Constitution of Oceanside
Preamble. Oceanside is a flourishing region, and we worry that our policy of freedom may attract hateful spammers. We believe that a loosely organized government is best for Oceanside's growth as a fun, games, and freedom-loving region. As such, we desire a new constitution, to replace the old one, which was incomplete at best but will serve as a Bill of Rights. This will strengthen our region's future relationships externally and internally.
Article I. Organization of Oceanside's Government
I. The delegate shall be elected every 120 days by a vote among the citizens of Oceanside. Puppet votes will not count. In the event of a tiebreak, the delegatial candidates will be allowed three days to campaign more, followed by another vote.
II. The delegate shall appoint a Head Advisor, who will be in the Council of Oceanside and also become the delegate in the event the current delegate becomes unable carry out his or her duties. The Head Advisor will only complete the delegate's term, but may run for re-election for the next term.
III. To prevent corruption, the citizens may then appoint two more nations to serve on the Council of Oceanside with the Head Advisor, who will be appointed by the Delegate. They will be selected in a separate election. In the event that the Head Advisor is unable to carry out his/her duties, the Council of Oceanside member who received more votes in the election will take over, followed by the other one.
IV. Citizens may submit amendments to the Council of Oceanside for review. If a majority vote is passed, the bill goes to the delegate, who has the option to veto it. The delegate may not veto a 3-0 vote among the Council, however.
V. Bills may not ban an ideology nor relate to the internal doings of Oceanside's member nations. They may only concern how nations interact with each other and with foreign regions.
VI. The Delegate may also select various other officers if need be. However, the delegate may not appoint council-members no matter what.
VII. It is understood that the price of having free voice to propose laws is that nations must also follow laws. If they do not, their right to make laws may be removed. If a nation is prosecuted of not following Oceanside laws, a possible punishment is to have law-writing privileges revoked for a period of time depending on the severity of the infraction.
Article II. Processes of Justice.
I. If a nation is thought to be guilty of violating an Oceanside act, they will have two days after the prosecution case is submitted to submit their case of innocence to the Council of Oceanside. Both prosecuting and defending cases shall be publicly posted on the RMB. Accusations with evidence will be taken more seriously than accusations without evidence. The Council will then vote GUILTY, INNOCENT, or ABSTAIN. Accused or prosecuting council-members will be replaced by the delegate or, in cases where the delegate is accused or prosecuting, by the Founder. If there is a tie, ABSTAINING votes will have to change their votes.
II. If the GUILTY decision is made, the Council will then decide on a suitable punishment. The punishment will then be carried out. However, member states have the right to avoid cruel and unusual punishment, such as a sentence of "TG Super-Llamaland 'I will not be a bad nation' 3,600 times. You may not copy-paste."
Article III. Rights and Obligations of Oceanside Nations
All Oceanside members inherently reserve the
I. Right to Free Speech and Free Belief. No nation should be banned for intraregional political beliefs or real-life political beliefs.
II. Right to Protection. It is the delegate's responsibility to alert nations of Oceanside on possible interregional safety risk. If the delegate is seen to be acting against the safety of Oceanside, he or she should be replaced immediately.
III. Right to RMB Safety. Trolling, spamming, and any recruitment messages will be cracked down upon.
IV. Right to Free WA Activity. Nations may endorse and vote as they wish. Nations may also voice opinion on whether or not a delegate should accept a WA proposal.
V. Right to Puppets. We won't crack down upon puppets, as long as you say they're puppets. Nations should not be incorrectly called puppets.
VII. Right to Democracy. Nations will vote on a new delegate every 120 days. The new delegate will always appoint appropriate directors.
Nations also have the obligation to...
I. Vote if you are eligible. A democracy thrives on voting. It is a member states's duty to help support our democracy by voting on elections, amendments, and other resolutions. Only nations that satisfy at least one of the following three requirements are eligible to vote:
a.) has an Oceanside influence of twelve or over
b.) has written at least one Council-approved Oceanside Amendment, regardless of citizen voting
c.) has at least three recommendations from nations that can vote in Oceanside
II. Be active on the RMB. Oceanside should be fun, and we require active nations to do that. Posting funny tidbits on the RMB is the easiest way to improve Oceanside.
III. Follow Laws. The Laws of Oceanside are relatively lax and have been instituted for a reason. If you break a law and are caught, you will suffer the consequences.
IV. Act Responsibly and Appropriately. Nobody likes the trollers, spammers, or posters of inappropriate things. Do not do this on the RMB or in TGs to citizens of Oceanside.
V. Spread a good image of Oceanside. Be responsible on the Forums and on other region's message boards. We do not want foreign regions to think Oceanside is composed of idiot spammers. Follow international rules as you would ours, although breaking those will not have you tried in our courts.
Article IV: Interregional Relationships
I. Oceanside is a neutral region, neither raider nor defender. Nations that engage in raiding and defending activity while residing in Oceanside are not supported by Oceanside, and they should not say that their activities are supported. The only exception is if it is to defend an allied region.
II. A unanimous vote among the Council of Oceanside and a "yes" vote from at least 80% of all voting citizens is enough to move the region to the raiding or defending side. However, to move back to neutral, Oceanside only needs a majority Council vote and a "yes" vote from 50% of the voters. The only exception is if it is to defend an allied region.
III. Neutral Oceanside may only pursue embassies with other neutral regions who have at least ten nations and are not permanently password-protected. If Oceanside were to move to one side, they could not pursue an embassy with the other, but they could still pursue embassies with neutral regions. Example: if Oceanside were to become defender, they could not have embassies with raider regions, but they could have embassies with defender or neutral regions.
IV. Oceanside will act with courtesy when dealing with other regions in interregional politics.
Article VI. Wartime Processes
I. With a majority vote amongst the council, the founder may eliminate delegate administrative powers at any time that an attack or instability is suspected.
II. If multiple foreign WA nations come in and immediately make any attempt at the delegacy, the founder does not need permission to eject them. However, the founder may only ban them with votes from two Council-members. The delegate may do the same thing with the permission of the founder and one other Council-member.
III. If Oceanside’s delegacy is seized for a period of over twenty days and the invaders remain in the region, Oceanside’s Council must take on efforts to refound Oceanside.
IV. A saved copy of the factbook entry, recruitment telegram, and relevant government documents must be kept at all times in the event of an invasion.
Article VII. Tolerance of Spamming and Community Safety
The Oceanside Council,
Wishing to keep free speech while cracking down on spamming,
Hereby mandates the following:
1.) No recruitment for other regions, UNLESS in the situation where an allied region is being raided and needs our help, is allowed on the RMB or by telegram.
2.) Recruitment on the RMB will be suppressed and the recruiters ejected. Second-time violators will be banned from Oceanside.
3.) Recruitment by TG must be reported to the delegate along with a copy of the recruitment telegram. Any TG recruiter for a foreign region will be immediately banned.
Also Mandates the following:
1.) All nations reserve the right not to join Non-Oceanside related NS activities and can only be encouraged, not forced, to do so.
2.) All nations reserve the right not to join Non-NS related activities.
3.) All nations reserve the right not to give up personal information.
4.) All nations reserve the right to ignore telegrams asking them to participate in the first three.
5.) Infringement on these rights will result in a warning, ejection, impeachment, or banning, depending on the severity.
