(The Constitution of the Empire of Hartfelden)

A fundamental act to reconstitute Hartfelden under one fundamental law

Section I. Empire

Article 1. Form of Government
Hartfelden is hereby defined as a constitutional imperial monarchy, ruled by the Kaiser.

Article 2. Empire
The Empire is legally defined as all territories that live under the name of the Empire of Hartfelden and which the Kaiser has direct control over the founding nation.

Article 3. Territory
Territory of the Empire shall consist of all regions that have sworn fealty to the Kaiser and have been approved by the Kaiser to be added to the Empire.

Article 4. Power of Territories
Territories shall have the right to exercise all Powers, as defined within this Constitution, within their territory and the right to exercise jurisdiction in all matters except for those reserved for the Empire.

Article 5. Supremacy of Imperial Law
Imperial Law shall be superior and take precedence over all state laws. No state law may conflict with an Imperial Law, or it will otherwise be, to the extent of the conflict, of no force and effect.

Article 6. Matters of the Empire
The Empire shall have exclusive jurisdiction over any matter involving Foreign Relations as well as the matters of War and Defense.

Section II. Kaiser

Article 1. Imperial Authority
The Kaiser shall be the Head of State and shall hold all Imperial Authority, which is defined as the ability to create Imperial Decrees. The Kaiser shall have control of all root admin and founding accounts. The Kaiser shall hold any powers not reserved or expressly stated within this Constitution.

Article 2. Imperial Style
The Kaiser's full style shall be the following: “His Imperial and Royal Majesty, Kaiser of Hartfelden, King of Tannborn and Kronenberg, Duke of Ansrau, Helmfurt, and Fuerstenwell, Margrave of Osterhausen and Delmenfingen and Lord of Huegelstatt”
The Kaiser's shortened style shall be: “His Imperial Majesty, Kaiser of Hartfelden”

Article 3. Commander-in-Chief
The Kaiser is the Commander-in-Chief of any and all official Armed Forces created within the Empire.

Article 4. Pardons and Mitigation
The Kaiser shall have the right and ability to pardon and mitigate all punishments.

Article 5. Orders and Distinctions
The Kaiser shall have the sole right to confer Imperial Orders and Distinctions, as described by law.

Article 6. Imperial Positions
The Kaiser shall hold the power to create any Imperial Office of which the Kaiser shall define their duties.

Article 7. Imperial Assent
The Kaiser shall have the right to either assent with their signature or veto laws passed by the Reichsversammlung.

Article 8. Imperial Decrees
The Kaiser shall have the right to create Imperial Decrees, which shall bear the force of law and shall be superior and take precedence over all other laws.

Article 8. War
The Kaiser shall have the ability to declare war as well as negotiate peace treaties.

Article 9. Imperial Oath of Office
The Kaiser shall state the following oath before they may be granted their full authority:
“I, [NAME], swear to the peoples of Hartfelden that I shall observe and uphold the Constitution and all Laws of the Empire. I swear that I shall defend and preserve, with all my power, the independence and territory of Empire and that I shall protect the freedom and the rights of all Hartfeldeners.”

Section III. Regierung

Article 1. Executive Functions
The Regrierung, hereby referred to as "the Imperial Government", shall exercise Executive Power in the name of His Imperial Majesty, which is defined as the ability to create Ministries which run civil services for the Empire.

Article 2. Government Composition
The Imperial Government shall consist of the Kanzler and their appointed ministers.

Article 3. Kanzler
The Kanzler shall be elected by the Reichstag for a term of 90 days.

Article 4. Executive Oath of Office
The Kanzler and Ministers shall swear the following oath of office:
“I, [NAME], hereby swear to faithfully serve the Kaiser and the Empire and her People. I swear that I shall defend the Empire from foreign and domestic foes, and to not neglect my duties as [Minister/Kanzler].”

Section IV. Reichsversammlung
Article 1. Legislative Functions
The Reichsversammlung, hereby referred to as "the Imperial Legislature", shall exercise Legislative Power in the name of His Imperial Majesty, which is defined as the ability to create, amend and repeal laws and treaties.

