Alvarian Constitution

Preamble

The end of the institution, maintenance, and administration of government, is to secure the existence of the body politic, to protect it, and to furnish the individuals who compose it with the power of enjoying in safety and tranquility their natural rights, and the blessings of life: and whenever these great objects are not obtained, the people have a right to alter the government, and to take measures necessary for their safety, prosperity and happiness.

The body politic is formed by a voluntary association of individuals: it is a social compact, by which the whole people covenants with each citizen, and each citizen with the whole people, that all shall be governed by certain laws for the common good. It is the duty of the people, therefore, in framing a constitution of government, to provide for an equitable mode of making laws, as well as for an impartial interpretation, and a faithful execution of them; that every man may, at all times, find his security in them.

We, therefore, the people of Alvaria, acknowledging, with grateful hearts, the goodness of the great Legislator of the universe, in affording us, in the course of His providence, an opportunity, deliberately and peaceably, without fraud, violence or surprise, of entering into an original, explicit, and solemn compact with each other; and of forming a new constitution of civil government, for ourselves and posterity; and devoutly imploring His direction in so interesting a design, do agree upon, ordain and establish the following Declaration of Rights, and Frame of Government, as the Constitution of Alvaria.

Date of Presidential Assent

This Constitution will be the governing document of Alvaria after being approved by the people of Alvaria and by the Parliament of Alvaria by two-thirds majority. This Constitution shall come into effect on the date of Presidential Assent.

Chapter I: Definitions

The following are defined as government roles

1.Civil office means any staff role.

2.High government office means the President, Vice President, Prime Minister and Deputy Prime Minister.

3.Government office means Minister or any other head or deputy of a Ministry or Department.

4.A member of Parliament.

5.Judicial office means any Judge or other judicial role.

A vote of no-confidence is the vote needed to remove an elected official. It requires a two-thirds majority vote by Parliament to be successful.

The Founder is the person who holds the Founder account on NationStates. Where possible, this person should also be the owner of the Discord server and any other associated platforms.

Chapter II: Citizenship

1.Citizenship Process

For an individual to become a citizen, they must:

1.Have a nation in the region Alvaria or one of her dominions;

2.Hold membership within the World Assembly;

3.Have a World Assembly nation within or outside Alvaria;

4.Be a member of the Official Alvarian Discord.

2.Exemptions

Exemptions may be made by the President, Prime Minister, Minister of Domestic Affairs, and any relevant persons in the Ministry of Domestic Affairs who have been given power on this matter

3.Jurisdiction of the courts

The Supreme Court shall be able to overturn any exemptions if the person exempted is guilty of any relevant crime.

4.Powers of Parliament

Parliament has the power to overturn any exemptions by a simple majority.

Chapter III: Sovereignty

1.Sovereignty

Alvaria, herein referred to as the Republic of Alvaria, shall be the sovereign congregation of nations on the site NationStates within the region Alvaria.

1.The regionís sovereignty shall extend to all territories and possessions legally annexed by the government of Alvaria.

2.No region nor nation nor body may infringe on the sovereignty of Alvaria.

3.The Parliament of Alvaria shall have the sole power to annex new territories and possessions.

Chapter IV: Declaration of Rights

1.Freedom of Expression

Parliament shall make no law abridging the freedom of speech, or of the press or association; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

2.Freedom to Practice Religion

Parliament shall make no law outlawing, disbanding or otherwise adversely affecting any political party.

3.Due Process of Law

No shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself,. No government shall make or enforce any law which shall abridge the privileges or immunities of citizens of Alvaria; nor deny to any person within its jurisdiction the equal protection of the laws.

4.Criminal Prosecutions

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the Region wherein the crime shall have been committed, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

5.Jury

In suits at common law, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in the court of Alvaria, than according to the rules of the common law.

6.Cruel or Unusual Punishment

Punishments must be proportionate to the crime/s committed.

7.Enumeration of Rights

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

8.Right to Privacy

No person or body of government has the right to release the contents of private conversations that contain one or more citizens, diplomats or visitors to Alvaria, without the consent of all other persons in the conversation. The only exception to this is if said communications are used as evidence before the courts, and even then must not include any information not relevant to the case.

