University of The Land of Kings and Emperors Act (2019)



An Act to cement the University of The Land of Kings and Emperors as a legal, statutory body with an organization that ensures its continuation and activity in service to the Electors of the Land of Kings and Emperors.

BE IT ENACTED by the Emperor's most Supreme Majesty, by and with the advice and consent of the Commons and the Nobles, in concordance with the Constitution, in this Estates General assembled, as follows;

Short Title

(1) This Act may be cited as the University of the Land of Kings and Emperors Act (2019).

Definitions, Establishment, and Functions

(1) There is hereby established as a statutory body, the University of the Land of Kings and Emperors herein referred to as "the University".

(2) The University shall be a legal entity with perpetual succession and a common seal and may contract or be contracted in its corporate name or sue or be sued in its corporate name.

(3) The functions of the University shall be to:

a. provide instruction, conduct research and disseminate knowledge of a standard required and expected of a University;
b. confer degrees and grant diplomas, certificates and other awards and honours as are usually conferred by similar institutions;
c. safeguard information appertaining to the history of the Land of Kings and Emperors.

Provisions

I. Governance

(1) Two officer positions shall be established and empowered by this Act for the management of the University: the Chancellor and Vice-Chancellor. All authority of the University shall be vested in the two and they shall exercise the powers of the University directly or indirectly through the faculty and staff of the University.

(2) The Chancellor and Vice-Chancellor shall have the authority to exercise their powers vested in this document to promote the interests of the University.

(3) Either officer shall automatically lose his office by:

a. loss of citizenship
b. expiration of a term of service and replacement by a successor
c. removal by proper authority, enumerated below.

II. Chancellor

(4) The Chancellor shall be the executive head of the University and shall serve as the University’s chief representative in the Region.

(5) The duties and responsibilities of the Chancellor shall be to:

a. formulate the policies of the University and to ensure they are implemented;
b. establish such number of faculties, schools, and departments of the University as is deemed necessary or expedient;
c. appoint and exercise control over the academic faculty and staff, including discipline;
d. appoint and oversee the Vice-Chancellor of the University;
e. determine the programmes and courses of study, in conjunction with academic faculty and staff, to be pursued at the University and admission standards;
f. promote or demote any officer of the University;
g. grant and revoke certification, awards, and honours bestowed in the name of the University;
i. establish and keep a coat of arms and seal of the University;
j. sit as an ex-officio member on any committee created by the University

(6) The Chancellor shall be appointed by the Emperor to serve a term of four (4) months. There shall be no limit as to the number of terms any Elector may serve as Chancellor of the University.

(7) At any point in a Chancellor’s term, the Estates General may vote to remove the Chancellor by a two-thirds majority vote in both chambers in favor of removal. Success of such removal will require the Emperor to appoint a successor to finish the remainder of the current term and the appointed replacement is available for subsequent appointment.

III. Vice Chancellor

(8) The Vice Chancellor shall be the second-in-command of the University.

(9) The duties and responsibilities of the Vice Chancellor shall be to:

a. control and superintend the property of the University;
b. recommend to the Chancellor competent individuals to form part of the academic faculty and staff;
c. recommend policies to the Chancellor to advance the work of the University;
d. approve and oversee activities of Student Organizations;
e. work with leaders of Student Organizations;
f. sit as an ex-officio member on any committee created by the University;
g. perform any other function as may from time to time be assigned to him or her by the Chancellor.

(10) The Vice Chancellor shall be accountable to the Chancellor and shall serve at the Chancellor’s pleasure. Nothing in this Act shall prevent the Vice-Chancellor from being a member of the academic staff and faculty.

(11) The Office of Vice Chancellor may be declared vacant when:

a. the Chancellor removes the Vice Chancellor, with due notice;
b. the Vice Chancellor submits their resignation to the Chancellor.

IV. Operation

(12) The Government and Administration Team shall be responsible to ensure that the University has an area that is visible and accessible to all citizens and any class of persons as permitted by the Chancellor. The property of the University shall be deemed to be private and the University shall govern its property as deemed necessary and proper.

(13) It shall be duty of the Government to advise and aid the University in the general direction of the University’s mission and functions.

(14) The University shall have the authority to establish and implement regulation as to its internal procedures.

(15) All laws and resolutions that speak to the University of the Land of Kings and Emperors shall be repealed.

(16) Any student or faculty member may create a Student Organization under the University, subject to the supervision of this Act.

(17) The University shall be housed as a Sub-Forum under Onderford.

Schedule

(18) Upon Passage and codification as Law, this Act will have immediate effect.

(19) The first term of Chancellor shall formally begin on the 1st of September, 2019; however the Emperor shall appoint a Chancellor to begin service prior to that date, with such additional length not affecting the beginning of the term.
