The Constitution
of the Republic of Ascenthia


Section I: Sovereignty
  1. The Most Serene Republic of Ascenthia, additionally titled as The Republic of Ascenthia, The Ascenthian Republic, or Ascenthia, is hereby declared to be a sovereign social and political congregation united under the region "Ascenthia".

  2. The seat of government and center of operations on the NationStates site for Ascenthia shall be the region "Ascenthia".

  3. No foreign or domestic force may inflict upon the independence of Ascenthia, nor claim sovereignty over any bodies legally under the possession of Ascenthia.

Section II: Jurisdiction
  1. The government of Ascenthia shall have indisputable jurisdiction over the region of "Ascenthia".

  2. Any nations or regions on the NationStates site may be placed under the jurisdiction of Ascenthia by Act of Senate or Executive Directive.

    1. Any Executive Directive establishing control over a region or nation may be contested by a motion of Senate, which may be initiated by any Senator. If the motion achieves a two-thirds majority, the Executive Directive shall be struck null.

  3. The government of Ascenthia shall have indisputable legislative authority over the Official Ascenthian Discord Server (686012898295676931); however, all authority of ownership and adminship shall be derived exclusively from and by the authority of the Founder.

  4. The government of Ascenthia shall have indisputable jurisdiction over any servers that are managed and owned by an Ascenthian citizen that are primarily used for management and administration as part of the Ascenthian government.

    1. Servers declared as classified by someone with the authority to declare classification may exist without the consent or knowledge of the unauthorised members of the Ascenthian government.

  5. Any servers on discord may be placed under the jurisdiction of Ascenthia by Act of Senate.

    1. This may only occur if the individual in possession of the server consents to it.

Section III: Citizenship

Subsection I: Requirements

  1. Once all requirements have been met, an individual will automatically achieve status as a citizen of Ascenthia.

  2. For an individual to become a citizen, they must:

    1. Have a nation in the region Ascenthia or one of her dominions;

    2. Hold membership within the World Assembly;

    3. Endorse the incumbent Doge;

    4. Be a member of the Official Ascenthia Discord Server.

  3. Exceptions to the World Assembly and endorsement requirements are to be made if:

    1. The individual in question is verifiably banned from the World Assembly;

    2. The individual in question is verifiably using their World Assembly nation for a government-sanctioned operation.

    3. The individual in question is protected or accommodated by a treaty.

  4. The executive branch may revoke an individual's citizenship within twenty-four hours of it being granted.

    1. Citizenship may only be revoked if the individual has provably been in violation of NationStates site conduct rules in the past.

    2. Any execution of this power may be contested by a motion of Senate, which may be initiated by any Senator. If the motion achieves a one-half majority, the revokement shall be struck null.

    3. Any execution of this power may be reversed be challenged by the victim in question and overturned via trial by jury if they determine there isn't enough evidence to suggest a violation occurred.

Subsection II: Rights

  1. All citizens shall be guaranteed the right to speak freely, participate in the active criticism of the government, and express any views, within the bounds of reasonable discourse, except by manner of hate speech.

  2. All citizens shall be guaranteed the right to request a just and fair trial.

  3. All law-abiding citizens who have held citizenship for at least one week shall be guaranteed the right to vote freely and participate in all elections.

    1. Individuals who have not held citizenship for at least one week shall not be allowed to vote or participate in elections.

Section I: The Founder

Subsection I: Role

  1. The Founder is primarily responsible for maintaining order and stability within Ascenthia in situations of emergency.

Subsection II: Powers and Responsibilities

  1. The Founder shall have the power to pardon violators of the law.

    1. Any pardon may be contested by a motion of Senate citizenry, which may be initiated by any Senator citizen. If the motion achieves a two-thirds majority, among those present and voting, the pardon shall be struck null.

  2. The Founder shall have the power to grant exemptions to the citizenship requirements.

    1. Any exemption may be contested by a motion of Senate Collegio, which may be initiated by any Senator officer thereof. If the motion achieves a one-half majority, the exemption shall be struck null.

  3. The Founder shall be responsible for chairing and appointing the staff of the Commission of Ascenthian Elections.

Subsection III: Requirements and Selection

  1. For any individual to assume or hold the office of Founder they must be a citizen of Ascenthia.

  2. Laurennia shall be the Founder, unless in resignation, in which case the office of Founder shall go to his/her designated successor (and thus this clause shall be modified to reflect the new holder of the office).

Section II: The Commission for Ascenthian Elections

Subsection I: Role and Structure

  1. The Commission for Ascenthian Elections, additionally titled CAE, shall be the body responsible for the management and oversight of Ascenthian elections.

  2. The Commission for Ascenthian Elections is led by the Founder, also referred to as the Chairman of the Commission for Ascenthian Elections, or simply the Chairman of the Commission.