9.Discrimination

Neither Parliament nor any other body of government may discriminate or segregate people on the basis of ethnicity, religion, membership in other regions or for any other reason

10.Habeas Corpus

The privilege of a writ or order of habeas corpus shall not be suspended in any and all cases.

11.Right to Vote

No citizen of Alvaria shall be denied the right to vote following a period of (3) weeks upon joining Alvaria.

12.Suspension of rights

Unless otherwise stated, no right mentioned above may be suspended in any case.

Chapter V: General Provisions

1.Prohibition of Office Holding

1.No person in Alvaria shall hold more than two government offices at once.

2.The President, Vice President, Prime Minister and Deputy Prime Minister shall not hold any other government role.

3.No person who holds a judicial office may hold any other government role.

4.Any person, unless prevented by another law, may hold any number of civil offices.

2.Amending the Constitution

Whenever two-thirds of Parliament deem it necessary, they shall propose amendments to this constitution, which when approved by two-thirds of the people in a referendum, shall be considered part of this constitution.

Chapter VI: Executive Branch

1.Executive Powers

Executive authority shall herein be split between the Prime Ministerial Office, consisting of the Prime Minister and Deputy Prime Minister, and the Presidency. The Prime Ministerial Office shall be under the Presidency. Underneath the Prime Ministerial Office is the Cabinet of Alvaria (the committee of senior ministers responsible for controlling government policy) such as the Minister of Foreign Affairs, Minister of Justice, Minister of Roleplay and any other positions that the Prime Ministerial Office or Parliament should so choose to create.

2.The President

Once elected, they shall serve until the end of their term, or until impeachment or resignation.
The Presidentís powers are as follows:

1.The President shall be the Head of State;

2.Represent Alvaria and officiate all treaties with the due approval of Parliament;

3.They shall have the capability to declare war with the due approval of Parliament;

4.They shall have the power to veto parliamentary legislation;

5.They shall have the power pardon with the consent of the Parliament or public;

6.They shall be responsible for the appointment of all judges with the approval of the Parliament;

7.They shall have the power to create Executive Orders, in compliance with the Constitution and all federal laws. The Supreme Court may strike down any Executive Orders and the Parliament may override Executive Orders with a two-thirds majority of the votes cast;

8.They shall have the power to bestow awards and medals to recipients they deem worthy;

9.They shall serve as the Commander-in-Chief of the Alvarian Alvarian Armed Forces, if any;

10.The sole power to grant citizens moderator and administrator roles on the Discord server, if one exists;

3.Inauguration of the President

The oath of office for the President shall be administered by the Chief Justice of the Supreme Court of Alvaria, the oath will say the following:
"I, (name), do solemnly swear (or affirm) that I will faithfully execute the office of President of Alvaria, and will to the best of my Ability, preserve, protect and defend the Constitution of Alvaria."

4.Succession of the President

In the case that the President is impeached and convicted, resigns, or the Presidentís account is deleted or CTEs, the following offices will succeed the President:

1.Vice President

2.Prime Minister

3.Deputy Prime Minister

4.Speaker of Parliament

5.Any and all offices of the Prime Ministerial Office created ranked by date of creation.

5.Vice President

The deputy to the President, the Vice President, shall be appointed at the discretion of the President.
The Vice President shall have the following powers:

1.Serve as the deputy of the President and serve underneath him in representative occasions as well as carry out any duties at the behest of the President so long as it is under the Presidentís powers;

2.Succeed the President if they are impeached, resigns, or account is deleted.

6.The Prime Minister

The Prime Minister shall be the head of the Prime Ministerial Office who shall be elected by the citizens for a term of four months.
The Prime Minister has the following powers:

1.They shall administer and preside over the Cabinet;

2.They shall appoint and dismiss members of the Cabinet;

3.They shall appoint members to the positions in the Prime Ministerial Office, and dismiss them at their discretion;

4.They shall commission Officers of the Alvarian Armed Forces, if any;

5.They shall establish a foreign policy, open, maintain and close embassies, and appoint ambassadors;

6.They shall be responsible for the day-to-day administration of the region and any associated platforms;

7.Serve as the Deputy Commander-in-Chief of the Alvarian Armed Forces, if any.
The Prime Minister has the ability to delegate any of their powers to any Ministry or Department that they create; however, they maintain ultimate control over their powers and can override the actions of any ministers or members of the Cabinet.

