Main Goal: The Establishment Of New Military Police Structure
REALIZING that our old military police structure was flawed,
UNDERSTANDING a fair and equitable need for an independent body of law for the military,
I, Emperor Conall Solis, officially enact THE INDEPENDENT MILITARY POLICING ACT and enforce it immediately with the following provisions.
SECTION I - ESTABLISHED JURISDICTION
ARTICLE I - The fair military policing authorities designated and established by the Minister Of Defense shall have such jurisdiction and purview as designated under this section.
ARTICLE II - The military police of the respective branch shall oversee all investigations of their soldiers.
ARTICLE III - Shall an investigation or suspected crime reach through multiple military jurisdictions, under this article, the military police authorities of the accepting branches shall coordinate and work together. The Defense Police Commission shall oversee all inter-military coordination.
ARTICLE IV - No military police authority shall investigate a civilian, unless they are a veteran, or unless prior written authorization of both the Minister Of Defense and the Minister Of Justice is provided and there's a competent jurisdictional reason, with the intent to be tried in a military tribunal.
ARTICLE V - The authorities of the military may assist in any law enforcement investigation as officially requested by the home agency.
ARTICLE VI - The Defense Police Commission shall have sole jurisdiction over military matters in the investigation of outside crimes, such as terrorism on national officials.
ARTICLE VII - The Defense Police Commission shall be designated as the regulatory agency over all matters of the branches respective police authorities, including to regulate, manage, and to assist.
ARTICLE VIII - The Defense Police Commission shall only investigate military crimes within branches as seen fit, or as requested by the branches respective police authority, but is mandated to investigate all MOD-related crimes including ones committed by civilians and contractors.
SECTION II - ESTABLISHMENT OF DPC
ARTICLE IX - This legislation shall officially establish the Defense Police Commission as an independent civilian-run law enforcement agency under the Ministry Of Defense with full domestic authority under the Foreign Intelligence Authorization Act.
ARTICLE X - The Defense Police Commission shall only have jurisdiction wherein defined under Section I.
ARTICLE XI - The Defense Police Commission shall regulate, manage, punish and provide for the good health of the various military policing authorities of the forces.
ARTICLE XII - The Commissioner of the Defense Police Commission shall be designated the head of the agency under this article, and shall not be a cabinet-level position in either Executive or Military.
SECTION III - AUTHORITY OF THE VARIOUS POLICING AGENCIES
ARTICLE XIII - The military police authorities of the forces may not enforce military law on civilians, unless exigent circumstances apply as defined by military law.
ARTICLE XIV - No military police authorities may modify or change military law, except for the DPC.
ARTICLE XV - Military police authorities may such investigate any crime internationally if it must do with a soldier under their purview.
ARTICLE XVI - Military police authorities may not investigate or prosecute their own, with the DPC or IEC having exclusive jurisdiction.
ARTICLE XVII - The DPC may not investigate their own people, with the IEC having exclusive jurisdiction.
ARTICLE XVIII - Should a crime occur with a soldier, even if a veteran, but it is of such a jurisdictional scale as outlined under Article VI, the military police authorities may coordinate with the DPC to investigate.
