The Government Structure of the Ecnavian Federation

Ecnavian Federal Parliament

Section 1. The Legislative power shall be vested in the Ecnavian Federal Parliament.

Section 2. The Ecnavian Federal Parliament shall be composed of 350 Members. The apportionment should be base on degressive proportionality through agreement.

Section 3. (1) The Members of the Ecnavian Federal Parliament.
shall be elected by the qualified electors in their respective states for a term of four months.

The elections shall be done on:

(1) For the term June to September; shall be on the fourth Monday of April or as may be provided by law, (2) For the term October to January; shall be on the fourth Monday of August or as may be provided by law, (3) For the term February to May; shall be on the fourth Monday of December or as may be provided by law.

Section 4. No person shall be a Member of the National Assembly unless he is a natural-born citizen of the state he is representing and, on the day of the election, is at least twenty-five years of age, able to read and write, a registered voter in the state he is from in which he shall be elected, and a resident thereon for a period of not less than one year immediately preceding the day of the election.

(2) In case a vacancy arises in the Ecnavian Federal Parliament one year or more before a regular election, the Commission on Elections shall call a special election to be held within seven days after the vacancy occurs.
Section 5 The Ecnavian Federal Parliament shall convene once every year on the fourth Monday of July for its regular session, unless a different date is fixed by law, and shall continue to be in session until thirty days before the opening of its next regular session, exclusive of Saturdays, Sundays, and legal holidays. However, it may be called to session at any time by the President of the Ecnavian Federal Parliament to consider such subjects or legislation as he may designate.

Section 6. (1) The Ecnavian Federal Parliament, shall, by a majority vote of all its Members, elect its Speaker from the Members thereof. It shall choose such other officers as it may deem necessary.
The election of the President of the Ecnavian Federation and the President of the Ecnavian Federal Parliament shall precede all other business following the election of the Speaker.
(2) A majority of the Ecnavian Federal Parliament shall constitute a quorum to do business, but a smaller number may adjourn from day to day and may compel the attendance of absent Members in such manner, and under such penalties, as the Ecnavian Federal Parliament may provide.
(3) The Ecnavian Federal Parliament may determine the rules of its proceedings, punish its Members for disorderly behavior, and with concurrence of two-thirds of all its Members, suspend or expel a Member, but if the penalty is suspension, this shall not exceed sixty days.
(4) The Ecnavian Federal Parliament shall keep a Journal of its proceedings, and from time to time publish the same, excepting such parts as may, in its judgment, affect national security; and the yeas and nays on any question shall, at the request of one-fifth of the Members present, be entered in the Journal.

Section 7. (1) Unless otherwise provided by law, each Member of the Ecnavian Federal Parliament shall receive an annual salary of two hundred forty thousand renx. No increase in salary shall take effect until after the expiration of the term of the Members of the Ecnavian Federal Parliament approving such increase.
(2) The records and books of accounts of the Ecnavian Federal Parliament shall be open to the public in accordance with law, and such books shall be audited by the Commission on Audit which shall publish annually the itemized expenditures for each Member.

Section 8 A Member of the Ecnavian Federal Parliament shall, in all offenses punishable by not more than six years imprisonment, be privileged from arrest during his attendance at its sessions, and in going to and returning from the same; but the Ecnavian Federal Parliament shall surrender the Member involved to the custody of the law within twenty-four hours after its adjournment for a recess or its next session, otherwise such privilege shall cease upon its failure to do so. A Member shall not be questioned or held liable in any other place for any speech or debate in the Assembly or in any committee thereof.

Section 9. A Member of the Ecnavian Federal Parliament shall not hold any other office or employment in the government, or any subdivision, agency, or instrumentality thereof, during his tenure. Neither shall he be appointed to any civil office which may have been created or the emoluments thereof increased while he was a Member of the Ecnavian Federal Parliament.

Section 10. No Member of the Ecnavian Federal Parliament shall appear as counsel before any court inferior to a court with appellate jurisdiction, before any court in any civil case wherein the government, or any subdivision, agency, or instrumentality thereof is the adverse party, or before any administrative body. Neither shall he, directly or indirectly, be interested financially in any contract with, or in any franchise or special privilege granted by, the government, or any subdivision, agency, or instrumentality thereof, including any government-owned or controlled corporation, during his term of office. He shall not intervene in any matter before any office of the government for his pecuniary benefit.

