In the United States, a State (or Commonwealth, as nine States currently designate themselves as) is a constituent political entity, of which there are currently 99. Bound together in a political union, each state holds governmental jurisdiction over a separate and defined geographic territory where it shares its sovereignty with the federal government. Due to this shared sovereignty, Americans are citizens both of the federal republic and of the state in which they reside. State citizenship and residency are flexible, and no government approval is required to move between states, except for persons restricted by certain types of court orders (such as paroled convicts and children of divorced spouses who are sharing custody).
State governments are allocated power by the people (of each respective state) through their individual constitutions. All are grounded in republican principles, and each provides for a government, consisting of three branches, each with separate and independent powers: executive, legislative, and judicial.[4] States are divided into counties or county-equivalents, which may be assigned some local governmental authority but are not sovereign. County or county-equivalent structure varies widely by state, and states also create other local governments.
States, unlike U.S. territories, possess many powers and rights under the United States Constitution. States and their citizens are represented in the United States Congress, a bicameral legislature consisting of the Senate and the House of Representatives. Each state is also entitled to select a number of electors (equal to the total number of representatives and senators from that state) to vote in the Electoral College, the body that directly elects the president of the United States. Additionally, each state has the opportunity to ratify constitutional amendments, and, with the consent of Congress, two or more states may enter into interstate compacts with one another. The police power of each state is also recognized. Additionally, Senators are elected by the Legislative Body of the State.
Historically, the tasks of local law enforcement, public education, public health, intrastate commerce regulation, and local transportation and infrastructure, in addition to local, state, and federal elections, have generally been considered primarily state responsibilities, although all of these now have significant federal funding and regulation as well. Over time, the Constitution has been amended, and the interpretation and application of its provisions have changed. The general tendency has been toward centralization and incorporation, with the federal government playing a much larger role than it once did. There is a continuing debate over states' rights, which concerns the extent and nature of the states' powers and sovereignty in relation to the federal government and the rights of individuals.
The Constitution grants to Congress the authority to admit new states into the Union. Since the establishment of the United States in 1776 by Thirteen Colonies, the number of states has expanded from the original 13 to 99. Each new state has been admitted on an equal footing with the existing states. While the Constitution does not explicitly discuss the issue of whether states have the power to secede from the Union, shortly after the Civil War, the U.S. Supreme Court, in Texas v. White, held that a state cannot unilaterally do so.
As of 2289, the States founded on Earth are old only in name and heritage; as no living citizen has any memory of humanity's time on earth. Furthermore, the geographic and demographic composition of the States has evolved drastically since the Great Ascension. Beyond this, contemporary Amauritan society generally recognize the legacy of these particular States to be an important aspect of their heritage. This is not helped by the fact that the majority of the newer states lie within more recently settled regions. These post-Ascension states were founded from the settlers of multiple legacy states mixed together, and lack any history prior to interstellar colonization; creating a perception of these states as more dynamic as opposed to the States founded before the Ascension.
Despite no longer bearing any resemblance to modern state borders, the original shapes of some of the states are still often used in state iconography, notable examples including Texas, Flaurita, and Hawaii. Many western States often use their new borders to represent their state, discarding their former trapezoidal shapes. As it is generally much harder to form a cohesive shape out of interstellar territories, the old shape of the United States together as a whole is also often used in national iconography. Of note is the shape of the intact “contiguous 48” that existed prior to the First Scinfaxi War, which is the primary symbol of the Democratic-Republican Party. All this is part of an “Earth Nostalgia” style, which has gone in and out of vogue in the past few decades.
Originally, many settlers from the old states opted to land in areas that at least that presented conditions similar to their oold geography, and ultimately settle in those regions. Hawaii is a good example of this as Hawaii chose to colonize and control an expansive isolated volcanic island chain in the Greater Pacific Region, about five times larger than their archipelago on Earth and featuring over a dozen large islands. These islands were seeded with Hawaiian flora and fauna, and the people there carefully preserve old Hawaiian culture as best they can. The state houses a biodiverse array of flora and fauna, and remains top tourism destination within the League of Free Nations; serving as the sole sanctuary for a wide assortment of endemic Hawaiian species. Bouricua, Guanahana, and Panama all chose their location similarly as well, controlling a chain of tropical islands with a combined size approximately the size of Antarctica from Old Earth, containing many local species native to their respective regions. As some of the last regions to be overrun by the Scinfaxi these island states were able to preserve a greater number of native species when compared to the States in the Contagious United States, which suffered significantly more ecological destruction during the Scinfaxi War.
State Governments
Under U.S. constitutional law, the 99 individual states and the United States as a whole are each sovereign jurisdictions. The states are not administrative divisions of the country; the Tenth Amendment to the United States Constitution allows states to exercise all powers of government not delegated explicitly to the federal government. Consequently, each of the 99 states reserves the right to organize its individual government in any way (within the broad parameters set by the U.S. Constitution and the Republican Guarantee enforced by Congress) deemed appropriate by its people, and to exercise all powers of government not delegated to the federal government by the Constitution.
A state, unlike the federal government, has un-enumerated police power, that is the right to generally make all necessary laws for the welfare of its people. As a result, while the governments of the various states share many similar features, they often vary greatly with regard to form and substance. No two state governments are identical. Many States have modeled State Governments based on the current Federal model, utilizing a Dual-Executive System with a bicameral legislature.
