Constitution of Erynia and Draconia

Erynian and Draconian Constitution (with amendments included in the text)

PREAMBLE
We, the citizens of the democratic states, establish a government built on the fundamental and inalienable principles of equality and liberty for all human beings— one which aims for a fairer, freer society where all have the ability to lead fulfilling lives— and one that is truly driven by the people it governs.

ARTICLE 1: Legislative Branch
Section 1 - All legislative powers herein granted shall be vested in the Parliament of Erynia and Draconia, which shall consist of a Senate and National Assembly.
Section 2 - The National Assembly shall be composed of 580 members chosen every three years by the people of each State through mixed-member proportional representation. Every ten years the number of seats shall be adjusted to accommodate the changing population, and the number of new seats added shall be confirmed by a simple majority in the Senate. A member of the National Assembly must be at least twenty-five years of age and be an inhabitant of the state or district they represent. The number of people represented for any one seat must be similar to that of another district. A member of the National Assembly may only serve one term. If a vacancy occurs due to resignation or otherwise, a new election shall be held solely for that seat. At the beginning of each new term, the National Assembly shall elect a member to serve as Prime Minister, as well as one to serve as Prime Minister pro tempore. The powers of the Prime Minister shall be outlined in Article 2, Section 3.
Section 3 - The Senate shall be composed of 235 senators chosen every 6 years by the people through instant runoff. A senator must be at least thirty years of age and be an inhabitant of the district they represent. The number of people represented for any one seat must be similar to that of another district. A senator may only serve one term. If a vacancy occurs due to resignation or otherwise, a new election shall be held solely for that seat. The Prime Minister of Erynia and Draconia shall appoint a senator to be the Speaker of the Senate. The Speaker shall oversee the sessions of the Senate.
Section 4 - The capitol building shall be the meeting place of both houses of Parliament. The capitol building is located at the intersection of Parliament Street and King’s Avenue in Eryn City. The National Assembly shall meet in the west wing of the capitol building, and the Senate shall meet in the east wing.
Section 5 - The duties and powers of Parliament shall be the following: create laws concerning the nation, declare war, collect taxes, approve the Prime Minister’s cabinet appointments, and approve treaties negotiated by the executive branch.

ARTICLE II: Executive Branch
Section 1 - The executive powers herein granted shall be vested in both a President and the Prime Minister.
Section 2 - The President shall be elected directly by the people by popular vote and shall serve for three years. They may serve for a maximum of two terms. The President must be at least thirty years of age and have been a citizen of Erynia and Draconia for at least twenty years. Once elected, the President-elect shall take an oath before officially becoming the President of Erynia and Draconia. The President shall be Commander in Chief of the nation’s military. The President shall have the power to ratify or veto a bill passed by Parliament, enforce the laws passed by Parliament, and represent the nation in talks with foreign countries. The President shall live on 63 Parliament Street, Eryn City.
Section 3 - The Prime Minister shall be elected by the National Assembly. They must be at least twenty-five years of age and have been a citizen of Erynia and Draconia for at least fifteen years. The Prime Minister shall have the power to form a cabinet, which shall be approved by the Senate by a simple majority. The executive branch shall be composed of several departments that shall specialize in certain areas of law execution, each led by a member of the Prime Minister’s cabinet. In addition to being co-leader of the executive branch, the Prime Minister shall also be the head of the legislative branch and shall oversee the sessions of the National Assembly. The Prime Minister shall live on the top floor of the building at the intersection of Parliament Street and North Avenue.
Section 4 - The President or Prime Minister shall be removed from office if two-thirds of each house of Parliament votes so. If the President or Prime Minister resigns or is removed from office, an election will be held to fill the vacancy.

ARTICLE III: Judicial Branch
Section 1 - The judicial powers herein granted shall be vested in a Federal Court. The Federal Court shall consist of a Supreme Court and six Lower Courts. The Supreme Court and each of the Lower Courts shall consist of twelve judges who shall be appointed by a non-partisan committee. Each judge must have studied law in university for at least eight years. Judges shall serve for ten years and may not be appointed to the Federal Court twice.
Section 2 - All new laws that have been put into effect shall be sent to the Supreme Court to decide if the law is in accordance with the constitution. The judges shall interpret the constitution and may nullify a law if they find it violates any part of the constitution.
Section 3 - The Lower Courts are in charge of dealing with disputes that are deemed too large for state courts. If a case is lost, it can be appealed to the Supreme Court, in which case the Supreme Court will take the case.
Section 4 - The Supreme Court may remove a politician without Parliamentary approval if they have been found guilty of a serious crime such as murder or treason.

