The Parliament of Agausia (Agausian: Agûsës Ṕarlament́i) is the supreme national legislature of the Republic of Agausia. It is a unicameral parliament, currently consisting of 145 members. The Constitution of Agausia mandates that the Parliament consists of no less than 145 members. MPs are elected by secret ballot for four-year terms. The electoral system is parallel system.

All members of the Parliament of Agausia are elected for four years on the basis of universal human suffrage. The Constitution of Agausia grants the Parliament of Agausia a central legislative power.

The Parliament of Agausia is the country's supreme representative body which effects legislative authority, determines the main directions of the country's home and foreign policy, controls the activity of the Government within limits defined by the Constitution and exercises other rights. The Parliament of Agausia is a unicameral legislature, and composed of 145 members elected for a term of four years through a mixed system.

The Parliament of Agausia is elected on the basis of universal, free, equal and direct suffrage, by secret ballot. Scheduled parliamentary elections are held on the last Saturday of November of the calendar year in which the term of Parliament expires. In case of the dissolution of the Parliament, elections are called no earlier than the 30th day and no later than the 45th day after the legislature is dissolved.

In order to fill vacancies (for any reason) elections are called no earlier than the 30th day and no later than the 45th day after an MP's seat becomes vacant. When a member of Parliament dies, resigns or become disqualified to hold a seat, a by-election is held in his constituency unless the tenure for the current Parliament is less than one and a half years (548 days), where the seat is simply left vacant until the next general election.

In Agausia to initiate a Linksnap election the president must have consent from the prime minister and after consultations with the parliamentary groups, while the Parliament is in session.

Snap elections should be held no earlier than 30 but no later than 45 days after parliament is dissolved.


Sessions and sittings [back to contents]



The first meeting of the newly elected Parliament is held on first Monday in February after a regularly scheduled election, or no later than the 30th day after the election results have been officially announced in a snap election. The first meeting of Parliament is called by the President of Agausia. The Parliament meets in its official capacity for a regular session twice a year, from the first Monday in February to the second Friday in June and from the first Monday in August to the second Friday in December. In between the sessions, the President can convene an extraordinary session of the Parliament at the request of the Chairperson of Parliament, at least one fourth of members of Parliament or the Government.

The Government, a Member of Parliament, a parliamentary faction, a parliamentary committee, and no less than 7 percent of registered voters have the right of to initiate a bill. A law is adopted if it is supported by a majority of the members of Parliament present but at least 3/5 of the total number of the members of Parliament (87 members). A law passed by Parliament is to be submitted to the President of Agausia within 10 days. The President can sign and promulgate the law or return it to the Parliament with justified remarks within 2 weeks. If the remarks are adopted, the final version of the law is submitted to the President within 5 days, and the latter must sign and promulgate the law within 5 days. If the President's remarks are rejected, the initial version of the law is put to a vote in the Parliament and, if adopted, submitted to the President within 3 days for signature and promulgation. If the President fails to promulgate the law, then the Chairperson of Parliament does this after the respective deadline expires. However, if the president if traveling (nationally or internationally) the initial deadline is extended to no more than 10 days.

The Parliament has the power to ratify, denounce and annul international treaties by a majority of the total number of its members. They can also impeach the President [1], a member of the Government, a judge of the Supreme Court, a General Prosecutor, a LinkAudit-General, a member of the Board of the National Bank, and several other Presidential Appointees. A LinkMotion of no confidence requires a Linksimple majority (73/145 MPs). The Parliament can be dissolved by the President of Agausia if the legislature fails to approve the incoming Government in the established time-frame, or at the discretion of the president, but only after consent from the prime minister and after consultations with the parliamentary groups, while the Parliament is in session.

The Agausian parliament can also make changes and amendments to the nation's constitution. A vote on constitutional reforms requires a full session of parliament with all members. The plurality of 3/5ths (at least 87) votes are required to pass an amendment or make changes. MPs are required to cast a vote, meaning that no abstentions are allowed. If a member cannot attend, or chooses not to attend the voting their absence will count as a Nay vote. An absolute majority would be adjusted for any vacancies, unless there is time for a special election in which the vote must wait for the vacancy to be filled. A vote on constitutional reforms cannot be called during extra-parliamentary sessions, or during a Linkcaretaker government.

There is a parliamentary trigger that allows for the parliament to send an amendment that does not reach 87 votes, but gets at least a majority (73) to a constitutional referendum.

The Parliament of Agausia elects the Chairperson for its term by a majority of the total number of its members by secret ballot, however, the chairperon of Parliament must come from the largest political party represented - even if the party is in opposition. The Chairperson of Parliament presides over the work of Parliament, ensures the free expression of opinion, and signs the acts adopted by Parliament. Most of the time the Chairperson of Parliament also serves as the Party Chair for their respective party. While there is no law or rule mandating this, over the years it has become tradition.

    In accordance with the Constitution of Agausia, the Parliament sets up committees and commissions from the pool of MPs. According parliamentary regulations, committees are formed on basis of a principle of proportional representation of factions. A committee can form a sub-committee within its main activities. Commissions are created for a period no longer than a term of a convocation of the Agausian Parliament itself.
