[GA][AGAINST] Repeal: Bail Conditions Arrangements
Our Vote recommendation: AGAINST
Proposal Overview:
The proposal seeks to repeal GA #688, a resolution to reform bail conditions by reducing reliance on cash bail. However, due to a mistake in the resolution, cash bail is made the primary option, contradicting its original intent. The repeal argues that this flaw undermines the entire resolution and calls for a more coherent approach to bail reform in the future.
Ministry Analysis:
While the Ministry applauds the author’s efforts to write this proposal, a repeal is not necessary. The bill itself is comprehensive, covering a lot of areas and is a guiding light for other bail and pre-trial related proposals. With the repeal being based on a single contradiction in clause 3, albeit contradicting the preamble, repealing such an important provision covering so much more than just how bail is paid because of one clause is faulty is not worth all the extra work. For these reasons, the Ministry recommends a vote AGAINST this proposal.
