Electoral Commission Transparency Act

Electoral Commission Transparency Bill - House of Commons

This House recognising the need for elected representatives to be accountable to the citizens of Enadia, and that citizens have the right to understand and be aware of the processes that govern the publication of election results enacts the following.

Article One - Publishing of Election Results

1a. The Electoral Commission of Enadia will publish graphical evidence harvested from the ballot process to demonstrate the percentage of the vote won by each candidate, in By-Elections that take place under the First Past the Post Electoral System.

1b. The Electoral Commission of Enadia will at a date determined by the Electoral Commissioner if they feel it is in the public interest, may release the turnout and ballot list (the names of electors) for By-Elections and Monarch of Enadia Elections held within Enadia. However, in the case of General Elections and Magistrate Elections, this will be considered unnecessary - due to the structure of said elections.

1c. Notwithstanding Article 1b. In the event, the result of a General Election is challenged the Electoral Commissioner may decide to fully publish the turnout from a General Election, however, due to the two acceptable models of said election Party List Proportional Representation and Single Transferable Vote - this will take the form of the total number of ballots cast only.

1d. The Electoral Commissioner of Enadia will be expected to publish or have requested the publication of results no later than twenty-four hours after they have certified the result. It is established in Act that the only other body permitted to distribute and publish election results in Enadia, is the Government of Enadia via the Prime Ministers Office; with the consent, and express permission of the Electoral Commissioner - the Office of the Prime Minister will not have access to the results before they have been certified by the Commissioner in any circumstances unless the Commissioner deems it appropriate. However, in this eventuality, the Commissioner must put this request in writing to the Attorney General of Enadia.

Article Two - Duty of the Electoral Commission

2a. The duty of the Electoral Commission of Enadia is to oversee the democratic process of electing citizens to public institutions and offices within Enadia. The Electoral Commission is expected to set the criteria for these elections and hold them as mandated by the House of Commons and the Constitution of Enadia.

2b. It is the express responsibility of the Prime Minister of Enadia to ensure the Commission and the Commissioner have performed their duty in an effective and efficient fashion embodying professionalism at all times in the exercise of their duty.
