Electoral Conduct Amendment (Mass Campaigning)

Overview


Purpose

The amendment seeks to cement the Supreme Court ruling on mass telegrams and to expand the same limitations to mass dispatches.

Implementation

The amendment shall be implemented immediately.

Existing Law


  1. Platforms utilised by a significant proportion of the region for communication purposes, including, but not limited to, NationStates and the regional Discord server, shall henceforth be known as regional platforms

  2. Individuals may not utilise any official powers they have on regional platforms to:

    1. Campaign for themselves or another candidate during an election with intent

    2. Campaign for or against a constitutional amendment up for discussion or referendum with intent

    3. Knowingly and purposely damage, or attempt to damage, any candidate's campaign as their sole intent

  3. A member of the election committee may not:

    1. Be a candidate running in the relevant election, unless absolutely necessary as dictated by the Constitution

    2. Share the details of the election results to any individual not part of the committee until after the relevant voting period has ended

    3. Reveal the vote of any individual at any time during or after the relevant voting period

    4. Use their position in the electoral committee, or knowledge of any private or classified information gained from serving in the said position, for malicious intent

    5. Intentionally misrepresent the true outcome of an election

    6. Maliciously tamper with votes

  4. An individual may not send a mass telegram to voters to campaign for or against any candidate during an election, or a constitutional amendment up for discussion or referendum

  5. Any violation(s) of these provisions shall be regarded as a criminal offence

    1. A mass telegram is defined as any telegram that uses a format which is either easy to individualize to a recipient nation or ambiguous towards what nations it is addressed to altogether, sent across any number of nations for the purpose of campaigning to them

    2. A mass dispatch is defined as any dispatch that directly tags any number of nations for the purpose of campaigning to them

  5. Any violation(s) of these provisions shall be regarded as a criminal offence
