The Constitution of the Federation of Jaedonstan

The Senate of the Federation of Jaedonstan hereby establishes, by the Will of the People and the Grace of God, this Constitution for the Governance and Peace of the Federation and of Her People, and for the Assurance of Domestic Harmony between Districts, ratifies this Constitution as the Supreme Law of the Federation.

Article I

§1.1 The people of the Federation of Jaedonstan shall be upheld as the ultimate power. They shall be protected by the rights outlined below.

§1.2 The people of the Federation shall be assured the right to free speech, which shall not be infringed by any government within the Federation; the Federation will ensure the right to free press and writing, as an extension of speech.

§1.3 The people of the Federation shall be assured the right to property and the right to create revenue with resources provided to them; the right to protect this property from the illegal and unwarranted search and seizure of property by any government within the Federation and that the seizure of this property will be carried out by the empowered persons and returned promptly and without unwarranted damage or confiscation of property belonging thereto.

§1.4 The people of the Federation shall be assured the right to bear arms and posses tools for the proper use and upkeep of those arms.

§1.5 The people of the Federation shall be assured the right to exercise the worship of their religion freely and without governmental hindrance.

§1.6 The people of the Federation shall be assured the right to a trial by a jury of their peers, be they male or female, in any case of a capital or infamous crime; no citizen of the Federation will be deprived of liberty, property, or life without the due process of the law, during times of both peace and of war; nor shall any soldier or seaman of the land or naval forces or any armed militia be deprived of the aforementioned liberty, property, or life without the due process of law, except as necessarily required during times of war or actual service; nor shall any citizen of the Federation be tried twice for the same crime, being placed in jeopardy of liberty, property, and life for the same offense; nor shall any trial take an undue amount of time; nor shall the time of imprisonment before a trial exceed what is necessary for the assurance of a fair trial or the bail set to be excessive; nor shall any person tried in a court of the Federation be denied the right to representation by a lawyer or councilor; nor shall any witness in any case be forced to witness as to jeopardize himself; nor shall any citizen be denied the right to stand before a jury of his peers in the place in which he committed his crime.

§1.7 The Rights hereafter described shall be reserved, in their entirety, for the member districts of the Federation; all rights not hereafter prescribed directly to the federal union of powers shall be reserved for the member districts of the Federation and to the people of the Federation.

§1.8 The Federation shall ensure the right of each member district to raise, train, and keep a well-armed militia force, for the defense of the district in times of war and for the keeping of the peace and order during times of peace. However, the Federation shall ensure that these forces are never used in rebellion against the legitimate government of the Federation or against the legitimate government of any other member district.

§1.9 The Federation shall ensure the right of each member district to establish its own legislature, judicial, and executive powers. The Federation shall ensure the rights of the districts to elect Senators to the federal Senate.

Article II

§2.1 The power of the federal union of powers shall rest upon the Senate of the Federation of Jaedonstan. The Senate shall be tasked with the representation of the people and districts of the Federation in the legislative body.

§2.2 The Senate will be empowered to pass acts upon the Federation by a legal, two-thirds majority vote. These laws and acts will be permitted to be enforced upon all federal property, holdings, and territory. Additionally, the member districts may be permitted to legally adopt any act that the Senate passes.

§2.3 The Senate will be empowered to introduce laws to the Federation. These laws will be permitted to be enforced upon all Federation territory, including member districts, by the district and federal agents of the law. These laws may be introduced in the Senate, but must pass both the Senate, with a two-third majority, and all member districts, with a two-thirds majority. The Senate shall be the only authority in the Federation permitted to declare war upon any other nation or entity, with a majority vote of two-thirds.

§2.4 The Senate may repeal all acts and laws that it passes. It must do so with a four-fifths majority. Any laws that are passed by both the Senate and the member districts may be repealed by the Senate with a four-fifths majority. The executive power may veto any act, law, or repeal of the Senate; the Senate may overturn this veto by a four-fifths majority vote.

§2.5 The Senate will act as the federal judicial power. The Senate will be permitted to review laws and acts of the Senate, both past and present, and make interpretations and precedents upon those laws. The Senate will appoint ten Senators to act as Karvik Senators of the Karvik court. These Senators will be permitted to publish official interpretations, overturn lower court rulings, and set precedents concerning all federal laws and acts.

