Aeterna Publicae Constitution

Constitution of the Aeterna Publicae

Article 1: Preamble

On this fateful day, us nations who number few set forth within this region to commit to a sacred ideal. Dedicated and driven by the principles of liberty enshrined in creationhood, and committed to the desire to ensure security and prosperity to the all who enter our borders, ignoring any previous creed or allegiance. We are brought forth to cherish these these ideals that all nations created within this site are endowed by forces greater than them the right of: Security, Liberty, and Autonomy. We hold sacred now and forever that those most who need protection deserve such protection.


Article 2: Bill of Rights

Amendment 1: Right of Autonomy

All who reside within Aeterna Publicae will have their nation, work, and ideas protected and held sacred by the region. This includes right to freedom of speech, freedom of opinion, freedom of lawful protest, freedom of movement, and freedom of allegiance.

Amendment 2: Right of Residency

All who reside within Aeterna Publicae will be seen as a resident until given citizenship.
All residents will have their rights of speech and opinion respected as well as no action will be taken to violate or hinder their right of allegiance and movement.

Amendment 3: Right of Citizenship

All who are citizens within the Aeterna Publicae will have their person respected and their rights maintained. Citizens will hold responsibilities not limited to:
Right of Petition
Right of Protection
Right of Protest
Right of Union and Assembly
Right of Fair and Unbiased Trial
Presumption of Innocence
Right to form Caucus

A citizen of the Aeterna Publicae will be determined as:
Any nation who has resided within the region of Aeterna Publicae for 12 days.
Any nation who has Endorsed the Founder and F.A.E.

Amendment 4: Right of Trial

All who are citizens of the Aeterna Publicae will be given the right to a speedy and fair trial.
The right of innocence will always be maintained to those tried.
Any and all evidence will be made available to the court to conduct a fair and unbiased trial of the accused.

Amendment 5: Right of Ejection

If at any time a nation is to be ejected and/or banned from the borders of the Aeterna Publicae, said nation holds the right to be informed of what action caused their ejection. The power of Ejection and Banning are to be held in the highest offices of the Founder, F.A.E, High General, and Council of the Masses, and only exercised with consent from the Council of Masses, unless said action must be *swift and immediate. Than that action will be handled by the Founder or F.A.E.

*Swift and Immediate will pertain to actions such as:
Extreme Spamming
Regional Defense (Invasion)
A banned or ejected nation is found to be hiding(puppet)

Amendment 6: Right of Protest

All citizens within the Aeterna Publicae shall forever hold the right to fair and peaceful protest. A protest will be defined such: “Any action that seek to exercise disapproval or discontent ”.
The right of protest shall be held highly within the government so long as the right of protest is not used to support any treasonous or subversive goal that may destabilize the Eternal Republic.

All protest have the Right to Petition the Government.
A protest consisting of 5 or more Nations may form a “Caucus”*
Any protest that last longer than 12hrs will be and shall be addressed by the Government and Founder.
The Right of Protest shall not best used as evidence in of itself to try and/or convict an offending Nation.

Amendment 7: Right of Movement

All citizens and residents within the Aeterna Publicae shall have their right of movement to and from the region respected. No action shall be taken or imposed to hinder the freedom of movement of any nation that comes within the Aeterna Publicae.


Article 3: Powers of the Founder and F.A.E.

The power of the Founder and F.A.E. are to be enshrined from the constitution to serve as the dual-heads of the Aeterna Publicae. The F.A.E will stand to mean “First Among Equals” to symbolize their position as the First Speaker.

The Founder and F.A.E will hold the power of ejection, banishment, and un-banishment.
The duties of both positions will be to ensure the security and prosperity of the Aeternal name within and outside the region. This includes but is not limited to directing or aiding with foreign and domestic policy.
The position of the Founder will be permanent and enshrined to the first nation to found the Aeterna Publicae
The position of “F.A.E.” will be heredical with a successor to be chosen at the F.A.E. request.

The selection of the F.A.E by a respective F.A.E will serve as the basis of the
“Aeternal Line”
This selection will be respected and undisturbed unless challenged by the Council of Masses and agreed upon by the Founder
If a selection is found to be corrupt or the selectee found to be inept, than it will the duty of the Council of Masses to elect a new F.A.E.
This challenge to the Aeternal Line will go unheard unless said challenge has been approved unanimously by a Council.
If the a new heir is selected to be F.A.E their line will be treated anew

The F.A.E. are to hold meetings with the Council of the Masses at regular intervals to discuss matters of regional stability, security, policies, and relations.
The Founder and Igemónas though prestigious in their position will to be held accountable to any action or decision that proves to be at the benefit or detriment of the region.
If any position is to fail within their duties they are to be exercised to the fullest extent of the law with their rights preserved by the constitution and their right to a speedy and fair trial respected.
Should the Founder become CTE or missing for an extended length of time their responsibilities are to be passed to the F.A.E.

