-elect new Office Holders, decide via Referendum, or Allow Congress to Vote using Provisions from Right XII.
XXIV. In Response to the Plights of the Citizens, the Republic shall grant Citizens the Right to Security from Prohibition of Voting Rights at or above Age seventeen, on account of said Age.
XXV. In Respect of the Sovereign Rights of Man, the Citizens shall delay any and all Laws that attempt to Raise of Lower the Salaries of the Senators and Representatives, until the next Elections of the Representatives.
XXVI. In Response to the Plights of Man and in Respect to the Sovereign Rights of Man, the Republic has granted Citizens the Right to Freely participate in Sexual Activities at the Age of sixteen, and are further granted the Freedom to partake in Activities with Members of the Same Sex, Family Members, other Species of the Republic, multiple Partners, and the Freedom to Engage in Activities in Public.
XXVII. As per Request by the Citizens, the Republic shall grant Citizens the Right to engage in the Sexual Market, which shall include working in Brothels and Engaging in Prostitution, so long as Health Checks are Enforced and Engaged regularly, and that no signs of Abuse or Favoritism occur between the Workers, Operators, and Clients.
XXVIII. As a Response to the Plights of Man, Citizens are granted the Right to Freely Operate vehicles upon reaching the Age of sixteen.
XXIX. In Respect to the Sovereign Rights of Man, Citizens are granted the Right to the Consummation of Marriage with consenting Partners, regardless of Gender, Species, Genetic Affiliation, or Amount of Partners Consummating. Citizens are able to Engage in Marriage at the Age of seventeen.
XXX. In Respect to the Sovereign Rights of Man, Citizens are granted with the Right of the Age of Majority, and are recognized as Citizens at the Age of seventeen, at which Citizens need not the Consent of Legal Guardians in certain Actions.
XXXI. In Response to the Plights of the Citizens, the Republic, in necessity of a strong Militia to maintain Order, protect the Citizens, and respond to Foreign Acts of Aggression, shall grant Citizens to Right to Voluntarily Enroll in Service to the Armed Forces of the Republic, and may decide on Enrolling to either the Army, Navy, Air Force, or Planetary Defence Forces at the Age of seventeen.
XXXII. In Respect to the Virtues of Democracy and Liberty, the Republic, in maintaining the Legacy of the United States of America, shall allow Citizens to be Democratically Elected to the positions of Government Officials, including the Offices of the Presidency and Vice Presidency, at the Age of twenty-one. Citizens may also be Elevated to the Office at the Age of seventeen if a two-thirds majority of Congress approves of the Candidate by their Reputation from the Citizens of the Republic.

Article IV.

Economic Rights of Citizens of the Republic:

The Republic, in order to evolve in improving the rights of the Citizens, may move from a capitalist to socialist economy, but shall retain these rights for Businesses and Citizens:

I. All businesses shall retain the right to operate within Republican territory, free from government intervention or control, so long as they operate within the confines of federal and local law.
II. Businesses shall retain the right to operate as they see fit.
III. All businesses may seek to gain profit however they please within law.
IV. The Government may not institute communism in any form. Socialism, as long as it's free-market, shall be instituted
V. Union membership or payment of union dues shall, not under any circumstance, be a requirement for employment.
VI. The nationalization and promise of free healthcare, education, housing, electricity, water, and public transportation.
VII. The right to use workplace democratic ideals as the base of businesses and corporations, as a means to further advance the goals of said businesses and corporations.

Article V.

Religion:

The Republic is a secular state, and wishes to avoid involving any mention of a specific religion within government. As such, this Constitution guarantees the rights to worship and not worship religion. With this, any attempts to force religion on citizens will be considered a violation of the Constitution.

Article VI.

The Flag, Sash, Motto, Emblem, and Protocols:

The Flag of the Republic shall be a rectangular-shaped flag in a two:three ratio. The flag shall consist of the flag of Texas, with fourteen stars surrounding the main star of the flag. For the Presidential Flag, the Flag shall consist of a navy blue field, and shall hold the fourteen star ring surrounding the main star.

The President shall also wear a Presidential Sash, consisting of the ring of stars in the Flag. The Sash shall be worn underneath the jacket that the President shall wear, and will be worn in all public appearances and addresses. The Sash shall be worn from the right shoulder and ending close to the left hip. The Sash shall be handed from the exiting President to the President-elect on Inauguration Day on January XX. The exiting President shall be given a Sash to wear for public addresses.

The Flag of the Republic

The Presidential Flag of the Republic

The National Motto shall be "Libero virtute dicemus vigere," which mean "By Virtue and Freedom, We shall Thrive."

The Emblem shall be a rectangular emblem, and it shall be designed in a similar fashion to the emblem of the Unified Democratic Council of the Republic. The Emblem shall contain a flag-like appearance, with a black and white coloration. The Emblem shall have a single, white, five-point star inside a field. The Emblem shall have three dividing lines, each corresponding to length, with the shortest bar at top, then increasing in length by descending order. The Emblem shall be placed on all documents and government-sanctioned fields.

For protocols involving the flag, it shall be lifted up the mast at dawn, and lowered at dusk. Once lowered, it shall be folded into a triangle and stored for later usage. The flag, can be violated by citizens in any given manner in protest or daily purposes, as guaranteed in Article III, Section I.

Article VII.

Species of the Republic:

Under Article VII, citizenship is also not limited to completely different species. Listed below are the species acknowledged as sapient citizens of the Republic:

Balaenoptera musculus: Blue whale
Megaptera novaeangliae: Humpback whale
Eschrichtius robustus: Gray whale
Tursiops truncatus: Common bottlenose dolphin
Stenella longirostris: Spinner dolphin
Delphinus delphis: Short-beaked common dolphin
Orcinus orca: Killer whale
Physeter macrocephalus: Sperm whale
Gorilla gorilla: Western gorilla
Gorilla beringei: Eastern gorilla
Pan troglodytes: Common chimpanzee
Pan paniscus: Bonobo
Pongo pygmaeus: Bornean orangutan
Pongo abelii: Sumatran orangutan
Lama glama: Llama
Vicugna pacos: Alpaca
Homo sapiens felis: Cat-human
Homo dominant: Dominants

These species were classified as being sentient after the MMCLXXVIII Advancement Exposition, where years of genetic modification allowed for the development of communication and sentience. Since then, attempts to kill any of the aforementioned species will result in imprisonment.

As of MMCLXXXII, this Constitution shall serve as supreme law for the Republic, with unanimous approval by the members of Congress. As of November V, MMCLXXXII, this Constitution shall be the start of our new Republic, and on January XX, MMCLXXXIII, the President shall be inaugurated, and shall henceforth complete the Constitution of the Republic.
