Constitution of the Lower Kingdom

Preamble

    We, the people of the Lower Countries, to ensure safety, security, and harmony, do endorse and enshrine this constitution and establish the government of The Royal Dominion of The Lower Kingdom. We put full faith and loyalty to our Kingdom, our King and his House, and our Government, and will defend them and our region to the end. This constitution will stand as the foundational cornerstone of this great institution.

Article I - The King

  1. The King shall be the Supreme Sovereign and Head of State of The Lower Kingdom.

  2. The King shall hold the office of World Assembly Delegate of the region of The Lower Kingdom.

  3. The King, at such time that he must abdicate the throne due to any reason, or vacate the throne due to his nation in The Lower Kingdom leaving the region or ceasing to exist, shall first publicly announce his heir apparent.

    1. If the King does not announce his heir apparent prior to abdicating or vacating the throne, his successor shall be the most senior member of his House. If none exists, the most senior member of the Gentry shall become King.

  4. The King shall, by right of royal prerogative, shall hold immunity from prosecution in legal affairs.

Article II - The Gentry

  1. The Gentry shall consist of all resident nations of The Lower Kingdom who have joined the World Assembly and are presently endorsing the King.

    1. High Admiral of the Royal Armada shall be permitted to grant exceptions to World Assembly membership and endorsement requirements to active serving members of the Royal Armada.

Article III - The States-General

  1. The States-General as a body shall be vested with all legislative powers within The Lower Kingdom

  2. The States-General shall consist of seven seats, whose members are seated by the King following an election amongst Gentry on a quarterly basis.

    1. Elections to the States-General are decided by a ranked-choice, instant-runoff vote on a seat-by-seat basis, in seven separate races.

    2. Upon the establishment of the Government of The Lower Kingdom, membership in the States-General shall be available to all members of the Gentry. Upon such time that there are seven members of the States-General, the existing States-General shall deliberate to determine a schedule for the first elections and all elections thereafter.

      1. Regardless of any such schedule, voting for the States-General elections shall take place for a period of three days from the commencement of voting.

      2. Members of the Gentry may announce their candidacy for the States-General up to three days prior to the start of the election.

  3. Any member of the States-General shall be permitted to resign from their seat at any time. A special election held under the same parameters as the regular States-General elections, to begin within three days.

  4. The States-General shall, from its membership, elect a Prime Minister immediately following the seating of the Members of the States-General by the King.

    1. The Prime Minister shall be elected by a single, non-transferrable plurality vote, which shall be held three days from the seating of the States-General or the resignation or vacancy of the Prime Minister. The voting period shall last for three days or until all votes have been cast.

  5. The Prime Minister shall be responsible for the direction of all domestic and foreign directives, as defined by law. The Prime Minister shall be accountable to the States-General.

  6. The King must, at the advice of the States-General, provide his Royal Assent to any laws passed by the States-General.

Article IV - The Cabinet

  1. The Prime Minister shall be aided in his duties as the Head of Government by his Cabinet. Ministers in this Cabinet shall be appointed by the Prime Minister and confirmed by the States-General by a simple majority vote.

    1. Members of the Cabinet must be nations who maintain residency in The Lower Kingdom throughout their tenure in office.

  2. The Prime Minister shall be obliged to appoint a Minister of Foreign Affairs and the High Admiral of the Royal Armada to his Cabinet. Any additional Cabinet Ministers may be defined by the Prime Minister or by subsequent laws of the States-General.

Article V - The Court

  1. The Supreme Judicial Court shall exist to deliberate and pass judgment with regards to all legal disputes between members of The Lower Kingdom, and to review the constitutionality of laws passed by the States-General.

  2. The Supreme Judicial Court shall, at minimum, consist of one member who shall serve as the Chief Justice. Any other additional members of the court shall be Associate Justices.

    1. The Supreme Judicial Court shall always have an odd number of Justices.

  3. All Justices of the Supreme Judicial Court shall be nominated by the King, to be confirmed by the States-General by a simple majority vote.

  4. The Chief Justice shall serve, ex officio, as the Speaker of the States-General.

    1. The Speaker of the States-General shall serve as the parliamentarian for the States-General. The Speaker shall conduct and facilitate all votes of the States-General according to procedures established by the States-General, and shall conduct and facilitate all elections for the States-General according to procedures established by the States-General.

  5. The Chief Justice shall serve a term of six months from the date of their confirmation by the States-General.

Article VI - The Royal Armada

  1. The Lower Kingdom shall maintain the Royal Armada, the military fighting force of the region.

  2. The Commander-In-Chief of the Royal Armada shall be entitled the High Admiral of the Royal Armada, who is appointed by the King on advice of the Prime Minister and a subsequent simple majority vote by the States-General.

  3. The Royal Armada of The Lower Kingdom shall serve, first and foremost, the interests of the region and its foreign policy goals. It shall serve, secondly, the allies of The Lower Kingdom, also in accordance with its foreign policy goals.

Article VII - Amendments

  1. This document may be amended by a two-thirds majority vote of the States-General, and the subsequent assent of the King.