The Powers of the Founder shall include:

Symbolic Head of the Region
Power of Banishment, Un-banishment, and Ejection.
Power to Establish Interregional Relations
Power of Shared-Authority over the Defense Forces
Powers of Emergency*
Shared Policy making abilities with the F.A.E. and Council

Should both the Founder and F.A.E both become absent from their positions or proven too inept or detrimental for their role it is up to the Council of Masses to appoint a new successor to lead the region.


Article 4: Powers of the Council of Masses

The Council of Masses will serve as a collection of citizens within the region, convened to help in the day to day governing and running of the region.

The CoM is to run as a collection of citizens with a legislature elected to represent any and all citizens within the region.
A collection of 5 or more citizens convened together may form a temporary party termed a “Caucus”
A Caucus shall serve as a temporary or permanent collection of Nations representing a shared goal of political change through direct representation.
Legislatures will represent the region by acting as a semi-permanent body to create, review, and revise public policy and law.
Legislatures shall be elected on a basis of every 6 months.
Each nation may serve as Legislature for 4 terms.
The head of a Legislature will be tallied for the heads of every 2 citizens.
A collection of Legislatures will form a Council
A Council will convene to act as one coordinated unit to create and revise regional policy
Any law must first be drafted as a bill.
A bill will serve as a proposed idea and/or action to be discussed
A bill will be discussed by the elected Council for a period of no less than 12hrs
If agreed upon by ⅔ of the majority the bill will be brought to the Founder and F.A.E to undergo Secondary Review
If both the Founder and F.A.E agree to the bill it will be passed to law

Article 5: High Court
Section 1: Composure of the High Court
1.1 The High Court shall consist of one High Elder who will be appointed by the and approved by the Council with a 2/3 majority vote and will serve a two month term.
1.2 The Council will have the right and authority to remove a High Court Justice for inappropriate conduct with a 2/3 majority vote.
1.3: The High Court shall also contain a Succedaneum Elder who will be appointed by the Chief Justice.

Section 2: The High Elder
2.1 The High Elder shall be the head Elder of the Courts and will be responsible for the High Court.
2.2 The High Elder will have the power to organize the court how he sees fit within the boundaries of the law.
2.3 The High Elder will preside over all cases involving regional security, crimes or felonies.

Section 3: Powers of the High Court

3.1 All jurisdictional power is granted to the High Court, and is the highest court in the region.
3.2 The High Elder of the High Court have the responsibility of upholding the Constitution and Laws of Aeterna Publicae and will rule over all criminal and civil cases.
3.3 The High Court shall evaluate laws passed by The Regional Assembly to validate its constitutionality.
3.4 The High Court is empowered to interpret the constitution and laws in accordance with circumstance, be it loosely or strictly.
3.5 The High Court shall rule over issues that do not fall under the executive or legislative branches of government.
Section 4: Limits of the High Court
4.1 No Justice of the High Court may hold any other government position
4.2 The High Court must follow the laws and constitution of Aeterna Publicae and must base their verdicts on the laws and constitution of Aeterna Publicae.

Section 5: Trial by Jury
5.1 The jury shall be made up of legal citizens.
5.2 The trial shall take place in the High Court of the forums.
5.3 After hearing any and all sides of the story concerning whatever the incident, the jury shall discuss the incident and vote.
5.4 The High Elder has the final say in any case, choosing the verdict, unless the Jury unanimously decides upon a verdict.

Section 6: The Powers of the Succedaneum Elder

6.1: The Succedaneum Elder will serve under the Chief Justice and the Constitution of Aeterna Publicae.
6.2: The Succedaneum Elder will be given the power to fill in for the Chief Justice if he/she is not present at the time of a case or problem.
6.3: The Succedaneum Elder will help in the organization and execution of formal cases when the Chief Justice is present including the building of a Jury.


Article 5: Defense of the Aeterna Publicae
Composition:
The Defense Forces of the Aeterna Publicae shall serve as a force from the collection of volunteer Nations within the region.
The Defense of the Region will however be the responsibility of every citizen within the Region.
It will be the duty of all Citizen Nations to respond with haste and action for the defense of the region against invasion.
The acting heads of the Defense Forces enshrined by the constitution and Region will be the Founder and F.A.E.
However the elected High-General will coordinate and organize the long-term and day-to-day operations of the Defense Forces
In times of shutdown or governmental collapse the ADF will be mobilized to protect the border of the region from possible invasion.

Organization:
It will be left to the duty of the acting High General to ensure the ADF operates and exist with discipline, self-efficiency, and is most importantly motivated.
It is left to the duty of the Founder and F.A.E to elect a capable High General to fulfill and exceed such standards
The Defense Forces are to be organized with succession in ranks to be made meritocratic with emphasis to be placed on competency, experience, vigor, and ingenuity.
In wartime the Defense Forces will act as the first and last line of the region and will be tasked with ensuring the safety, security, and independence of the region and her citizens.
In peacetime the Defense Forces will be placed on reserve but will be required to maintain basic training.