7.Inauguration of the Prime Minister

The oath of office for the Prime Minister shall be administered by the Chief Justice of the Supreme Court of Alvaria, the oath will say the following:
"I, (name), do solemnly swear (or affirm) that I will faithfully execute the office of Prime Minister of Alvaria, and will to the best of my Ability, preserve, protect and defend the Constitution of Alvaria."

8.Succession of the Prime Minister

In the case that the Prime Minister is impeached and convicted, resigns, or the Prime Ministerís account is deleted or CTEs, the following offices will succeed the Prime Minister:

1.Deputy Prime Minister

2.Speaker of Parliament

3.Minister of Justice

4.Minister of Domestic Affairs

5.Minister of Defense

6.Minister of Foreign Affairs

7.Any and all other Ministers created ranked by date of creation of their Ministry.

9.Deputy Prime Minister

The deputy to the Prime Minister, the Deputy Prime Minister, shall be appointed by the Prime Minister.
The Deputy Prime Minister shall have the following powers:

1.Inaugurate any and all members of the Prime Ministerial Office, officers of the cabinet; and

2.Serve as the deputy of the Prime Minister and serve underneath him in representative occasions as well as carry out any duties at the behest of the Prime Minister so long as it is under the Prime Ministerís powers; and

3.Succeed the Prime Minister if they are impeached, resigns, or account is deleted.

10.The Founder

The Founder shall have the power to declare a state of emergency. For the duration of this emergency, all executive powers shall be vested in the Founder, to be dispensed at their will. The courts have the power to contest the validity of the state of emergency, and take appropriate measures.

11.Minister of Foreign Affairs

The Minister of Foreign Affairs, appointed by the Prime Minister, is the Prime Ministerís chief foreign affairs adviser. The Minister carries out the Prime Ministerís foreign policies through the Ministry of Foreign Affairs.
The Minister of Foreign Affairs, with the permission of the Prime Minister, shall have the following duties:

1.Serves as the Prime Ministerís principal adviser on Alvarian foreign policy;

2.Conducts negotiations relating to Alvarians foreign affairs;

3.Exequaturs to foreign consuls in Alvaria;

4.Advises the Prime Minister on the appointment of Alvarian ambassadors and other diplomatic representatives;

5.Advises the Prime Minister regarding the acceptance, recall, and dismissal of the representatives of foreign governments;

6.Personally participates in or directs Alvarian representatives to international conferences, organizations, and agencies, subject to the involvement of the high government;

7.Negotiates, interprets, and terminates treaties and agreements, subject to the involvement of the high government;

8.Extends the protection of the Alvarian Government to Alvarian citizens and interests in foreign regions;

9.Supervises the administration of Alvarian laws abroad;

10.Provides information to Alvarian citizens regarding the political, economic, social, cultural, and other conditions in foreign regions, subject to The presence of better informed ambassadors or other persons; and the status of relations between Alvaria and the other regions;

11.Informs the Parliament and Alvarian citizens on the conduct of Alvarian foreign relations;

12.Promotes beneficial intercourse between Alvaria and other regions;

13.Administers the Ministry of Foreign Affairs and all other departments under it or lack thereof.

The powers of the Minister of Foreign Affairs and the Ministry are up to the discretion of the Prime Minister, who also has the ability to override any decisions made.

12.Minister of Justice

The Minister of Justice, appointed by the Prime Minister, is the head of the Ministry of Justice.

The Minister of Justice, with the permission of the Prime Minister, shall have the following duties:

1.They shall also oversee any and all governmental legal affairs; and

2.They shall oversee any and all investigations called for by the courts; and

3.They shall appoint the Attorney General.

The powers of the Minister of Justice and the Ministry are up to the discretion of the Prime Minister, who also has the ability to override any decisions made.

13.Attorney General

The Attorney-General shall be appointed by the Minister of Justice. They are responsible for state prosecution, and are either to lead the prosecution for them or are to appoint another prosecutor. The Minister of Justice can also serve as the Attorney General.

14.Minister of Defense

The Minister of Defence, appointed by the Prime Minister, shall serve as the head of the Ministry of Defence and Grand Marshal of the Alvarian Armed Forces. The Minister of Defence shall have the following duties:

1.They shall shall be tasked with the upkeep of the Alvarian Armed Forces; and

2.They shall have the power to promote members of the military; and

3.They shall be responsible for the defence of the region and all associated platforms.

