Constitution Amendment (Chief Justice)

Overview


Purpose

The amendment seeks to create the position of Chief Justice in the Supreme Court, who will be given several administrative responsibilities.

Implementation

The amendment shall be implemented immediately.

Existing Law


Article V

  1. All judicial authority shall be vested in a tribunal, henceforth known as the Supreme Court

  2. The Supreme Court shall consist of three members, henceforth known as Justices, appointed by the Secretary

  3. The Justices shall be responsible for:

    1. Handling legal disputes between citizens

    2. Hosting court cases to settle criminal charges

    3. Voting on said criminal charges upon the conclusion of a fair and public hearing

    4. Being the highest authority on the interpretation of all regional law

  4. An appointment of a Justice must be confirmed with a two-thirds majority of electoral citizens in favour

  5. A Justice shall be prohibited from holding any other government portfolio during their tenure

  6. A Justice may be immediately removed through the following process:

    1. A motion shall be endorsed by two Members of the General Assembly or five percent of electoral citizens

    2. A majority of electoral citizens shall vote on whether to remove them in the following manner:

      1. World Assembly citizens shall be permitted to vote in a three-day poll

      2. Military Voting and Dual citizens shall be permitted to vote on the Regional Message Board in the same period

Article V

  3. The Justices shall be responsible for:

    1. Handling legal disputes between citizens

    5. Internally electing a Justice to serve as Chief Justice

  4. The Chief Justice shall be responsible for:

    1. Organising and leading discussions on criminal cases, lawsuits and court rulings with the Justices

    2. Communicating information of criminal cases, lawsuits and court rulings to the public

    3. Delegating their responsibilities to another Justice where deemed necessary or beneficial for the management of criminal cases, lawsuits, or court rulings

  5. An appointment of a Justice must be confirmed with a two-thirds majority of electoral citizens in favour

  6. A Justice shall be prohibited from holding any other government portfolio during their tenure