Article 2. Legislative Composition
The Imperial Legislature shall consist of the Reichssenat and the Reichstag. All laws start in the Reichstag and then go to the Reichssenat upon being passed by the Reichstag.

Article 3. Reichssenat
The Reichssenat shall be the Upper House of the Imperial Legislature. It shall contain a number of seats as determined by law. The Reichssenat shall be elected by the Reichstag. The Reichssenat shall have the power to scrutinise laws passed by the Reichstag, as prescribed by law. Members of the Reichssenat shall be styled as Senators.

Article 4. Reichstag
The Reichstag shall be the Lower House of the Imperial Legislature It shall contain all citizens unless otherwise determined by law or court order. The Reichstag shall have the power to create laws subject to the scrutiny of the Reichssenat. Members of the Reichstag shall be styled as Reichstagsabgeordneters.

Article 5. Impeachment
The Reichstag holds the power to impeach and remove from office any Senatoren by a two-thirds supermajority. The Reichssenat holds the power to impeach and remove from office any member of the Regriung by a two-thirds supermajority.

Article 6. Amendments and Laws
All laws shall require a majority from those who voted from both Houses to pass as well as Imperial Assent to become law.

Article 7. Procedures
Each House may enact, amend and repeal Procedures for their internal governance, requiring only a majority vote of the respective house. Procedures shall be further prescribed by law.

Article 8. Presiding Officer
The Reichstag and the Reichssenat shall each have a presiding officer – who shall use the title Präsident of their respective house. The Präsident shall open and close debates and voting for all laws.

Article 9. Oaths of Office
The members of the Reichssenat shall swear the following oath to take office;
“I, [NAME], do hereby swear to fulfill my duties in Reichssenat, and to serve the Kaiser and the Empire, and to serve the People of my Empire”

Section V. Gerichtshof

Article 1. Judicial Power
The Gerichtshof shall exercise Judicial Power in the name of His Imperial Majesty, which is defined as the power to possess jurisdiction over all matters relating to Hartfelden law.

Article 2. Judicial Composition
The Gerichtshof shall consist of one Richter to rule on all criminal cases as well as the constitutionality of laws and orders. The Richter shall be appointed by the Kaiser.

Article 3. Oath of Office
“I, [NAME], do hereby swear to faithfully and fully serve the Kaiser and the Empire and to serve the People of the Empire. I swear to fulfill my duties to their full extent and to uphold the constitution and laws of the Empire.”

Section VI. General Provisions

Article 1. Constitutional Documents
The Constitutional Documents of Hartfelden shall be composed of this Constitution, and any other Act so declared by a two-thirds supermajority of each House of the Reichsversammlung and given Imperial Assent.

Article 2. Constitutional Supremacy
The Constitutional Documents are the supreme law of Hartfelden, and any law inconsistent with the provisions of the Constitutional Documents is, to the extent of the inconsistency, of no force and effect.

Article 3. Amendments to the Constitutional Documents
All amendments to the the Constitutional Documents of Hartfelden shall require a two-thirds supermajority vote of both Houses as well as Imperial Assent. The Constitutional Documents may also be modifed by Imperial Decree.

Article 4. Gendered Terms
All terms in this Constitution which have a gender, such as Kaiser and His Imperial Majesty, shall also be able to be held by any gender and may use the alternate form, such as Kaiserin and Her Imperial Majesty.

Article 5. Citizenship
The Citizens shall be residents of the Empire given citizenship by the Kaiser or Executive Staff with proper authority to do so. All Citizens shall be required to swear the following Oath of Fealty:
“I, [NAME], do solemnly swear that I shall be faithful and bear true allegiance to His Majesty Kaiser Friedrich I, and to His Heirs and Successors, and that I shall faithfully obey the constitution of Hartfelden and her laws as well as fulfill my duties as a citizen.”

Section VII. Temporary Provisions

Article 1. Existing Citizens
All existing citizens shall stay citizens under the new constitution and shall be given 72 hours to swear the Oath of Fealty as defined in this constitution or otherwise they shall be removed as citizens.