The powers of the Minister of Defence and the Ministry are up to the discretion of the Prime Minister, who also has the ability to override any decisions made.

15.Minister of Domestic Affairs

The Minister of Domestic Affairs, appointed by the Prime Minister, shall serve as the Prime Ministerís chief advisor on Domestic Affairs. The Minister carries out the Prime Ministerís domestic policies through the Ministry.
The Minister of Domestic, with the permission of the Prime Minister, shall have the following duties:

1.They shall oversee the moderation of all platforms associated with Alvaria; and

2.They shall be responsible for overseeing the recruitment of new people to the region;

3.They shall be responsible for Discord customs;

4.They shall be responsible for updating all factbooks and keeping a record of all legislation.

The powers of the Minister of Domestic Affairs and the Ministry are up to the discretion of the Prime Minister, who also has the ability to override any decisions made.

16.Minister of Roleplay

The Minister of Roleplay, appointed by the Prime Minister, shall serve as the head of the roleplay. The Ministry of Roleplay shall be an autonomous body. The Minister of Roleplay shall have the following duties:

1.They shall monitor all content and posts, and be responsible for retconning;

2.They shall update and supply all rules for the roleplay;

3.They shall appoint, if they choose to, a roleplay council, which shall be responsible for monitoring content, retconning bad or inaccurate decisions, conversations and posts, and carrying out any other duties assigned to them by the minister; and

4.They shall have the ability to overrule any decision made by the council.

The powers of the Minister of Roleplay are up to the discretion of the Prime Minister, who does not have the ability to override any decision made.

17.Powers of Ministers

1.Any Minister shall have the power create and define the powers of:

A.A deputy minister;

B.Subsidiary departments; and

C.Any staff positions.

1.Unless the Prime Minister vetoes anything listed in (1), anything listed in (1) shall be taken as legally binding.

3.(2) Does not apply to the Minister of Roleplay.

18.Inauguration of any Other Member of the Executive

The oath of office for any member of the executive that is not the Prime Minister of President shall be administered by the Deputy Prime Minister. Each person is to say the following:
ďI, (name), do solemnly swear (or affirm) that I will support and defend the Constitution of Alvaria against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office upon which I am about to enter.Ē

Chapter VII: Legislative Branch

1.Legislative Powers

1.All legislative power shall be vested in a unicameral Parliament. The Parliament shall be the body responsible for the creation of laws binding the structure of government and civilian conduct within Alvaria.

2.No persons shall be elected to the Parliament before holding citizenship in Alvaria for 21 days, including the time before the adoption of this constitution.

2.The Parliament

The Parliament of Alvaria shall consist of Parliamentarians, chosen by the people of Alvaria on the first Saturday of every month. Each Parliamentarian shall have one vote. The number of Parliamentarians shall be ten. The Parliament may, by law, change the number of Parliamentarians. Parliament shall have the following powers:

1.They can overturn an executive veto by a two-thirds majority;

2.They can overturn a pardon by a two-thirds majority;

3.The Parliament shall have the power to remove any holder of a high government office from that office by a vote of no-confidence;

4.They shall have the power to vote on any legislation, requiring a simple majority, unless otherwise stated in the act.

5.Parliament may set its own rules, punish its members for disorderly behavior and, with legal reasoning and the concurrence of three fifths of its members, expel a member.

6.A motion for a vote of no-confidence may be initiated by any Parliamentarian.

3.Speaker

1.The Parliament shall choose it's Speaker. If any party has a majority, then they shall appoint a Speaker. If there is no majority, Parliament shall vote on a speaker. The Speaker shall have the following duties:

2.Calling for bills to be debated by the Parliament;

3.Calling for bills to be voted on by the Parliament;

4.Running the voting process;

5.Announcing the end verdict; and

6.Voting in the event of a tie. However, this is the only time that the Speaker is allowed to vote.

4.Inauguration of Parliamentarians

Each Parliamentarian shall take the following oath, or affirmation, before taking office:
ďI, (name), do solemnly swear (or affirm) that I will support and defend the Constitution of Alvaria against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office upon which I am about to enter.Ē

5.Impeachment

1.The Parliament shall have the sole power to try all impeachments.

