CONFEDERATION OF CORRUPT DICTATORS
The purpose of the Copyright and Licensing Act is to fully protect any work that an artist creates. This will be the first of its kind within the Government of the Confederation. The act will be the foundation of the unique production of work for the Confederation to give artists assurance that their work will not be illegally used. The act also sets out the rights of the commissioner, which when nations take advantage of, can boost the economy of the Confederation.
Works are defined as any works that are created for the Confederation. Work examples are Music, Literature, and Art.
The use of a work is the distribution, commercialization, or derivation of the work as defined by IV and V. It does not include selling the work.
The Director is as defined by the Imperial Senate Act: Section VI, Article v, Sub-Article c
The artist is the nation that created the work unless further specified by an individual's name from the nation. They may be also known as the original author. If multiple nations collaborated on work, they are all considered artists.
The commissioner is defined as the individual or nation that pays for an artist to create a work.
A work being commissioned is defined as the commissioner transferring money for a work to be created.
i. The artist must fully disclose what level of copyright the work has. It must be decided for any and all works.
ii. The artist and Director may change the copyright level of the work upon mutual agreement.
iii. The Director is exempted from the levels of copyright and the legal action they bring, to only publish the work in a document of all works created and distribute it to the location it needs.
iv. The artist holds a non-exclusive license for the work they create and is exempted from all the levels of copyright and legal action they bring.
v. All use of a work must clearly disclose the level of copyright the original work had and give full credit to the artist, either by the individual's name or nation.
vi. Level 1 Copyright states that any nation from any region may use the work.
vii. Level 2 Copyright states that only nations of the Confederation of Corrupt Dictators and any nation from regions with established embassies to the Confederation may use the work.
viii. Level 3 Copyright states that only nations of the CCD may use the work.
ix. Level 4 Copyright states that only nations that hold a government position and the Imperial Council may use the work.
x. Level 5 Copyright states that only nations that hold a seat on the Imperial Council may use the work.
i. Distribution of the work includes but not limited to sharing via telegrams, factbooks/dispatches, regional message boards, NationStates forum, e-mail, instant messengers, other third-party platforms.
ii. Pertaining Level 1 copyright, any nation from any region may freely distribute the work.
iii. Pertaining Level 2 copyright, any nation from the CCD or embassies of the CCD may distribute the work. The work must only be distributed within the CCD and the CCD embassies.
iv. Pertaining Level 3 copyright, any nation of the CCD can distribute the work. The work must only be distributed within the CCD.
v. Pertaining Level 4 copyright, any members of the government or IC may distribute the work. The work must not be distributed by any other nation.
vi. Pertaining Level 5 copyright, any nation that holds a seat on the IC may distribute the work. The work must not be distributed by any other nation.
i. Commercial use of work includes the use of the work in promoting a service or an idea.
ii. Derivative use of work includes the use of a work's aspects to create a new version.
iii. Only the original author of a work and nations that are members of the Government may use the work commercially.
iv. The original author of a work and any member of the CCD only may use a work in a derivative way, but become secondary authors when derivating work and not artists.
v. Secondary Authors only have a non-exclusive license if it is granted by the original author.
v. All distribution of a derivation work retains the original copyright level.
vi. Within NationStates, only the artist and the Imperial Council may sell a work.
vii. Selling of work within NationStates transfers the non-exclusive license from the seller to the buyer.
viii. Outside of NationStates, only the artist is permitted to sell the work.
i. The following articles do not apply when a work has been commissioned:
a. III.iv - Only the commissioner holds a non-exclusive license.
b. V.iii - Only the commissioner can use the work commercially, but may grant permission to others.
c. V.v - Only the commissioner can grant a non-exclusive license to secondary authors
d. V.vi - The artist cannot sell the commissioned work.