ARTICLE IV: Powers of the States
Section 1 - Erynia and Draconia shall be divided into 12 states. Each state shall have a democratic government that must follow all the guidelines that have been set forth in this document for the federal government. All states must adhere to federal laws and pay federal taxes in addition to their own laws. Each state shall have a democratically elected legislature and a Chancellor, who shall serve as the executive of that state. Any power not given to the federal government shall be left to the individual states. A state may not declare war on any other state or nation, and cannot sign treaties or alliances with other states or foreign countries. Each state also has a judicial branch which shall operate similarly to the Federal Court.
Section 2 - For a state to secede from the union, a referendum must be held in that state. If a simple majority of the state votes for secession, it must be approved by the Senate via a simple majority.
Section 3 - The number of states may be increased to up to sixteen if both houses of parliament decide to introduce said new states.

ARTICLE V: Rights of residents
Section 1 - All residents of Erynia and Draconia shall be guaranteed freedom of speech and expression -- as long as such speech does not degrade or dehumanize another person-- as well as the right to peacefully protest and assemble. The government may not infringe on this right by passing a law that restricts said freedoms.
Section 2 - All residents of Erynia and Draconia shall have the right to healthcare free of charge, which shall be supplied by the nation’s single-payer healthcare system.
Section 3 - All residents of Erynia and Draconia, no matter the severity of the crime, shall have the right to a trial to the fullest extent of the law. All people on trial shall be given a lawyer, regardless of their ability to pay. All lawyers shall be government lawyers, and lawyers from private firms shall be illegal. The government may not decide which lawyers to give to which people based on any socio-economic or other personal factors, and may not discriminate against certain people by supplying them with sub-par lawyers.
Section 4 - All residents of Erynia and Draconia have the right to practice their religion without interference or discrimination, as long as the practices are lawful and humane, and the government cannot directly or indirectly associate with any religion or give precedence to a certain religion.
Section 5 - All residents of Erynia and Draconia shall be treated equally under the law. Everyone, regardless of their gender, race, religion, politics, etc., shall have the same rights and opportunities, and no law may be passed that discriminates against any group. Additionally, no person may be owned by another.
Section 6 - No person shall be subject to any cruel, inhumane, or unusual punishment.
Section 7 - All residents of Erynia and Draconia, regardless of whether they are a citizen or not, shall have the right to petition the government or lobby to Parliament.
Section 8 - All residents of Erynia and Draconia shall have the right to have a job if they want one.
Section 9 - All residents of Erynia and Draconia have the right to be paid at least a wage that allows them to pay their monthly expenses. Any unpaid or underpaid labor is illegal.
Section 10 - All aforementioned rights apply to any human being or artificially intelligent robot who is currently residing on land, water, air or otherwise under the jurisdiction of the government of Erynia and Draconia.

ARTICLE VI: Rights and opportunities of citizens
Section 1 - Anyone who has resided in Erynia and Draconia for at least 2 years is legally a citizen. All citizens are guaranteed all the rights listed in Article V, as well as the ones mentioned in the following sections.
Section 2 - All citizens above the age of seventeen shall have the right to vote in all elections.
Section 3 - All citizens shall have the right to all levels of education free of charge.
Section 4 - If a citizen meets the requirements to run for a political office, they shall have the opportunity to run for said office. No laws that restrict certain genders, races, religions, etc. from holding office may be passed, with the exception of age requirements.

ARTICLE VII: Technicalities
Section 1 - The official name of this nation shall be “The Democratic States of Erynia and Draconia”, and may also be legally referred to as either “Erynia and Draconia”, “The Democratic States”, or “The DSED”.
Section 2 - Erynia and Draconia shall recognize the Ravellian language as the official language of the nation, and shall use this language for national matters. Additionally, the English language shall be nationally recognized as well.
Section 3 - The only accepted currency in Erynia and Draconia shall be the Eryconian Dollar, which shall be created and regulated solely by the national government.
Section 4 - The national bird of Erynia and Draconia shall be the Tree Swallow, the national animal shall be the Dragon, and the national plant shall be the Oak tree.

ARTICLE VIII: Amendments and rewritings
Section 1 - An amendment needs three-fifths of both houses to pass and does not need the approval of the executive.
Section 2 - If the current constitution is deemed too flawed to reform through amendments, the constitution may be rewritten. In order for a new constitution to become effective, it must pass both houses of Parliament by a two-thirds majority and be approved by eight of the twelve state legislatures.
Section 3 - If a state successfully secedes from the union, or the name of a street mentioned in this document or other technical aspect changes, an amendment to fix the technicalities can pass without any vote.