2.All high government and government officials can be impeached for crimes that provide for impeachment as a punishment for the offence.

3.If either the Prime Minister of the President is on trial, their deputies shall act in their place. If either deputy is also on trial, the line of succession shall be followed.

4.Parliament reserves the right to ban impeached officials from holding office for an appropriate period of time.

5.Any impeached official can appeal to the courts

Chapter VIII: Judicial Branch

1.Judicial Powers

The Judicial power of Alvaria shall be vested in the Supreme Court and other lower courts the Parliament may establish from time to time. The Supreme Court may choose to set its own rules, punish its members for disorderly behavior and, with legal reasoning and the concurrence of three fifths of its members, expel a member.

2.Supreme Court Judges

The Supreme Court of Alvaria shall be composed of one Chief Judge and between two and four Judges nominated by the Prime Minister.

The Parliament shall be required to confirm each Judge and the Chief Judge by a simple majority. This process will consist of the following steps:

A) All prospective judges must consent to being subjected to a hearing chaired by the Speaker with the presence of the rest of the Parliament.

B) During the hearing in the Parliament, all members of the Parliament are entitled to ask any questions relevant to the prospective judgeís qualifications and ability to serve on the court. This includes ascertaining if the judge is a fit and proper person.

C) Discretion as to what is and is not relevant belongs to the Speaker of the Parliament.

D) The prospective judge is required to answer any and all inquiries forwarded by the Parliament in this hearing.

E) Once all members of Parliament have asked their questions and they have been answered sufficiently, the Parliament shall vote.

3.Jurisdiction

1.The Judicial power of Alvaria shall extend to all cases regarding the law, constitution or treaties of Alvaria.

2.The Supreme Court shall have original jurisdiction in controversies in which a domestic civil officer is a party, a foreign civil officer is a party, the military is a party or Alvaria is a party.

3.The Supreme Court shall have appellate jurisdiction in all other cases.

4.Statutes have superiority over case law.

Chapter IX: Elections

1.Presidential Elections

1.Presidential Elections shall begin on the first Saturday of every sixth month.

2.The registration for the elections shall begin no earlier than one week prior to the Primary Elections and no later than forty-eight hours prior to the Primary Elections.

3.All law-abiding citizens who held citizenship in the region at the beginning of registration shall be permitted to register.

4.All registrations by law-abiding and applicable citizens must be accepted if they meet the required format.

5.The Commission for Alvarian Elections must establish a set registration format that is publicly available whilst also remaining politically neutral.

6.The election shall last until forty-eight hours have passed following its beginning.

7.The election shall be done using the preferential system and shall have four ranks to rank candidates in.

8.If the election has three or fewer candidates, the elections shall be done in first-past-the-post.

9.The Commission for Alvarian Elections may include additional questions within the election, though may not make them mandatory unless they are governmentally mandated.

10.Both the election and the registration must be publicly announced.

2.Prime Minister Elections

1.Prime Ministerial Elections shall begin on the first Saturday of every fourth month.

2.The registration for the elections shall begin no earlier than one week prior to the elections and no later than forty-eight hours prior to the elections.

3.All law-abiding citizens who held citizenship in the region at the beginning of registration shall be permitted to register.

4.All registrations by law-abiding and applicable citizens must be accepted if they meet the required format.

5.The Commission for Alvarian Elections must establish a set registration format that is publicly available whilst also remaining politically neutral.

6.The election shall last until forty-eight hours have passed following its beginning.

7.The election shall be done using the preferential system and shall have four ranks to rank candidates in.

8.If the election has three or fewer candidates, the elections shall be done in first-past-the-post.

9.The Commission for Alvarian Elections may include additional questions within the election, though may not make them mandatory unless they are governmentally mandated.

10.Both the election and the registration must be publicly announced.

3.Emergency Presidential Elections

1.In the case of the resignation of the President with no legal successors willing to take the office, an Emergency Presidential Election shall be held.

2.The Emergency Election shall begin on the Saturday following the resignation of the President. If the date is less then forty-eight hours away, then the date of the election will move to the next Saturday, and the Founder shall be in charge until the next election, and it is up to their discretion to declare a state of emergency during the intermediary period. If the Founder is not available, or is the same person as the President, the Chief Justice of the Court shall be in charge until the election.

