General Assembly Resolution #50: "Repeal: 'Assembly Committees'"

G.A.R. #50
»Repeal: ›Assembly Committees‹«

Author: The Aug. Achipel, OCS OHY OIN

Sponsors: New sistonia, The Hon. Funky Goats, The Hon. Cymiopolis

Category: Domestic Affairs, Legal Affairs

Affects: High Court, GAR#36

Section I: Statement of Policy

  1. During the time since General Assembly Resolution #36 was enacted in May 2020, both General Assembly Committees, referred to hereinafter as just "Committees", have gone as far as enacting one single bylaw, which only affect the Committees themselves.

  2. The Secretariat has faced struggles to keep the Committee Chair positions filled since then; referring to the past Committee Chair elections in November 2020 in which only one candidate participated in each election and the currently prepared Committee Chair elections for January 2021 in which one of the Committees has again only one or even no candidate yet by the time of this resolution's writing.

    1. Regarding the Judiciary Committee Chair election in November 2020, it has become obvious that the declared and elected candidate Gividome had no intention to actively preside over said Committee, resulting in that nation's ceasing to exist during their term in office.

    2. Instead of replacing said nation in a snap election for the Judiciary Committee Chair, the Secretariat has made such efforts only recently and only regarding the regular Committee Chair elections scheduled for January 12 each year.

    3. Since the election of The kingdoms of austranisia as new Judiciary Committee Chair on January 15, the Judiciary Committee continues to show no signs of activity. The same goes for the Executive Compliance Committee, which has essentially been dormant since August 2020.

  3. Other measures to keep the Government in check seem to be preferred by the citizenry of the New West Indies, such as state cases 20-12 and 20-13 opened against the Secretariat of the New West Indies by Reno sheriffs department on grounds of Electoral Misconduct or the motions of no-confidence against former Presidents of the General Assembly.

  4. The amount of effort required to maintain the Committees has been significantly greater than the actual profit the region has gained from them since their creation.

Section II: Amendments to Previous Legislation

Article 2, Section II of General Assembly Resolution #46 is hereby amended to read the following:

If there is a case-specific recusal, the General Assembly shall elect an Acting Justice (via a simple majority) to serve the case. A candidate shall notify the Judiciary Committee President of the General Assembly of their candidacy. The Committee President of the General Assembly shall decide which candidate shall be considered by the General Assembly for the case. In case the President of the General Assembly is found to be in a conflict of interest, the Secretary-General shall decide on a candidate. If that nation is not elected by the General Assembly, then the process shall repeat until someone is elected or the case is dropped.

Section III: Repeal

  1. General Assembly Resolution #36 ("Assembly Committees") is hereby repealed and any Committee established by that it are consequently dissolved.