    1. An alternative Chairman of the Commission may be designated by the Founder and the consent of the populous.

  3. The Chairman of the Commission for Ascenthian Elections must have at least two Deputy Chairmen.

    1. The Deputies' primary job is to provide oversight to the Chairman so as to maintain the sanctity of electoral management, and to assist in the enforcement of the electoral regulations.

  4. The Chairman of the Commission for Ascenthian Elections may also, but shall not be obligated to, appoint additional staff members within the Commission.

  5. If the Chairman of the Commission is a member of the election, then the Deputy Chairmen shall oversee the election.

Subsection II: Requirements

  1. All members of the Commission for Ascenthian Elections must be citizens of Ascenthia.

Section III: The Doge

Subsection I: Role

  1. The Doge shall serve as the Speaker of the Senate and highest executive authority.

Subsection II: Responsibilities

  1. The Doge shall be responsible for presiding over the Senate.

    1. In the absence of the Doge, the Hand of the Doge shall be responsible for presiding over the Senate.

  2. The Doge shall hold the authority of the Consul in the absence of a Consul.

  3. The Doge shall be responsible for the appointment of the Head Inquisitor with the consent of the Senate Collegio and the populous citizenry.

  4. The Doge shall be responsible for appointing an interim Consul in the absence of a majority coalition or political party one.

Subsection III: Executive Powers

  1. The Doge shall have the power to veto any legislation passed by the Senate bills within forty-eight hours of passage.

    1. Legislation may only be vetoed before it takes effect.

    2. Any veto may be contested by a motion of the Senate citizenry, which may be initiated by any Senator citizen. If the motion achieves a two-thirds majority, among those present and voting, the veto shall be struck null.

    3. The Doge may contest any overturn of a veto by challenging it to a public vote. If the motion achieves a one-half majority public approval, the veto shall return to full effect.

  2. The Doge shall have the power to classify, declassify, or reclassify any information to any level.

  3. The Doge shall have the power to propose a declaration of war to the Senate.

    1. A proposal for declaration of war shall require a two-thirds majority to pass into effect.

Subsection IV: Requirements and Selection

  1. For any person to assume, hold, or run for the office of Doge, they must be a citizen of Ascenthia they must have been a citizen for a period of three consecutive months and a Senator for at least one..

  2. The Doge shall be elected every six months by manner of Single Transferable Vote.

  3. If the Doge resigns, the Hand of the Doge shall become Doge. If there is no Hand, an election shall be held.

  4. An incumbent Doge may not serve as a Senator or Inquisitor.

Section IV: The Consul

Subsection I: Role

  1. The Consul shall be the Head of Government of Ascenthia.

  2. The primary role of the Consul shall be as head of the Cabinet.

Subsection II: Responsibilities

  1. The Consul shall be responsible for the management of the executive branch in conjunction with any of their appointed Cabinet members.

Subsection III: Executive Powers

  1. The Consul shall have the power to create, dissolve, or edit any Ministries or Departments with the assent of the Doge.

    1. The Consul may freely delegate authority over anything within the realm of the executive branch to any position or body under his oversight.

    2. Any Executive Directives creating or dissolving any body under the executive branch or applying/removing power to/from any executive body may be contested by a motion of Senate, which may be initiated by any Senator. If the motion achieves a one-half majority, the Executive Directive shall be struck null.

  2. The Consul shall have the power to issue Executive Directives, also known as E.D.'s.

    1. The Consul shall be required to issue Executive Directives for all executions of their power over the executive branch.

    2. The Doge may override any Executive Directive.

  3. The Consul shall have the power to classify, declassify, or reclassify any information to any level with the assent of the Doge.

  4. The Consul shall have the power to propose a declaration of war to the Senate.

    1. A proposal for declaration of war shall require a one-half majority to pass into effect.

Subsection IV: Requirements and Selection

  1. For any person to assume, hold, or run for the office of Consul, they must be a citizen of Ascenthia.

  2. The Consul shall be elected at the beginning of each Senate by the majority coalition or political party in the Senate.

    1. In the case of resignation or removal, the majority coalition or political party will elect another Consul.

    2. The majority coalition or party may remove and replace the Consul at any time by majority consensus.

    3. In the case that the majority coalition or party cannot successfully elect a Consul, the Doge shall appoint the Consul with the consent of the Senate. If the Doge cannot find a suitable candidate for the office of Consul, s/he may call an election for the office of Consul, which shall operate by manner of First Past The Post.

  3. An incumbent Consul may not serve as an Inquisitor.

Section V: The Senate

Subsection I: Role and Structure

  1. The Senate shall be the body responsible for the creation of laws binding the structure, power, and responsibilities of government and civilian conduct within Ascenthia.

  2. The Senate shall consist of Senators.

    1. The Senate shall consist of at least eight Senators. The number of seats may be changed based on the population by the Commission of Ascenthian Elections, at their discretion.