3.The registration shall begin immediately after the resignation of the President looking to be replaced.

4.All law-abiding applicable citizens shall be allowed to register.

5.All registrations by law-abiding applicable citizens must be accepted if they meet the required format.

6.The Commission for Alvarian Elections must establish a set registration format that is publicly available whilst also remaining politically neutral.

7.The election shall begin on Saturday and shall last until forty-eight hours have passed.

8.The election shall be done using the preferential system and shall have four ranks to rank candidates in.

9.If the election has three or fewer candidates, the elections shall be done in first-past-the-post.

10.The Commission for Alvarian Elections may include additional questions within the election, though may not make them mandatory unless they are governmentally mandated.

11.Both the election and the registration must be publicly announced.

12.If the Emergency Election would be scheduled on the day of a Presidential Election, the Emergency Election would not be held.

4.Emergency Prime Minister Elections

1.In the case of the resignation of the Prime Minister with no legal successors willing to take the office, an Emergency Prime Ministerial Election shall be held.

2.The Emergency Election shall begin on the Saturday following the resignation of the Prime Minister. If the date is less then forty-eight hours away, then the date of the election will move to the next Saturday, and the Founder shall be in charge until the next election, and it is up to their discretion to declare a state of emergency during the intermediary period. If the Founder is not available, the Chief Justice of the Court shall be in charge until the election.

3.The registration shall begin immediately after the resignation of the President looking to be replaced.

4.All law-abiding applicable citizens shall be allowed to register.

5.All registrations by law-abiding applicable citizens must be accepted if they meet the required format.

6.The Commission for Alvarian Elections must establish a set registration format that is publicly available whilst also remaining politically neutral.

7.The election shall begin on Saturday and shall last until forty-eight hours have passed.

8.The election shall be done using the preferential system and shall have four ranks to rank candidates in.

9.If the election has three or fewer candidates, the elections shall be done in first-past-the-post.

10.The Commission for Alvarian Elections may include additional questions within the election, though may not make them mandatory unless they are governmentally mandated.

11.Both the election and the registration must be publicly announced.

12.If the Emergency Election would be scheduled on the day of a Prime Minister Election, the Emergency Election would not be held.

5.Parliamentary Elections

1.Primary Parliamentary Elections shall begin on the first Saturday of every month.

2.The election shall begin on the first Saturday of the month and shall last until forty-eight hours have passed.

3.The election shall be done via a system in which seats within the Parliament will be apportioned proportional to the proportion of the vote earned by each political party.

4.The Commission for Alvarian Elections may include additional questions within the election, though may not make them mandatory unless they are governmentally mandated.

5.Both the election and the registration must be publicly announced.

6.The Commission for Alvarian Elections must establish a set registration format that is publicly available whilst also remaining politically neutral.

6.By-Elections

1.In the case of the resignation of one or more Parliamentarians within the Parliament, a by-election shall be held.

2.The By-Election shall begin on the Saturday following the resignation of the first Parliamentarian looking to be replaced. If the date is less then forty-eight hours away, then the date of the election will move to the next Saturday.

3.The registration shall begin immediately after the resignation of the first Parliamentarian looking to be replaced.

4.All law-abiding citizens shall be allowed to register.

5.All registrations by law-abiding citizens must be accepted if they meet the required format.

6.The Commission for Alvarian Elections must establish a set registration format that is publicly available whilst also remaining politically neutral.

7.The election shall begin on Saturday and shall last until forty-eight hours have passed.

8.The election shall be done using the preferential system and shall have four ranks to rank candidates in.

9.If the election has three or fewer candidates, the elections shall be done in first-past-the-post.

10.The Commission for Alvarian Elections may include additional questions within the election, though may not make them mandatory unless they are governmentally mandated.

11.Both the election and the registration must be publicly announced.

12.If the By-Election would be scheduled on the day of a Parliamentary Primary Election, a By-Election shall not be held.

7.Alvarian Electoral Commission

The Alvarian Electoral Commission shall consist of three members and be appointed by the Supreme Court. They shall be appointed 2 weeks before the Presidential elections, and shall serve until 2 weeks before the next election.