§2.6 The Senate will consist of five Senators from each member district. Each district will be permitted to elect their Senators in the manner which they approve of most; however, the Federation will require that the Senators be elected every six years, that the Senators be five in number, that the Senators be residents of the member district they represent, that the Senators hold only one seat in the Senate at a time, that the Senators are elected in accordance will all laws and acts of the Federation, and that all Senators be citizens of the Federation at the time of their election.

Article III

§3.1 The power of the executive branch will rest upon the appointed Vizior of the Senate. The Senate shall appoint a member of their body, a natural-born citizen of the Federation and one whom exceeds the age of twenty-three, to become the appointed Vizior. The Vizior shall be permitted to continue acting as a Senator within the Senate, but his vote shall not be counted more than any other vote, nor shall he be given preferential treatment in the presentation of bills or the rebuttal of arguments. Instead, the Vizior shall act as the president of the Senate and shall keep order within the Senate.

§3.2 The Vizior shall be the appointed executive authority within the Federation; thus, he shall enforce and ensure the enforcement of all laws and acts of the Senate. He shall be permitted to appoint agents of the federal Senate to enforce the law and will be permitted to appoint magistrates of the federal Senate to administrate and carry out the prosecution of the law.

§3.3 The Vizior shall be vested with the power of conducting and administrating all foreign affairs on behalf of the Senate. The Vizior shall be permitted to appoint ambassadors and officers to represent the Federation in foreign affairs and is permitted to appoint officers to negotiate and arbitrate treaties with foreign powers, be that military or domestic. The Senate may overturn a treaty signed by the Vizior with a four-fifths vote.

§3.4 The Vizior is permitted to appoint ministers to which he may delegate all the powers of his office. These ministers may be members of the Senate or citizens of the Federation but must be natural-born citizens over the age of twenty-five. The Senate may deny any appointee the position of a minister with a vote of four-fifths. This vote may not be vetoed by the Vizior. The Vizior will appoint a Lieutenant Minister from among his cabinet. This Lieutenant Minister will be tasked with the roles, powers, and office of Vizior should the Vizior be removed, retire, or otherwise unable to fulfill his duties. Should the Vizior be permanently removed, the Lieutenant Minister will be tasked with fulfilling the roles, powers, and office of the Vizior until his term is up or until the Senate votes for a special election.

§3.5 The Vizior shall be held in check by the power of the Senate. Should the Senate judge that the Vizior has broken any federal law or committed crimes against the Federation and her people, the Senate will initiate a Vote of Impeachment of the Vizior. Should the Senate vote to begin a trial of the Vizior, the Vizior will be permitted to defend himself or appoint councilors. The Senate shall act as the jury; a two-thirds majority will be required to convict the Vizior. The Senate will then be required to remove the Vizior from office if he is convicted. The Lieutenant Minister will immediately be sworn into office.

§3.6 The Senate may initiate a Vote of No Confidence in the Vizior. Should a Senator initiate this vote, the Senate is not permitted to vote upon any other bill or motion until the vote is complete. The Senate will be permitted to remove the Vizior should the Vote pass with a two-thirds majority. The Senate will then immediately hold a special election to replace the Vizior. The Senate may not initiate a Vote of No Confidence while the Federation is in a state of war.

Article IV

§4.1 The power of the federal criminal court will rest in the Vestik Court. The magistrates and judges of the Vestik Court will be appointed and removed by the Vizior. The Vizior will be permitted to appoint a single citizen of the Federation to a position of the Vestik Court but will not be permitted to appoint a single citizen to more than a single position. All appointees must be current citizens of the Federation and over the age of twenty-five. Any appointment by the Vizior to the Vestik Court may be overturned by the Senate without veto.

§4.2 The Vestik Court will be empowered to hear and overturn any criminal case from any lower court. The Vestik Court will not be permitted to hear any case that is not facilitated by federal laws or acts.

§4.3 The Senate is permitted to initiate voting upon an amendment to this Constitution. Any Senator will be permitted to initiate this voting process. The Senate must approve the proposed amendment with a vote of two-thirds. The amendment will only become law once two-thirds of the member districts approve, through their legislative bodies.

Article V

§5.1 All powers not herein described will be reserved for the member districts of the Federation and the people of the Federation.

§5.2 The Senate, for the protection of the people from threats both foreign and domestic, will be permitted to establish, train, and keep a standing military. This military may not exceed the number of one hundred thousand men. This military will consist of all land, naval, and militia forces within the Federation; the Senate is permitted to call up all militias in times of war. The Senate will place the Vizior as the commander-in-chief of this military. All member districts are permitted to establish, train, and keep a standing militia of both land and naval troops.