  3. The Doge shall be the head of the Senate and will be responsible for its oversight.

Subsection II: Powers

  1. The Senate shall have all legislative authority vested in them.

  2. The Senate shall have the power to amend the Constitution by two-thirds majority.

  3. The Senate shall have the power to overturn Executive Directives establishing governmental control over a region or nation on NationStates.

  4. The Senate shall have the power to overturn a veto.

  5. The Senate shall have the power to overturn a pardon.

  6. The Senate shall have the power to overturn a citizenship exemption.

  7. The Senate shall have the power to approve or deny a treaty.

    1. Treaties may only be proposed by the executive.

    2. Treaties shall exist a level above common law and a level below the Constitution.

  8. The Senate shall have the power to vote out a sitting member of the executive branch via a vote of no-confidence.

    1. A vote of no-confidence shall require a two-thirds majority of the voting Senate.

    2. A motion for a vote of no-confidence may be initiated by any Senator.

  9. Laws that apply punishment to offenders of crimes listed in bills before they take effect, or laws that apply punishment without due process under the trial they are entitled to, are strictly prohibited from introduction and passage in the Senate.

Subsection IV: Requirements and Selection

  1. For any person to assume, run for, or hold office as a Senator, they must be a citizen of Ascenthia.

  2. The Senate shall be re-elected once a month by manner of the proportional apportioning of legislative seats based on the percentage of votes a given party receives; therefore, the respective parties shall bear absolute liberty in their possession of the seat except by power of removal, in which case only the judiciary may hold such ability, and only within the bounds of the law.

    1. Only registered parties may contest in the various elections; rules for registration exist at the discretion of the Commission for Ascenthian Elections.

  3. No Senator may hold or assume office as Doge during their tenure.

Section I: The Inquisition

Subsection I: Role and Strucutre

  1. The Inquisition shall be the highest authority on justice and enforcement in Ascenthia and the primary criminal authority and judicial body within the region.

  2. The Inquisition shall be headed by the Head Inquisitor and shall be composed of Inquisitors who will be appointed by the Head Inquisitor.

  3. The Head Inquisitor shall be appointed by the Doge and shall serve until removal or resignation.

    1. All appointments shall require two-thirds majority approval of the Senate and the majority consent of the populous to be approved.

Subsection II: Powers and Responsibilities

  1. The Inquisition shall be responsible for espionage, counterespionage, investigation of potential criminal activity, enforcement of the law, and the punishment of criminals.

  2. The Head inquisitor shall have the responsibility of presiding over all trials.

  3. All verdicts shall be issued solely by the Head Inquisitor with the advice of his/her Inquisitors, except if the verdict is challenged by the defendant, in which case a trial by jury shall occur.

    1. The jury shall be composed of at least five members and at the most nine, who shall be selected by the Founder from the citizenry.

    2. The jury shall be composed of ten members, who shall be selected randomly by the Founder from the citizenry.

    3. No citizen shall be forced to participate in the jury without consent.

  4. The Inquisition shall have the power to issue any punishments for criminal behaviour within the bounds of the law.

    1. The law must have been in effect at the time of the occurrence of the criminal behaviour being punished.

Subsection III: Requirements and Selection

  1. Nominee Head Inquisitors seeking confirmation must be first approved by the incumbent Doge before being required to be subject to a hearing in the Senate.

  2. All prospective and approved Head Inquisitors must consent to be subjected to a hearing chaired by the acting Doge with the presence of the rest of the Senate.

    1. During the hearing in the Senate, all acting members of the Senate are entitled to ask any questions relevant to the prospective Head Inquisitor's qualification and ability to serve as head of the Inquisition.

      1. Discretion as to what is and isnít relevant belongs to the Doge.

      2. The prospective Head Inquisitor is required to truthfully answer any and all inquiries forwarded by the Senate in this hearing.

  3. A Head Inquisitor may not serve as a Consul or Doge during their tenure.

Section I: Supremacy
  1. Following the ratification of the Constitution, no legal document may be considered higher.

    1. The Constitution may be ratified by the Founder of Ascenthia.

  2. All laws or regulations contradicting anything within this Constitution may be struck unconstitutional and thus null by public vote as challenged by any citizen.

Section II: Implementation
  1. Prior to the first elections, the region shall fall under the administration of the provisional government.

    1. The provisional government shall be headed by the Doge, an office which shall be occupied by the Founder or a citizen of their choice; the Doge shall have full authority over the executive for this time.

  2. The provisional government shall last until the conclusion of the first elections, the date of which shall be set at the discretion of the Founder.

Section III: Amendment
  1. Any articles, sections, subsections, clauses, subclauses, or parts may be amended or removed and any articles, sections, subsections, clauses, subclauses, and parts may be added by the Senate through the set amendment procedure.
