I guess since I am now the President-Elect, I should describe my platform for my upcoming term. My platform is a very nice mahogony platform, held up by redwood beams (and the work of the proletariat, of course!). And not to be that over the top, it has some medium casting on the steps leading up to the platform itself. Lastly, there is a mahogany podium for my official RMB posts. Plus the podium has a cup holder for when I get thirsty during long posts. (See, I've thought of everything!) thank you for your time, DSA.

Preamble

We, the people of the Eurasian Socialist Union, have confirmed our Constitution and have ordered its promulgation in regards to our consolidated loyalty and efforts and, in order to perfect our Socialist Alliance, establish justice, insure domestic peace, provide for the common defence, promote general welfare, promote Socialist ideology, and secure the rights of Socialism and equality to both ourselves and our generations to come, Hereby establish this Constitution for the Eurasian Socialist Union.

Article I. Basic Rights of Residents

  1. All people within The Eurasian Socialist Union will hold the freedoms of religion, expression, association, as well as belief and speech (apart from the exceptions listed in Article II Clause II).

  2. All citizens within The Eurasian Socialist Union will have the right to vote and run in elections for public offices.

  3. Every individual is equal under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, skin color, religion, sex, sexual orientation, gender identity, age or mental or physical disability.

Article II. Political Views

  1. All nations within The Eurasian Socialist Union are allowed to run their internal affairs however they wish. They will not be persecuted because of their Category, Civil Rights, Economy, or Political Freedoms.

  2. Any nation that posts on the forum or regional message board material or speech that is considered hateful, racist, or openly pro-capitalist by the Chief Premier or Honour WA Delegate, that nation may be ejected and banned at any time.

Article III. Communication Codes

  1. No nation shall in any way directly emotionally assault another strictly on the basis of their political beliefs, and punishments will be dealt accordingly in an expedient manner by either the founder or the Judiciary depending on circumstances surrounding the incident. The founder maintains the right to kick all individuals from the region, but will generally refrain from doing so unless the case has been determined by him to have seditious intent. In all other situations, a civil court case will occur.

  2. No nation shall ever insult another nation based on religious views.

  3. On handling perceived emotional assaults, when one feels that his or her views have been insulted or slandered, he or she must immediately inform the offending party. If the offending party decides to continue with this path of action, the offended party will stop posting on the regional message board, and will submit a complaint to the Supreme Court, the Founder, and the Honour WA Delegate. Based on the circumstances, either an immediate ejection or a civil court case may occur.

Article IV. The Cabinet of the Eurasian Socialist Union

Section I. The Chief Premier
Subsection I. The Chief Premier's Authority and Duties
  1. The Chief Premier is the creator of the region and will always maintain their executive powers.

  2. The Chief Premier shall be the guardian of the region’s safety and performance.

  3. The Chief Premier has the ability of changing the region to password-protected if they worry of a threat.

  4. The Chief Premier has the ability of ejecting any nation if they have broken a rule.

  5. The Chief Premier has the ability to create embassies with other regions while consulting with the Minister of Foreign Affairs & The Premier.

  6. The Chief Premier has the ability to close embassies with other regions.

  7. The Chief Premier has the ability to create a Regional News Network.

  8. The Chief Premier has the ability to make State of The Region Addresses.

  9. The Chief Premier shall help defend the Constitution with all that he is capable of.

Subsection II. Restrictions The Chief Premier

  1. The Chief Premier may not elect any of his puppet nations into the regional government.

  2. The Chief Premier may not curtail any of the rights of the people expressed in this Constitution.

  3. The Chief Premier may not hold a place in the Regional Government.

  4. The Chief Premier may not make changes to the Constitution and the laws that preside them, although he is allowed to suggest laws to The Legislature.

Section II. The Honour WA Delegate
Subsection I. The Honour WA Delegate's Authority and Duties

  1. The Honour Delegate shall be the Eurasian Socialist Union’s representative in the World Assembly.

  2. The Honour Delegate may draft and sign peace treaties with other regions, along with the Assistance of the Chief Premier, Premier and the Minister of Foreign Affairs.

  3. The Honour Delegate should carry himself in a dignified and exemplary manner due to the fact that he is a chief representative of the region.

  4. The Honour Delegate shall submit proposals to the World Assembly on behalf of the region.

  5. The Honour Delegate has the ability to edit the World Factbook Entry if permission is given from Chief Premier.

  6. The Honour Delegate has the ability to password protect the Region from intruders, such as the Black Riders, or if a password is requested by the Region.

  7. The Honour Delegate has the ability to eject and/or ban nations from the Region with reasonable cause. (Ejection and Bans will be verified by the Chief Premier and Premier afterwards)

  8. Honour Delegate has the ability to make embassies with other regions, As long as consulted with the Minister of Foreign affairs and the other region has filled out an embassy request form.

Subsection II. Restrictions of The Honour WA Delegate

  1. The Honour Delegate may not eject or ban nations arbitrarily. The Delegate will be held accountable for any offense found.