Section 11. (1) There shall be a question hour at least once a month or as often as the rules of the Ecnavian Federal Parliament may provide, which shall be included in its agenda, during which the President of the Ecnavian Federal Parliament or any Minister may be required to appear and answer questions and interpellations by Members of the Ecnavian Federal Parliament. Written questions shall be submitted to the Speaker at least three days before a scheduled question hour. Interpellations shall not be limited to the written questions, but may cover matters related thereto. The agenda shall specify the subjects of the question hour. When the security of the State so requires and the President of the Ecnavian Federal Parliament so states in writing, the question hour shall be conducted in executive session.
(2) Ecnavian Federal Parliament or any of its committees may conduct inquiries in aid of legislation in accordance with its duly published rules of procedure. The rights of persons appearing in such inquiries shall be respected.

Sec. 12. (1) Except as otherwise provided in this Constitution, no treaty shall be valid and effective unless concurred in by a majority of all the Members of the Ecnavian Federal Parliament.

Section 13. (1) The rule of taxation shall be uniform and equitable. The National Assembly shall evolve a progressive system of taxation.

Ecnavian Federal Parliament shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of Ecnavian Federation; but all Duties, Imposts and Excises shall be uniform throughout the Ecnavian Federation;
3: To regulate Commerce with foreign Nations, and among the several States,
4: To establish Laws on the subject of Bankruptcies throughout the Ecnavian Federation;
5: To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;
6: To provide for the Punishment of counterfeiting the Securities and current Coin of the Ecnavian Federation;
7: To establish Post Offices and post Roads;
8: To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;
9: To constitute Tribunals inferior to the Court of Justice of the Ecnavian Federation;
10: To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations;
11 To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powersvested by this Constitution in the Government of the Ecnavian Federation, or in any Department or Officer thereof.

Section 14. (1) Every bill passed by the Ecnavian Federal Parliament shall, before it becomes a law, be presented to the President of the Ecnavian Federal Parliament. If he approves the same he shall sign it; otherwise, he shall veto it and return the same with his objections to the Ecnavian Federal Parliament. The bill may be reconsidered by the Ecnavian Federal Parliament and, if approved by two-thirds of all its Members, shall become a law. The President of the Ecnavian Federal Parliament shall act on every bill passed by the Ecnavian Federal Parliament within thirty days after the date of receipt thereof; otherwise, it shall become a law as if he had signed it.
(2) The President of the Ecnavian Federal Parliament shall have the power to veto any particular item or items in appropriation, revenue, or tariff bill, but the veto shall not affect the item or items to which he does not object.

The Ecnavian Council of Ministers

Section1. The council shall be compose of the head of states or governments of the member states of the Ecnavian Federation.
Sec.2. The council shall have the following responsibilities:
The Council shall pursue an independent foreign policy. In its relations with other states and regions, the paramount consideration shall be the sovereignty of the members, territorial integrity, regional interest, and the right to self-determination.

The Council shall promote a just and dynamic social order that will ensure the prosperity and independence of the nations and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living, and an improved quality of life for all.

The Council recognizes and shall promote through policies ;social justice in all phases of all national development.

The Council recognizes and shall promote through policies ;protect and promote the right to health of the people and instill health consciousness among them.

The Council recognizes and shall promote through policies ;protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature.

The Council recognizes and shall promote through policies ;give priority to education, science and technology, arts, culture, and sports to foster patriotism and nationalism, accelerate social progress, and promote total human liberation and development.

10. The Council recognizes and shall promote through policies ; affirms labor as a primary social economic force. It shall protect the rights of workers and promote their welfare.

11. The Council recognizes and shall promote through policies ;the indispensable role of the private sector, encourages private enterprise, and provides incentives to needed investments.

12. The Council recognizes and shall promote through policies ;recognizes and promotes the rights of indigenous cultural communities within the framework of regionall unity and development.

13. The Council recognizes and shall promote through policies ;shall encourage non-governmental, community-based, or sectoral organizations that promote the welfare of the nations.

Sec.3 The administrative head of the Council shall be the President of the Ecnavian Council, elected by the member ministers of the council for a term of six months.
2. He shall be the one to appoint the heads of the different committees of the Ecnavian Federation.