  2. The Honour Delegate may not suppress messages on the Regional Message Board arbitrarily if it is the result of an argument or debate.

  3. The Honour Delegate may not commit a felony while in Office.

  4. The Honour Delegate may only and must submit proposals to the WA requested by the Cabinet or Legislature, by majority vote, or by a group of citizens numbering more than five persons.

  5. The Honour Delegate may tell a nation that they will eject the nation; but when they do they must show where the rule is that they broke. If a rule doesn’t exist they must speak to the founder or Prime Minister first.

  1. The Premier shall be the Eurasian Socialist Union’s Head of State.

Article VI. The Court System of the Eurasian Socialist Union

    Section I. Establishment, Authority, and Jurisdiction
  1. The Supreme Court of the Eurasian Socialist Union is the sole judicial body competent to hear disputes among Residents of the Eurasian Socialist Union at the first instance. It shall fairly administer justice within the Eurasian Socialist Union and uphold the Constitution at all trials and disputes with full nine-member Judiciary.

  2. The authority and duties of the Supreme Court include but are not limited to:

    1. Determining the scope of the Constitution when applied to various rulings

    2. Determining the legality of pending and passed legislation

    3. Determining the legality of Cabinet Members’ official decisions and actions

    4. Determining the legality of treaties

    5. Resolving disputes among Residents

    6. Investigating various claims as requested

    7. Sentencing or pardoning Residents that are successfully impeached by the Legislature

    8. Determining the legality of the Honour WA Delegate's or Chief Premier's placing any nation on the Eurasian Socialist Union’s ban list.

  3. The jurisdiction of the Court shall extend to all Residents of the Eurasian Socialist Union.

Section II. Structure and Responsibilities

  1. A Supreme Court Justice is to be an individual responsible for ensuring that justice is ensured within the Eurasian Socialist Union. He or she may be sponsored into the position by either the Founder or the WA Delegate, but must have previously served in a Governmental Position for at least 5 days.

  2. There will be 9 members of the Supreme Court, and they may only be removed with with a proper Legislative process.

  3. The Chief Justice is responsible for organizing the proper distribution of cases to maintain timeliness and impartiality.

  4. No sitting justice shall fire a request for judicial review.

  5. No justice, even the Chief Justice, will ever speak for the Supreme Court unless a majority vote on the issue at hand has been achieved.

  6. The implied powers of any one justice may be overturned by the mere power of one official. It may be reinstated at the earliest possible date with a 2/3 vote by the Legislature.

Section III. Cases

  1. Each case or request for an advisory opinion submitted to the Supreme Court shall be given a title. In the case of contentious issues, the title shall be of the form “A v. B”, with the names of the two parties in alphabetical order. In the case of advisory opinions, the title shall be of the form “In re A”, with A being the subject in question. In the case of impeachments, the title shall be of the form “Impeachment of A”, with A being the name of the nation in question.

Section IV. Proceedings

  1. The proceedings of the Supreme Court shall be public.

  2. In contentious issues, the party bringing the case to the Supreme Court shall submit an initial statement to which the defending party shall have the opportunity to respond.

  3. Nations at trial have the right to the assistance of other nations in making their case. They may call witnesses whose testimony the Supreme Court shall have power to compel and may be represented by another nation of their choice. They may not be compelled to testify against themselves.

  4. The parties shall have the opportunity through the Supreme Court to ask each other questions and cross-examine those testifying.

  5. The Supreme Court may require from Residents in the form of a written and public subpoena any evidence that it deems necessary to make its decisions, including private communications and telegrams, and may compel parties to give testimony before the Supreme Court. The refusal of such information or testimony shall constitute contempt of court, which the Supreme Court may punish.

  6. Testimony given before the Supreme Court will be subject to penalty for perjury.

  7. At all controversies before the Supreme Court, all Residents shall have the right to submit whatever briefs, comments, or other information for consideration that they wish.

Section V. Decisions

  1. The Supreme Court shall issue a written opinion on each of its decisions.

  2. Penalties imposed by the Supreme Court in cases of impeachment shall be limited to removal from office and, optionally, disqualification from holding office under the Eurasian Socialist Union for a certain period of time or indefinitely.

  3. No penalty may be imposed as part of an advisory opinion.

  4. Penalties imposed by the Supreme Court in the case of contentious issues may include:

    1. Formal reprimand,

    2. Placing a nation under a period of probation, during which any new offense may be punished with a greater than usual degree of severity,

    3. Disqualification of a nation from holding office under the Eurasian Socialist Union for a period of time or indefinitely,

    4. Recommendation to the Chief Premier or Honour WA Delegate that a nation be expelled from the Eurasian Socialist Union , or

    5. Any combination of the above

  5. The Supreme Court may choose not to impose a penalty in contentious cases, letting its decision stand for itself as a form of justice.

  6. Penalties shall be proportional to the severity of the offense committed.

Article VII. Voting and Elections

Section I. Voting

  1. Only citizens may vote in any election.

  2. The Chief Premier shall appoint an Elections Supervisor to serve until resignation or replacement by a better replacement.

  3. The Elections Supervisor responsibilities shall be to announce the upcoming elections at least 5 days before the standing period for an election begins, explain the qualifications needed for people to run and vote in elections, open up the standing period for elections, open the polls, and close the polls.

  4. Citizens will be able to be nominated and stand for office and campaign starting on the 1st to the 5th of an election month.

  5. Voting in any election shall begin on the 6th of an election month and end on the 10th.

  6. The Cabinet, The Speaker of Parliament, The Pro Tempore of Parliament, The Speaker of Regional Council, and The Pro Tempore of Regional Council shall each be elected to 3- month terms, in the months of January, April, July, and October.

  7. The members of the Judiciary shall each be elected to 6-month terms, in the months of January and July.

  8. Candidates for these elected offices must be a Resident of the Eurasian Socialist Union for a minimum of ten (10) calendar days when nominations begin.

  9. All winning candidates in any election for a public office must take the following Oath, administered by the Supervisor of Elections:
    "I, (name), promise to preserve, defend and uphold the Constitution, observe the laws, promote the general welfare of the people, and faithfully execute the duties of the office of (name of position)."

Article VIII. Disciplinary Consequences

Section I. Ejection and/or Banning
  1. Ejection and/or banning from the region The Eurasian Socialist Union may be prescribed as a punishment for violations of regional laws and/or the Constitution.Violation of forum Terms Of Service and moderation policies remain the responsibility of forum administration.

  2. The Chief Premier and Honour WA Delegate is permitted to eject and/or ban violators of NationStates rules, regional laws, and/or the Constitution with probable cause and must present conclusive evidence to the region and Government.

  3. The Chief Premier or Honour WA Delegate is required to eject and/or ban Nations and/or Players that have been sentenced in the Courts to be ejected or banned from the region for breaking regional laws.

Section II. Impeachment

  1. Any member of The Legislative Branch may bring up articles of impeachment against the Premier, Honour WA Delegate, any Minister, Speaker, or Pro Tempore.

  2. The proposed impeachment must have the support of at least 4 other member of the Legislative Branch.

  3. The Pro Tempore shall then begin a vote no shorter than 48 hours and no longer than 96 hours on the proposed impeachment.

  4. A proposed impeachment must obtain a two thirds majority to pass.

Section III. Legal Recourse

  1. In the case where a Nation feels that their disciplinary consequence was unwarranted, they may appeal their case to the Supreme Court that shall have the power to overturn the Chief Premier/Delegate's ruling.

  1. The Legal Code shall consist of Laws passed by Parliament and carried over by agreement from previous governing documents.

Article X. Miscellany

  1. I. The Constitution has full constitutional authority with all the rights and privileges that come with that authority. The Legal Code is second only to the previous in legal force. In case of conflict in wording, the Constitution take precedence. Any and all other regulations and guidelines are lower in authority than the Legal Code unless otherwise specified.

  2. All Government bodies are allowed to create rules for its own governance.

  3. If any elected official should fail to check into their account for one week without prior notice, the dual consent of the Chief Premier and Honour WA Delegate will ask the elected official's Deputy-Minister to be the respective ministry's replacement. This Deputy-Minister replacement will fulfill the remainder of the term.

Article XI. Amending the Constitution

  1. I. Only members of The Legislative Branch may propose changes to the Constitution.

  2. The Constitution may only be changed via constitutional amendment with the approval of two thirds of votes cast in the Parliament in a vote lasting seven days.

  3. An approved constitutional amendment is not subject to veto.

I've just taken a look at The Red and Black regional activity and it seems like Proletarya, a nation that used to be here two weeks ago, was actually one of Castlemaine's puppets.
That's how all the fuss around Misley's puppet sweep started... he was monitoring our RMB. I have to confess, I find his acting skills are pretty good.

Anybody hear about the old DC Madam scandal being relevant to this year's election? I normally avoid gossip and tabloidism, but I can't stand being told half the story and then left hanging.

So, what... out of the pool of the dozen candidates, that leaves only a handful that frequent the DC area. Cruz, Rubio, Paul, maybe Hillary (through Bill), Sanders...? O'Malley's from neighboring Maryland, and Fiorina and Trump have operated businesses in the region, but would be unlikely to have been solicited as they were not natives to capitol hill.

Anyone watch the debate last night? I thought Clinton really had Sanders on the ropes at times. Was very disappointed in how much Sanders bent the truth and put up a poor performance. However, he did absolutely get her with his retaliation to her saying his fight against money in politics was just a smear against her. Anyone else's opinions?

I wish they would just debate the issues and not set it up like they do. It's so counterproductive in the current made for TV model they have now where some person asks loaded questions and then they start calling each other names or saying what they think will get them elected...

Why monitor us? It's not like we are super involved in the Red Fleet or The Internationale's affairs outside of a few nations lending their help here and there...

I wasn't, I was waiting until the Internationale was unlocked or they moved to a back up region. What I said before was true, neither I nor the CL have any quarrel with this region.

I think Hillary makes it extremely hard to take her seriously when she whines about being called out on taking bribes.
